Declarations of public utility, for the purposes of dispropriation, in favor of the concessionary Autopista Sul S.A., the real estate it mentions, located in the Municipality of Itajaí, State of Santa Catarina.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 in the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and in accordance with that appearing in the ANTT Process No. 50500.117168 /2012-32,

D E C R E T A:

Art. 1º Become declared of public utility, for purposes of disappropriation, in whole or in part, in favour of the concessionary Coastal Sul S.A., the real estate delineated by the topographical coordinates described below, excluded the domain goods public, situated on the banks of the Highway Governor Mário Covas, BR-101 /SC, located in the Municipality of Itajaí, State of Santa Catarina, necessary for the complementation of the execution of the pedestrian walkway implantation works at km 116 + 900m:

I-area 1-defined by the Plants Plants in the U.T.M. System -SIRGAS 2000, starts the description of this perimeter at the vertex P1, of coordinates N (Y) 726171, 636 and E (X) 7024020, 98, situated at the boundary with public utility area; of this, follows with azimuth of 289 ° 29 ' 07 " and distance of 14 ,79m, confronting in this excerpted with public utility area, up to the vertex P1A, of coordinates N (Y) 726176.522 and E (X) 7024007, 173; of this, follows with azimuth of 254 ° 32 ' 42 " and distance of 2.51m, confronting in this excerpts with Mechanics of Vehicle Piçarras Ltda., up to the vertex P5A, of coordinates N (Y) 726174, 177 and E (X) 7024006, 448; of this, follows with azimuth of 340 ° 30 ' 56 " and distance of 14 ,47m, confronting in this excerpt with Posto Santa Rosa Ltda., up to the vertex P6, of coordinates N (Y) 726169, 279 and E (X) 7024020.048; of this, follows with azimuth from 70 ° 33 ' 26 " and distance of 2.50m, confronting in this stretch with Posto Santa Rosa Ltda., up to the vertex P1, of coordinates N (Y) 726171, 636 and E (X) 7024020, 98, thus closing the perimeter with 34 ,12m and the area with 36.39 m²; and

System -SIRGAS 2000, initiates the description of this perimeter at the vertex P1A, of coordinates N (Y) 726176.522 and E (X) 7024007, 173; of this, follows with azimuth of 160 ° 30 ' 56 " and distance of 37 ,26m, confronting in this stretch with public utility area, up to the vertex P2, of coordinates N (Y) 726188.948 and E (X) 7023972.050; of this, it follows with azimuth of 70 ° 33 ' 26 " and distance of 2.31m, confronting in this stretch with public utility area, up to the vertex P3, of coordinates N (Y) 726191.120 and E (X) 7023972.816; of this, follows with azimuth from 160 ° 60 '14 "and distance of 30 ,85m, confronting in this stretch with the Governor's Rodovia Mário Covas, 101/SC, up to the vertex P4, of coordinates N (Y) 726201.389 and E (X) 7023943, 730; of this, follows with azimuth of 230 ° 50' 36" and distance of 4.78m, confronting in this stretch with Mechanics of Vehicle Piçarras Ltda., up to the vertex P5, of coordinates N (Y) 726196, 881 and E (X) 7023942.135; of this, follows with azimuth of 340 ° 31'06 " and distance of 68 ,27m, confronting in this excerpts with Mechanics of Vehicles Piçarras Ltda., up to the vertex P5A, of coordinates N (Y) 726174.106 and E (X) 7024006.504; of this, follows with azimuth of 74 ° 29 ' 25 " and distance of 2.51m, confronting in this excerpt with Posto Santa Rosa Ltda., up to the vertex P1A, of coordinates N (Y) 726176.522 and E (X) 7024007, 173, thus closing the perimeter with 143.46 m and the area with 241.22 m².

Art. 2º It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the land areas and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exime the dealership from the prior obtaining of the legislative authorizations that are perhaps due, from the licensing and the fulfilment of the obligations to the environmental entities and to the other bodies of the public administration, necessary for the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree takes effect on the date of its publication.
