DECREE OF June 5, 2009.

Disposes on the creation of the Green Canto Extractivist Reserve, in the Municipality of Beberibe, in the State of Ceará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 18 of the Law n^o 9,985, of July 18, 2000, and in the Decree n^o 4,340, of August 22, 2002, and what appear in the Process n^o 02007.003650 /2001-61,

DECRETA:

Art. 2^o The Extracactivist Reserve ora created is aimed at protecting the means of living, culture and ensuring the use and conservation of renewable natural resources traditionally used by the excerptive population of the Green Canto Pqueen community, resident in the area of reservation comprehension and too much populations inhabitants of contiguous areas.

Art. 3^o Caberá to the Chico Mendes Institute of Conservation of the Biodiversity-Chico Mendes Institute to administer the Pqueen Extrativist Reserve of the Green Canto, adopting the necessary measures for its implantation and control, in the terms of the art. 18 and 23 of the Law n^o 9,985, of July 18, 2000.

Single paragraph. The organs of the Federal Public Administration will be able to, in the form of the law, firm up instruments with the Chico Mendes Institute, aiming at the efficiency of the management of the federal public heritage located within the Extrativist Reserve.

Art. 4^o Ficam declared of social interest, for the purposes of misappropriation, in the form of the Law n^o 4,132, of September 10, 1962, the rural real estate of legitimate private domain and its benefits that come to be identified in the Pqueen Extrativist Reserve of the Green Canto, for the purposes set out in the art. 18 of Law No. 9,985, of 2000.

§ 1^o The Chico Mendes Institute gets authorized to promote and execute the misappropriations of which it treats this article, and may, for the purpose of immission of possession, claim the urgency to which art relates. 15 of the Decree-Law n^o 3,365, of June 21, 1941.

§ 2^o The Federal Prosecutor-General's Office, the organ of the Advocate General of the Union, through of its legal unit of implementation with the Chico Mendes Institute, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of possible property titles and their records real estate considered irregular, incidents in the conservation unit ora created.

Art. 5^o This Decree comes into effect on the date of its publication.
