DECREE NO. 7,127, OF March 4, 2010.

Approves the Regimental Structure and the Demonstrative Frame of the Positions in Commission and Gratified Functions of the Ministry of Agriculture, Livestock and Supply, and gives other arrangements.

The PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives it the art. 84, incisos IV and VI, paragraph (a) of the Constitution, and with a view to the provisions of the art. 50 of the Law no 10,683, of May 28, 2003,

DECRETA:

Art. 1st Stay approved the Regimental Structure and the Demonstrative Table of the Cargos in Commission and Functions Gratified from the Ministry of Agriculture, Livestock and Supply, in the form of the Annexes I and II.

Art. 2nd In due to the provisions of the art. 1st, stay remanded, in the form of Annex III, the following posts in committee of the Group-Direction and Superiors Superiors-DAS:

I-from the Office of Management, the Ministry of Planning, Budget and Management, to the Ministry of Agriculture, Livestock and Supply: twenty-nine DAS-101.2; five DAS 101.1; three DAS 102.4; and two DAS 102.3; and

II-of the Ministry of Agriculture, Livestock and Supply to the Office of Management, Ministry of Planning, Budget and Management: three DAS 101.4; two DAS 101.3; twenty-nine DAS 102.2; and five DAS 102.1.

Art. 3rd The apostilaments arising from the approval of the Regimental Structure of which treats the art. 1st shall occur within twenty days, counted from the date of publication of this Decree.

Single paragraph. After the apostilaments provided for in the caput, the Minister of State for Agriculture, Livestock and Supply shall be publishing in the Official Journal of the Union, within sixty days, counted from the date of publication of this Decree, nominal relationship of the holders of the posts in committee of the Group-Direction and Superiors Superiors-DAS referred to in Annex II, indicating, including, the number of vacant positions, their denomination and their respective level.

Art. 4th The Minister of State for Agriculture, Livestock and Supply may edit internal regiment to detail the integral administrative units of the Ministry's Regimental Structure, its competencies and the assignments of its leaders.

Art. 5th This Decree comes into effect on the date of its publication.

Art. 6th Ficam revoked the Decree no 5,351, January 21, 2005, the Annex and the arts. 1º and 2nd of the Decree No 6,348, of January 8, 2008.

ANNEX I

REGIMENTAL STRUCTURE OF THE

MINISTRY OF AGRICULTURE, ANIMAL HUSBANDRY AND SUPPLY

CHAPTER I

OF THE NATURE AND COMPETENCE

Art. 1st The Ministry of Agriculture, Livestock and Supply, the body of direct administration, has as an area of competence the following subjects:

Agricultural policy, covering production and marketing, supply, storage and guarantee of minimum prices;

II-production and fomenting agrolivestock, inclusive of the activities of heveiculture;

III-market, marketing and agrolivestock supply, inclusive regulatory and strategic stocks;

IV-agricultural information;

V-defense animal and plant health;

VI-surveillance of inputs used in the agri-related activities and service provision in the sector;

VII-classification and inspection of products and animal and plant derivatives, including in actions supporting the activities exerted by the Ministry of Finance, regarding foreign trade;

VIII-protection, conservation and manhandling of soil, oriented to the agricultural and livestock productive process;

IX-technological research in agriculture and livestock;

X-meteorology and climatology;

XI-cooperativism and rural associativism;

XII-energization rural, agroenergy, inclusive rural electrification;

XIII-technical assistance and rural extension;

XIV-policy relative to coffee, sugar and alcohol; and

XV-planning and exercise of government action in the activities of the Canavian agroindustrial sector.

Art. 2nd Compete, still, to the Ministry of Agriculture, Livestock and Supply to address international agricultural negotiations and support the actions exerted by other Ministries, regarding foreign trade.

CHAPTER II

CHAPTER III

DAS COMPETENCIES OF THE ORGANS

Section I

From the Direct and Immediate Assistance Bodies to the Minister of State

Art. 4th To the Cabinet competes:

I-watch to the Minister of State in his political and social representation;

II-occupy public relations and promote the activities of agenda, ceremonial, institutional promotion and events, prepares and dispatching of the expedients of the Minister of State;

III-arrange for official publication and the disclosure of the subjects related to the acting area of the Ministry;

IV-coordinate the execution, follow-up and evaluation of the activities of the Minister's Office;

V-promoting the development of the activities concerningthe relationship of the Ministry with the Legislative Power, in particular in the follow-up of projects of interest and in the care of the consultations and requirements, depending on the normative orientation of the central body of the Legislative Monitoring System;

VI-promoting the communication activities of government, in scope of the Ministry, depending on the normative orientation of the central body of the Government Communication System of the Executive Power; and

VII-exercise other assignments that are committed to it by the Minister of State.

Art. 5th To Strategic Management Advisory competes:

I-promote the strategic management of the Ministry;

II-coordinate the elaboration of the strategic planning of the Ministry and, especially:

a) develop the prospection of scenarios based on the policies and government guidelines;

b) consolidate the institutional project as to the mission, the vision of the future and the sectoral guidelines; and

c) follow up the unfolding of the guidelines on goals and the establishment of the respective performance indicators;

III-promote and support the elaboration of the plans and programs in an articulated and systemic way; and

IV-proceed to the strategic articulation of specific institutional affairs, determined by the Minister of State.

Art. 6th To the Executive Secretariat competes:

I -attend the Minister of State in the supervision and coordination of the activities of the integral Secretaries of the structure of the Ministry and the entities to it linked;

II-supervise and coordinate, within the Ministry's scope:

a) the activities related to the federal systems of planning and budget, financial administration, accounting, administration of information and informatics resources, of human resources, general services, archive document management, organisation and institutional innovation and of civil personnel; and

b) the activities related to the discipline, the documentary information agrolivestock and the follow-up of the decentralized units, the linked entities and the collegiate bodies, including of the sectoral and thematic chambers;

III-promote the execution, follow-up and evaluation of the relevant programs and actions;

IV- assist the Minister of State in the setting of the guidelines and the implementation of the matters of the Ministry's area of competence;

V-carry out intakes of expense payers' accounts and too many responsible for public goods and values and all the one who gives cause for loss, stray or irregularity that results in damage to the erarium;

VI-orient and coordinate the analyses of the benefits of accounts of the convents firmed up within the Ministry; and

VII-exercise other assignments that are committed to it by the Minister of State;

Single paragraph. The Executive Secretariat competes, still, the role of the sectoral body of the Civil Personnel System of the Federal Administration-SIPEC, the Administration System of Information Resources and Informatics-SISP, of the General Services System-SISG, of the Federal Planning and Budget System, the Federal Financial Administration System, the Federal Accounting System, the National Archives System, the File Document Management System-SIGA and the Organization System and Institutional Innovation-SIORG.

Art. 7th À Subsecretariat of Planning, Budget and Administration compete:

I-plan and coordinate, within the Ministry's scope, the execution of the activities related to the systems of which it treats the single paragraph of art. 6o;

II-promote the articulation with the central bodies of the federal systems referred to in the inciso I, inform and guide the organs of the Ministry as to the fulfilment of the established administrative standards;

III-orient the formulation and consolidate the proposals budget of the Ministry and its linked entities, understanding the fiscal budget and that of social security, compatibilizing them with the goals, targets and allocation of resources, in compliance with the guidelines laid down by the body central of the Federal Planning and Budget System;

IV-promote the elaboration and consolidation of the plans and programs of the activities of their area of competence and submit them to the top decision;

V-coordinate the elaboration and consolidation of the plans and programs of the Ministry's finalistic activities, their budgets and alterations, as well as subjecting them to the top decision;

VI-follow and promote the evaluation of projects and activities;

VII-manage the resources of the Federal Agrolivestock Fund and too much transfers and financial revenues;

VIII-develop, in the framework of the Ministry, the activities of budgetary, financial and accounting execution; and

IX-exercise other assignments that are committed to it by the Executive Secretary.

Art. 8th To Legal Consulting, the sectoral body of Advocate General of the Union, competes:

I-advise the Minister of State in matters of a legal nature;

II-exercise the supervision of the activities of the legal organizational units of the linked entities;

III-fixing the interpretation of the Constitution, das laws, of the treaties and of the remaining normative acts to be uniformly followed in their area of acting and coordination, when there is no normative orientation of the Union Advocate General;

IV-elaborate studies and prepare information, by request of the Minister of State;

V-watch the Minister of State in the internal control of the administrative legality of the acts to be by him practiced or already effective and of those arising from organs or entities under his legal coordination;

VI-examine, preview and conclusively, in the framework of the Ministry:

a) the edital texts of bidding, as well as those of the respective congenneric contracts or instruments, to be published and celebrated; and

b) the acts by which one is going to recognize the inexigibility, or decide the bidding dispensation;

c) the terms of congeniuses;

VII-examine orders and judicial sentences and guide the ministry officials as to their exact compliance; and

VIII-collate elements of fact and law and prepare the information that is to be provided by Ministry officials in lawsuits, as well as information requested by the Advocacy-General of the Union.

Art. 9th To Ouvidoria competes:

I-receive and forward the complaints, complaints, representations and suggestions regarding procedures and actions of agents, administrative units and linked entities, within the Ministry's scope;

II-informing the interested the progress and the result of the arrangements adopted in relation to the manifestations received;

III-organize and interpret the set of the received manifestations and produce statistics indicative of the level of satisfaction of the actors involved with the activities under the competence of the units of the structure of the Ministry and the linked entities;

IV-submit recommendations to the Minister of State aiming at the enhancement and correction of situations of inappropriate operation of the activities under the competence of the units of the structure of the Ministry and the linked entities;

V-acting as additional channel of communication between the server and the Minister of State; and

VI-divulge its competencies to the agents involved with the activities under the competence of the units of the structure of the Ministry and the linked entities.

§ 1st The Ouvidor will exercise its assignments with autonomy and independence.

§ 2nd The Ouvidor will forward semester report of your activities to the Minister of State, without prejudice to the forwarding, at any time, of information or recommendations that understand pertinent.

§ 3rd The Ouvidoria will keep the secrecy of the source when the person concerned expressly requests the preservation of his / her identity.

§ 4th The Secretariat-Executive Office of the Ministry will ensure the appropriate means of the exercise of the activities of the Ouvidoria.

Section II

Of The Singular Specific Organs:

Art. 10. To the Secretary of Defense Agropecuaria compete:

I-contribute to the formulation of agricultural policy with regard to agri-agri defence;

II-plan, normatize, coordinate and supervise the agri-defense activities, in particular:

a) animal health and plant sanity;

b) surveillance and inspection of products, derivatives, by-products and residues of animal and plant origin;

c) supervision of agrolivestock inputs;

d) laboratory analysis as a support to agri-defense actions; and

e) sanitary, animal and plant certification;

III-coordinate the execution of the agri-defense activities concerning international transit at borders, sea and river ports, airports and customs stations, referring to the products and agrolivestock inputs;

IV-formulate proposals and participate in negotiations of international agreements, treaties, or international agreements concerningthe themes of agri defence, in articulation with the other organs of the Ministry;

V-coordinate the elaboration, promote the execution, follow up and evaluation of the programs and actions of the Registry;

VI-promote the deployment of the management systems of the Registry and update the database with information technical-operational and strategic;

VII -to deploy and implement the actions arising from decisions of international bodies and acts and of treaties, agreements and arrangements with foreign governments concerning the matters of their competence;

VIII-promoting intra-sectoral and intersectoral articulation necessary to carry out the agri-defence activities;

IX-propose programming and follow up with the implementation of capacity-building and training of human resources and collaborators, in fulfillment of the specific technical demands;

X-assist the Minister of State in the setting of the guidelines and in the implementation of actions of the Ministry;

XI -to subsidize the Strategic Management Advisory with specific information necessary to the operationalization of the strategic planning of the Ministry; and

XII-exercise other assignments that are committed to it by the Minister of State.

Single paragraph. To the Secretary of Defense Agropecuaria also competes in the coordination of the Unified System of Attention to Agrolivestock Sanity, of the Brazilian System of Vegetable Origin Product Inspection, of the Brazilian System of Animal Source Inspection of Animal Origin, of the Brazilian System of Inspection of Agrolivestock Insumers, and of the Traceability Service of the Productive Chain of Bovine and Bubalinos-SISBOV.

Art. 11. To the Department of Surveillance of Agricultural Insummits compete:

I-draw up the government action guidelines for the surveillance and quality assurance of agricultural inputs, with a view to contributing to the formulation of agricultural policy;

II-program, coordinate, and promote the execution of the activities from:

a) inspection and surveillance of agrotoxic, its components and related;

b) inspection and surveillance of the production, certification and marketing of seeds and seedlings; and

c) surveillance of the production and marketing of fertilizer, corrective and inoculants;

III-promote technical-fiscal and operational audits of the activities of its competence;

IV- formulate proposals and participate in negotiations of international agreements, treaties or arrangements, concernin the themes concerning the quality of agricultural inputs, in articulation with the other organizational units of the Ministry's bodies; and

V-coordinate the elaboration, promote the execution, monitoring and evaluation of the programs and actions of the Department.

Art. 12. To the Department of Surveillance of Insumos Livestock competes:

I-draw up the government action guidelines for the surveillance and quality assurance of livestock inputs, with views to contribute to the formulation of agricultural policy;

II-program, coordinate, and promote the execution of the activities from:

a) inspection and surveillance of veterinary use products; and

b) inspection and surveillance of products intended for animal feed;

III-participate in the definition of the requirements required for organic products, in articulation with the Department of Animal Health;

IV-promote technical-fiscal and operational audits of the activities of its competence;

V- formulate proposals and participate in negotiations of international agreements, treaties or arrangements, concernin the themes concerning the quality of livestock inputs, in articulation with the other organisational units of the Ministry's bodies; and

VI-coordinate the elaboration, promote the implementation, monitoring and evaluation of the programmes and actions of the Department.

Art. 13. To the Animal Source Products Inspection Department competes:

I-elaborate the governmental action guidelines for the inspection and surveillance of products and derivatives of animal origin, with a view to contributing to the formulation of agricultural policy;

II-program, coordinate, and promote the execution of the inspection activities and sanitary and industrial surveillance of products of animal origin;

III-promote technical-fiscal and operational audits of the activities of its competency;

IV-formulate proposals and participate in negotiation of agreements, international treaties or arrangements, concernin the topics concerning the inspection of products of animal origin, in articulation with the other organizational units of the Ministry's organs; and

V-coordinate the elaboration, promote execution, follow-up, and evaluation of the programs and actions of the Department.

Art. 14. To the Department of Product Inspection of Vegetable Origin compete:

I-draw up the governmental action guidelines for the inspection and surveillance of products of vegetable origin, with views to contribute to the formulation of agricultural policy;

II-program, coordinate, and promote the execution of the activities from:

a) surveillance and inspection hygienic-sanitary and technological products of plant products and their derivatives;

b) surveillance and hygiene-sanitary and technological inspection of beverages, vinegars, wines and derivatives; and

c) surveillance of the classification of plant products and their derivatives, byproducts, and waste of economic value;

III-promote technical-fiscal audits and operational of the activities of its competence;

IV-formulate proposals and participate in negotiations of international agreements, treaties or arrangements, concerningto the themes concerning the inspection of products of vegetable origin, in articulation with the rest organizational units of the Ministry's organs; and

V-coordinate the elaboration, promote the execution, monitoring and evaluation of the Department's programs and actions.

Art. 15. To the Department of Sanity Vegetal compete:

I-draw up the government action guidelines for plant sanity, with views to contribute to the formulation of agricultural policy;

II-program, coordinate, and promote the execution of the activities of:

a) phytosanitary surveillance, inclusive of the definition of phytosanitary requirements to be observed in the transit of plants, products and derivatives of vegetable origin and agricultural use materials;

b) prevention and control of pests, in particular the definition of phytosanitary requirements to be observed in the import and export of agrotoxic, seeds and seedlings and vegetable products destined for animal feed;

c) surveillance of the transit of vegetables, parts of vegetables, their products, by-products and derivatives, including the application of phytosanitary requirements to be observed in import and export; and

d) promotion of education campaigns and too many actions of phytosanitary defense;

III-promote technical-fiscal and operational audits of the pertinent activities of its competence;

IV-formulate proposal and participate in negotiation of agreements, international treaties or convents, concernin the topics of plant defense, in articulation with the remaining organizational units of the Ministry's organs; and

V-coordinate the elaboration, promote the execution, monitoring and evaluation of the Department's programs and actions.

Art.16. To the Department of Animal Health competes:

I-draw up the government action guidelines for animal health, aiming to contribute to the formulation of agricultural policy;

II-program, coordinate, and promote the execution of the activities from:

a) zoossanitary surveillance, especially the definition of sanitary requirements to be observed in the transit of animals, products and derivatives of animal origin, as well as materials of use in the veterinarian;

b) prophylaxis and combat disease of animals, developing studies for the definition of the requirements required for organic products, in articulation with the Department of Surveillance of Livestock Insumos;

c) surveillance of the transit of animals, of veterinary products, of animal multiplication materials, of products destined for the animal feed, products and derivatives of animal origin, including the application of sanitary requirements to be observed in import and export; and

d) promotion of zoossanitary campaigns;

III-promote technical-fiscal and operational audits of the activities of its competency;

IV-formulate proposals and participate in negotiation of agreements, international treaties or arrangements, concernin the themes of animal defense, in articulation with the other organizational units of the Ministry's organs; and

V-coordinate the elaboration, promote the execution, follow up and evaluation of the Department's programs and actions.

Art. 17. The Registry of Agrolivestock Development and Cooperativism competes:

I-contribute to the formulation of agricultural policy with regard to the development of agribusiness;

II-plan, foster, coordinate, supervise, and evaluate the activities, programs, and actions of:

a) cooperativism and rural associativism;

b) technological research, spread of information and transfer of technology;

c) technical assistance and rural extension;

d) rural infrastructure and logistics of agri-production and marketing;

e) geographical indication and designation of origin of agrolivestock products;

f) production and foment agri-industrial, agroindustrial, extractivist, and agroecological and integrated production systems, as well as of certification and sustainability;

g) development of new agrolivestock products and stimulus to the process of agroindustrialization;

h) standardization and classification of agricultural products, livestock and animal and plant origins;

i) protection, manhandling and conservation of soil and water, agroirrigation, direct planting and recovery of agricultable areas, from degraded pastures and agroforestry;

j) precision agriculture;

l) zootechnical manhandling and animal welfare; and

m) value aggregation to agrolivestock products and extractivists;

III-coordinate and normatizing the activities of:

a) protection of cultivars, especially those of the National Cultivar-Protection Service-SNPC; and

b) preservation, conservation and protection of the genetic heritage and improvement of animal and plant species of economic interest;

IV-formulate, foster, support, and coordinate government actions aimed at technological and biotechnological research in agrolivestock, agroindustry, extractivism and biodiversity;

V-promote the deployment of the management systems of the Registry's activities and update the database with information technical-operational and strategic;

VI- promote and implement actions aimed at agrolivestock activity, observing the technically correct use of natural resources, the recovery of degraded areas, protection, conservation and manhandling of soil and water, biodiversity and medium environment, in consonance with government policies and guidelines;

VII-implement the actions arising from treaties, agreements and agreements with foreign governments and national and international bodies concerning the subjects of their competence, in articulation with the too many organs of the Ministry;

VIII- propose development actions of the productive chains of agribusiness;

IX-coordinate and promote the operationalization of fomenting the equesideoculture;

X-propose programming and follow up the implementation of capacity-building and training of human resources and collaborators, in fulfillment to the specific technical demands;

XI-assist the Minister of State in the setting of the guidelines and the implementation of actions of the Ministry;

XII-subsidize the Strategic Management Advisory with specific information required to operationalize the planning strategic of the Ministry; and

XIII- exercise other assignments that are committed to you by the Minister of State.

Art. 18. To the Department of Cooperativism and Associativism competes:

I-draw up plans, programs, and projects of development of cooperativism and rural associativism;

II-fomenting programs, projects, actions, and activities of promoting cooperativism and rural associativism in the areas of:

a) education, capacity-building and training;

b) professionalization of management;

c) intercooperation; and

d) social responsibility with communities;

III-propose public policies for the cooperativism and rural associativism, aiming for social welfare;

IV-stimulate and promote the deployment of agroindustries in cooperative systems or associactivists;

V-formulate proposals and participate in negotiations of international agreements, treaties, or arrangements, concerningthe themes related to cooperativism and rural associativism, in articulation with the other organizational units of the Ministry's organs; and

VI-coordinate, promote, follow up, audit and evaluate the programs, projects, actions and activities of the Department.

Art. 19. To the Department of Infrastructure, Logistics and Institutional Partnerships Compete:

I-draw up plans, programs and projects of rural and logistics infrastructure of agri-production, aiming at development in a sustainable way;

II-coordinate studies, implement actions, promote, and evaluate the implementation of programs and projects aimed at the rural and logistics infrastructure of production, inclusive rural electrification, energization, agro-industry, mechanization and agricultural aviation;

III-elaborating standards and overseeing the concerningactivities to the logistics of production and infrastructure and the registration of agricultural aviation service provider;

IV-formulate proposals and participate in international negotiations, agreements, treaties, or international agreements, concerningthe themes related to infrastructure and logistics;

V-supporting actions aimed at the infrastructure and logistics of agri-livestock production, in articulation with other government bodies and the other organizational units of the Ministry;

VI-coordinate, promote, follow, audit and evaluate the programs, projects, actions and activities of the Department; and

VII-coordinate, guide and follow up, in compliance with established guidelines and specific regulation, the formulation of terms of partnerships for the execution of programs and projects of agri-like development and cooperativism, upon arrangements, agreements and adjustments firmed up and too many congenneric instruments.

Art. 20. To the Department of Intellectual property and Technology of the Agrolivestock compete:

I-draw up plans, programs and projects related to technological research, agribusiness studies, intellectual property processes, and the development of agrogenous production of form sustainable;

II-propose standards and coordinate the activities of preservation, conservation and protection of the genetic heritage of animal and plant species of economic interest;

III-plan, promote, coordinate, and follow up actions, studies and technological research activities of interest of the agri-livestock;

IV-coordinate and promote the activities of the SNPC and laboratory support for the protection of cultivars;

V-coordinate the activities concerning geographical identification and origin naming of agri-products;

VI-fomenting and promoting precision agriculture;

VII-formulate proposals and participate in negotiation of agreements, international treaties or arrangements, concernin to the themes related to agribusiness projects and studies, in articulation with the other organizational units of the Ministry; and

VIII-coordinate, promote, perform, follow, audit and evaluate the programs, projects, actions and activities of the Department.

Art. 21. To the Department of Production Systems and Sustainability competes:

I-draw up plans, programs, and development projects of special agri-production systems, environmentally sustainable;

II-implement programs, projects, actions, and activities of fostering, aiming at the improvement of efficiency and sustainability of conventional agri-production systems, assessing environmental, social, economic and structural impacts;

III-implement programs, projects, actions, and activities aimed at to:

a) agrolivestock production integrated;

b) agroecology, agriculture organic and organic animal husbandry;

c) recovery from degraded areas; and

d) manhandling, protection and conservation of soil and water, by using hydrographic microbasins as planning units;

e) generation of employment and income in agribusiness;

f) value aggregation to rural production;

g) plantio right on the straw;

h) irrigated agriculture;

i) occupation of the rural space; and

j) sustainable forest production;

IV-promote and support the activities of fomenting à equesideoculture;

V-stimulate and implement actions targeting suitability of the creation and transport environments, so as to ensure animal welfare;

VI-elaborated standards, coordinate and foster activities and actions of standardization, genealogical records, classification and certification of agrolivestock production;

VII-fostering genetic betterment of animal and plant species of agri-economic and economic interest;

VIII-develop and implement programs, actions and projects to stimulate and diffuse the proper use of inputs and services inherent in the agri-production processes;

IX-coordinate and guide the activities of setorial organization, of inscriptions and of enrollments;

X-formulate proposals and participate in negotiations of international agreements, treaties, or arrangements, concerningthe themes related to agrolivestock production systems and sustainability, in articulation with the Ministry's remaining organizational units; and

XI-coordinate, follow up, audit and evaluate the programs, projects, actions and activities of the Department.

Art. 22. To the Bureau of Agricultural Policy compete:

I-formulate the government action guidelines for agricultural policy and food security;

II-analyze and formulate propositions and regulatory acts of government action for the agri-sector;

III-supervise the elaboration and application of the mechanisms of government intervention regarding marketing and agri-livestock supply;

IV-promote studies, diagnostics, and evaluations on:

a) the effects of economic policy on the productive system agrolivestock, including irrigation;

b) rural insurance; and

c) the zoning agroraneous;

V-administer the system of agricultural information;

VI-identify priorities, sizing and proposing the targeting of resources for costing, investment and agri-business marketing, inclusive of budget ones, within the framework of the National Rural Credit System-SNCR;

VII-proofing the services of CNPA and the CER;

VIII-participate in discussions on the topics of foreign trade policy involving products of the agri-sector and their inputs, in articulation with the other organs of the Ministry;

IX-promote the deployment of the management systems of the Registry's activities and update the database with technical-operational and strategic information;

X-propose programming and follow up with the implementation of capacity-building and training of human resources and collaborators, in fulfillment of the specific technical demands;

XI-assist the Minister of State in the setting of the guidelines and in the implementation of Ministry actions;

XII-subsidize the Strategic Management Advisory with specific information necessary to the operationalization of the strategic planning of the Ministry; and

XIII-exercise other assignments that are committed to it by the Minister of State.

Art. 23. To the Department of Commercialization and Agricultural Supply and Livestock competes:

I-subsidize the formulation of policies and guidelines for the sector and coordinate the implementation of government action for:

a) the food supply and the remaining products agrorands;

b) the distribution, the supply and the marketing of agrolivestock products; and

c) the incentive to commercialization of products from the chains of agriculture and animal husbandry;

II-create instruments to promote the efficient use of the logistical means of storing the agri-production;

III-follow up and analyze the complexes agrolivestock and agroindustrial, in the internal and external markets;

IV-articular and promote integration between the public sector and private initiative, in the activities of supply, marketing and storage of agricultural and animal husbandry products;

V-coordinate, elaborate, follow up, and evaluate the standards regarding the Minimum Price Assurance Policy-PGPM and the agri-livestock supply;

VI-identifying priorities and coordinating the elaboration of programming for the targeting of the budget resources of the Official Credit-OOC and SNCR operations, relating to the removal, storage, formation and sale of public stockpiles of agri-livestock products and the equalization of prices and costs;

VII-coordinate, within the Ministry's framework, the availability of the public stocks for the fulfillment of the Federal Government's social programs;

VIII-formulating proposal and participating in negotiations of international agreements, treaties or arrangements, concerningto the themes related to supply and marketing, in articulation with the rest organizational units of the Ministry; and

IX-coordinate the elaboration, promote the execution, monitoring and evaluation of the Department's programs and actions.

Art. 24. To the Department of Agricultural Economics competes:

I-subsidize the formulation of policies and guidelines for the sector and follow up on the implementation of the government actions related to the agri-production, inclusive of irrigation;

II-elaborate and follow up regulatory acts related to the operationalization of agricultural policy;

III-coordinate, follow up and evaluate the elaboration of agri-and crop plans and the execution;

IV-carry out economic studies concerning the SNCR;

V-coordinate the elaboration of agronegoccio statistics and the agricultural information system;

VI- conduct studies, research and analysis referring to the structural and conjunctural issues of economic policies on agribusiness;

VII-promoting studies and research regarding the catchment of resources for the agri-sector, in articulation with the rest organizational units of the Ministry and the public administration;

VIII-follow and analyze the segments of the agrolivestock, in the internal and external markets;

IX-formulate proposals and participate in negotiations of international agreements, treaties, or arrangements, concerningthe themes related to agricultural policy, in articulation with the Ministry's remaining organizational units, and propose actions of technical cooperation with international bodies in the subjects of its competence; and

X-coordinate the elaboration, promote execution, follow-up, and evaluation of the programs and actions of the Department.

Art. 25. To the Department of Rural Risk Management compete:

I-develop studies for the formulation and implementation of the agri-sector risk management policies and, especially, for the development of rural insurance in the Country;

II-run:

a) assignments referring to the Inter-Ministerial Manager Committee of the Rural Insurance-CGSR and too much assignments that are conferred upon you by delegation from that Committee;

b) the technical and administrative support activities to the Executive Secretariat of the CGSR; and

c) the proposition, the follow-up, the implementation and execution of the policies, guidelines and actions set out in the framework of the CGSR, for the drafting of the Rural Insurance Triennial Plan;

III-develop and promote studies related to rural insurance, with agricultural zoning;

IV-support the operationalization of CER, in particular the services of Collegiate's executive secretariat;

V- give technical support to the execution of the Agrolivestock Activity Assurance Program-PROAGRO;

VI-formulate proposals and participate in negotiations of international agreements, treaties or arrangements, concerningto the themes related to rural risk management, in articulation with the other units of the Ministry; and

VII-coordinate the elaboration, promote the execution, monitoring and evaluation of the Department's programs and actions.

Art. 26. To the Registry of Production and Agroenergy competes:

I-contribute to the formulation of agricultural policy with regard to the cafeteric, sucro-alcohol and agroenergy productions;

II-formulate, supervise, and evaluate policies, programs and actions for the coffee, sucro-alcoholic and agroenergy sectors;

III-probing the services of executive secretariats of the CDPC and the Inter-ministerial Council of Sugar and Alcohol-CIMA;

IV-propose actions and participate in discussions on the themes of their competence, in articulation with the remaining organs of the Ministry;

V-promoting the deployment of the management systems of the activities of the Registry and update the database with technical-operational and strategic information;

VI-propose programming and follow up with the implementation of capacity-building and training of human resources and collaborators, in fulfillment to the specific technical demands;

VII-assist the Minister of State in the definition of the guidelines and the implementation of actions of the Ministry;

VIII-subsidize the Strategic Management Advisory with specific information required to operationalize the planning strategic of the Ministry; and

IX-exercise other assignments that are committed to it by the Minister of State.

Art. 27. To the Department of Sugar and Agroenergy competes:

I-subsidize the formulation of the public policies regarding the canaviary sector and agroenergy;

II-plan, coordinate, control, and evaluate the execution of government actions and programs concerningthe segments productive of sugar cane and sugar, alcohol and too much raw materials of agricultural origin when destined for the manufacture of fuels and the generation of alternative energy;

III-follow, in a systematic way, the behavior of production and the marketing of sugar cane, sugar, alcohol and other agroenergy raw materials, intended for the manufacture of fuels and power generation, and propose measures to ensure the regularity of domestic supply;

IV-develop studies and research targeting subsidize the formulation of plans and programmes regarding sugarcane, sugar, alcohol and the remaining agroenergy raw materials;

V-advisor on the subjects linked to CIMA;

VI-formulate proposals and participate in negotiation of agreements, international treaties or arrangements, concernin to the themes related to the productive chain of sugarcane, as well as to the alcoholic and agroenergy sectors, in articulation with the Ministry's remaining organizational units; and

VII-coordinate the elaboration, promote execution, monitoring and evaluation of the programs and actions of the Department.

Art. 28. To the Department of Coffee compete:

I- subsidize the formulation of public policies regarding the coffeemaker sector;

II-plan, coordinate, control, and evaluate the execution of government actions and programs concerningthe productive segments of the coffeehouse sector;

III-propose, coordinate and keep up with the supply and demand of cafes for export and internal consumption;

IV- plan, coordinate and follow up actions for the application of the resources of the Cafeeira-FUNCAFÉ Defense Fund, including the drafting of annual budget proposal and the accounting of the acts and facts regarding their operationalization;

V-promote, coordinate, control and evaluate the programs, projects, policies and sectoral guidelines for coffee emanating from CDPC;

VI-propose, coordinate and control the formation of public coffee stocks and the management of the coffee-storing units;

VII-promote studies, diagnostics, and evaluate the effects of the economic policies on the productive chain of coffee;

VIII-identify priorities and propose the application of FUNCAFÉ's resources in costing, harvesting, commercialization, investment, empowerment of human resources and rural extension, including from existing ones in the scope of the SNCR;

IX-develop activities aimed at the commercial promotion of coffee in the internal and external markets, in articulation with the Ministry's remaining organizational units;

X-formulate proposal and participate in negotiations of international agreements, treaties, or convents, concerningthe themes related to the coffee shop sector, in articulation with the other units of the Ministry; and

XI-coordinate the elaboration, promote the execution, monitoring and evaluation of the Department's programs and actions.

Art. 29. To the International Relations Office of the Agronegócio competes:

I-formulate proposals and coordinate the participation of the Ministry in negotiations of international acts, treaties, and arrangements concerningthe topics of interest of agribusiness;

II-analyze and follow up and follow the evolution and implementation of the agreements, external financing and deliberations regarding foreign policy for agribusiness, within the framework of international bodies, including the issues affecting the supply of food, with implications for agribusiness;

III-promote internal articulation in the Ministry for the elaboration of proposals and participation in the negotiations of agreements and deliberations concerning foreign policy, of interest of agribusiness, to subsidize the Brazilian position;

IV-coordinate and promote the development of activities, in the International scope, in the areas of cooperation, technical assistance, contributions and external financing, in articulation with the other bodies of public administration;

V-acting as focal point for the negotiation areas of agreements for cooperation, technical assistance, contributions and external financing related to agribusiness, in articulation with the other bodies of the public administration;

VI-accompany and participate in the formulation and implementation of the commercial defence mechanisms;

VII- promote Brazilian agribusiness, its products, brands and patents in the external market;

VIII-analyzing the conjuncture and trends of the external market for the products of the Brazilian agribusiness;

IX-systematization, update, and make available the database concerning the histories of the negotiations and relative contentiations to agribusiness, in Brazil and abroad, as well as the main risks and potential opportunities to their productive chains;

X-advise the other organs of the Ministry in the elaboration of the national agricultural policy, in terms of the compatibility with the international commitments;

XI- coordinating and monitoring the implementation of decisions, concerning the interest of agribusiness, of international bodies and agreements with foreign governments, in articulation with the Ministry's remaining organizational units;

XII-attend the Minister of State and the leaders of the Ministry's organisational units in the coordination, preparation and supervision of missions and international, bilateral and multilateral affairs;

XIII-propose programming and follow up with the implementation of capacity-building and training of human resources and collaborators, in fulfillment to the specific technical demands;

XIV-assist the Minister of State in the definition of the guidelines and the implementation of actions of the Ministry;

XV-coordinate, guide, inspect and evaluate advising assignments in agricultural matters along with diplomatic missions Brazilians abroad;

XVI-subsidize the Strategic Management Advisory with specific information necessary to the operationalization of the strategic planning of the Ministry; and

XVII-exercise other assignments that are committed to it by the Minister of State.

Art. 30. To the Department of Commercial Affairs competes:

I-articular and draw up proposals for multilateral negotiations of trade agreements and to examine the deliberations concerning the remaining commercial practices in the international market involving matters of interest of the agri-sector;

II- to monitor the implementation of multilateral trade agreements and the agreements firmed up by MERCOSUR with third markets, which have implications for agribusiness;

III-follow and analyze, within the framework of international bodies and in the regional integration forums, issues that affect the food supply or are of interest to Brazilian agribusiness;

IV-elaboration analysis of consistency and coherence of notifications from the member countries of the World Trade Organization-WTO;

V-participate:

a) of the formulation and implementation of the defense mechanisms commercial; and

b) of the theme negotiations economic and formulations of the MERCOSUR trade agreements with third markets;

VI-producing analyses on the external market, in relation to the competitor countries of products of the Brazilian agribusiness, identifying opportunities, obstacles, scenarios, and prognoses;

VII-advising the remaining organizational units of the Registry and the organs of the Ministry, in the drafting of the national agricultural policy, in terms of the compatibility with the commitments arising from the international agreements, of which Brazil is a signatory, and of the agreements of MERCOSUR and too many agreements of regional integration;

VIII-watch the organizational units of the Ministry's organs:

a) in the coordination and follow-up of international, bilateral and multilateral missions and subjects, related to agribusiness; and

b) in the elaboration of proposals and technical studies, concerning the acting by Brazil in technical litigation concerning agribusiness;

IX-acting, in articulation with the other organizational units of the Ministry, in the various instances of the institutional framework of MERCOSUR and too many international blocs and bodies, which deal with matter of interest of the agri-sector;

X-coordinate regional integration negotiations, as well as the drafting of proposals regarding MERCOSUR's foreign trade policy, on themes of interest to Brazilian agribusiness; and

XI-propose, negotiate and coordinate actions of cooperation between MERCOSUR and international bodies and of topics concerning multilateral negotiations in agri-related matters.

Art. 31. To the Department of Sanitary and Phytosanitary Negotiations competes:

I-articular with the organizational units of the Office of the Secretary of Defense Agropecuaria the drafting of proposals for negotiations of sanitary and phytosanitary agreements and to analyze the deliberations concerning the sanitary and phytosanitary requirements involving matters of interest of the agrolivestock sector;

II-follow up the implementation of sanitary and phytosanitary agreements that have implications for agribusiness, of which the Brazil to be a signatory;

III-accompany and analyze, within the framework of international bodies, the issues related to identity patterns and minimum requirements as to the sanity of products and systems of agri-livestock production;

IV-elaboration, in articulation with the organizational units of the Secretary of Defense Agrohusbandry, consistency and consistency analysis of regulations on sanitary and phytosanitary issues notified by the countries to the Committee on Sanitary and Phytosanitary Measures of the WTO;

V-follow and analyze the policies of national interest, together to the international reference bodies of the Agreement for the Application of Sanitary and Phytosanitary Measures of the WTO, in articulation with the organizational units of the Office of Agrohusbandry Defence;

VI-tracking and analyzing the patterns, measurements and barriers Sanitary and phytosanitary of the major producing countries and exporters of agrolivestock products;

VII-advisor on the drafting of national agri-defense policies, in terms of the compatibility with the commitments arising from the international agreements that Brazil is a signatory;

VIII-watch the organizational units of the Office of the Secretary of Defense Agrolivestock in the coordination and monitoring of international, bilateral and multilateral missions and affairs, related to defence agri-livestock;

IX-draw up proposals and technical studies, in articulation with organizational units of the Secretaria de Defence Agropecuaria, referring to Brazil's acting in technical litigations concerning sanity and plant health;

X-propose, negotiate, and coordinate cooperation actions on subjects sanitary and phytosanitary; and

XI- acting, in articulation with the Office of Defense Agrohusbandry and too many organs of the Ministry, in the various instances of the institutional framework of MERCOSUR and too many international blocks and bodies, which deal with matters of health interest and phytosanitary of the agrolivestock sector.

Art. 32. To the International Promotion Department of the Agronegócio competes:

I-articulate the actions related to the promotion of agribusiness products and services;

II-draw up plans, strategies, guidelines, and analyses to direct and stimulate the external marketing of products of the agriturismo, as well as proposing measures to reduce the fragilities identified;

III-subsidize the formulation and evaluation of proposals and actions of public policies for the increment of quality and competitiveness of the productive segments of agribusiness;

IV-program and coordinate the participation of the Ministry in events international trade promotion;

V- constitute partnerships with the public and private sectors to optimize the participation of Brazil in international events, in the Country and abroad, by coordinating, guiding and supporting the participation of agribusiness;

VI-promoting the interaction between the diverse segments of the chain productive agribusiness and the actions developed by the Ministry for the external market;

VII-identify the opportunities, obstacles, scenarios, and prognoses for the products of the Brazilian agribusiness;

VIII-organize and disseminate the information concerning the commercial promotion activities of agribusiness;

IX-evaluate the results of the agribusiness promotion actions; and

X-propose, negotiate, and coordinate cooperative actions for the promotion of agribusiness, between MERCOSUR and international bodies and development of topics concerning the multilateral negotiations in agri-related matters.

Art. 33. To the Executive Board of the Plan da Lavoura Cacaueira competes:

I-promote the sustainable rural development of Brazil's cocoa producing regions, by means of research and development, technology transfer, training and agri-education, certification, and organization of the production;

II-plan, support, and follow up actions of strengthening the productive sector, strengthening local arrangements, with an emphasis on agroforestry systems and the attraction of investments;

III-promote and broaden the competitiveness and sustainability of the segments of agribusiness, the enhancement of the cacaureous lavrot and the development of cocoa production in the Country;

IV-promote and improve the living conditions of rural populations and contribute to the rational use of natural resources in the cacao producing regions;

V-extend agri-livestock income and generate jobs in the cocoa producing regions, through the development of agrosilvopastoris activities, observing socio-economic balance relationships, labor-intensive capacity and sustainability environmental;

VI-administer the resources from the General Fund of the Cacau-FUNGECAU;

VII-coordinate the elaboration, promote the implementation, monitoring and evaluation of the programs and actions pertinent to their area of competence;

VIII-propose the programming and follow up the implementation of empowerment and training of human resources and collaborators, in fulfilment of the specific technical demands;

IX-assist the Minister of State in the definition of the guidelines and the implementation of actions of the Ministry;

X-subsidize the Strategic Management Adviser with specific information necessary to the operationalization of the strategic planning of the Ministry; and

XI-exert other assignments that are committed to it by the Minister of State.

Art. 34. To the National Institute of Meteorology competes:

I-promoting the execution of studies and meteorological and climatological surveys applied to agriculture and other correlates activities;

II-coordinate, elaborate, and execute programs and projects of agrometeorological surveys and monitoring of climate and environmental modifications;

III-elaboration and release, daily, at the national level, the weather forecast, warnings, and special weather bulletins;

IV-establish, coordinate and operate the networks of meteorological observations and data transmission, including those integrated into the international network;

V-coordinate the elaboration, promote the execution, monitoring and evaluation of the programs and actions pertinent to their area of competence;

VI-propose the programming and follow up with the implementation of capacity-building and training of human resources and collaborators, in fulfilment of the specific technical demands;

VII-assist the Minister of State in the definition of the guidelines and the implementation of actions of the Ministry;

VIII-subsidize the Strategic Management Advisory with specific information necessary to the operationalization of the strategic planning of the Ministry; and

IX-exercise other assignments that are committed to it by the Minister of State.

Section III

Of The Deccentralized Units

Art. 35. To The National Agri Laboratories, depending on technical guidelines of the Office of the Secretary of Defense Agrohusbandry, it is incumbent to promote laboratory support to the programs and actions of competence of that Registry.

Art. 36. To Federal Superintendences of Agriculture, Livestock and Supply, depending on technical guidelines of the Ministry's singular and sectoral specific organs, compete to perform activities and actions of:

I-sanitary defense, inspection, classification and surveillance agrorands;

II-foment and agroaring development and heveiculture;

III-technical assistance and rural extension;

IV-rural infrastructure, cooperativism, and rural associativism;

V-production and marketing of agrolivestock products, inclusive of the coffee, sugar cane, sugar and alcohol;

VI-administration and development of people, as well as general services;

VII-strategic planning and operational planning;

VIII-programming, monitoring, and budget execution and financial of the allocated resources;

IX- quality and productivity of the services provided to its users; and

X-improvement of the management of the Superintendency.

Single paragraph. Federal Superintendences have jurisdiction within each State of the Federation and the Federal District, and there may be change of that limit, in the common interest, to carry out the activities of agri-defence and production support and to the agroaring marketing, rural infrastructure, as well as cooperativism and rural associativism, upon act of the Minister of State.

Section IV

Of The Collegiated Bodies

Art. 37. The CCCCN has the competences, composition and functioning set out in specific regulation.

Art. 38. The CER competes to decide, in a single administrative instance, on resources concerning the ascertaining of damages and respective damages under PROAGRO.

Art. 39. The CDPC has the competences, the composition and the functioning set out in specific regulation.

Art. 40. It is up to the CNPA to exercise the competencies established in the Laws in the 8,171, of January 17, 1991, and 8,174, of January 30, 1991.

CHAPTER IV

DAS ATTRIBUTIONS OF LEADERS

Section I

From the Executive Secretary

Art. 41. The Executive Secretary is incumbent on:

I- to coordinate and promote the consolidation of the Ministry's overall action plan and submit it to the approval of the Minister of State;

II-supervise and promote the evaluation of the execution of the projects and activities of the Ministry;

III-supervise and coordinate the articulation of the organs of the Ministry with the central bodies of the systems affections to the area of competence of the Secretariat-Executive; and

IV-exercise other assignments that are committed to it by the Minister of State.

Section II

Dos Secretaries

Art. 42. The Secretaries are incumbent on planning, directing, coordinating and directing the execution, as well as monitoring and evaluating the activities and projects of their respective units and exercising the remaining assignments that are committed to them in internal regiment.

§ 1st Incumbent, Still, to the Secretary of Agricultural Policy to exercise the burden of CNPA's Executive Secretary and CER President.

§ 2nd Incumbent, Still, to the Secretary of Production and Agroenergy exercise the charges of CDPC Executive Secretary.

§ 3rd Incumbent, Still, to the Secretary of Agrolivestock Development and Cooperativism to promote actions for the operationalization of CCCCN.

Section III

Of the remaining Leaders

Art. 43. To the Chief Minister's Office, to the Head of the Strategic Management Advisory, the Legal Adviser, the Undersecretary, the Directors of the Institute, the Commission and the Departments, the Superintendents and the remaining leaders is to plan, drive, coordinate and guide the implementation of the activities, programs and actions of the respective bodies and organizational units and exercise other assignments that are committed to them.

CHAPTER V

OF THE GENERAL AND TRANSITIONAL PROVISIONS

Art. 44. The Office of Agrolivestock Defence, the Office of Agrolivestock Development and Cooperativism, the Agricultural Policy Secretariat, the Registry of Production and Agroenergy and the International Relations Office of the Agronegócio will provide support coach to CER, the CDPC and the CNPA, depending on their specific competencies.

Art. 45. The internal regiments will be able to define the detailing of the integral bodies of the Ministry's Regimental Structure, the competencies of the respective organisational units, and the assignments of their leaders.

Art. 46. The Minister of State for Agriculture, Livestock and Supply will identify the posts in committee and the gratified functions concerning the particular organs and of decentralised units, which shall be occupied, exclusively, by servers effective from the personnel framework of the Ministry of Agriculture, Livestock and Supply.

Single paragraph. It will be established internal selection process that will define the parameters for occupancy of the posts in committee and of the gratified functions, so as to prioritize professional merits of the servers referred to in the caput of this article and listed nominees triplice.
