DECREE OF March 23, 2006.

Creates the Biological Reserve of the Araucaries, in the State of Paraná, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 10 of the Law no 9,985, of July 18, 2000, and in the Decree no 4,340 of August 22, 2002, and what appears in the Process at 02001.002208 /2005-00,

DECRETA:

Art. 1º Stay created the Biological Reserve of the Araucaries, located in the Municipalities of Imbituva, Ipiranga and Teixeira Soares, in the State of Paraná, with the goals of preserving the existing natural environments featured prominently for the remnants of Forest Ombrophila Mixed and Várzeas, as well as carrying out scientific research and developing environmental education activities.

Art. 2º The Biological Reserve of the Araucaries has the limits described from the Topographic Letters of IRATI, Folha SG.22-C-I/4, of UVAIA, Folha SG.22-II/1, of TEIXEIRA SOARES, Folha SG.22-C-II/3, and of IMBITUVA, Folha SG.22-I/2, all in scale 1:50.000, edited by the Directorate of the Geographic Service of the Army. The Biological Reserve of the Araucaries is divided into five areas in accordance with the following descriptive memorial:

§ 1º Ficam excluded from the limits of the Biological Reserve of the Araucaries, described in the caput of this article, the stretch of the RFFSA railway line (between Guaragi and Guaraúna), between c.p.a. 568532 E and 7201539 N and c.p.a. 565749 E and 7199328 N, the excerpts from the berth of the road without naming the Municipality of Imbituva, which connects the Federal Highway BR-373 with the Municipal Road OM-102, in the Municipality of Teixeira Soares, between c.p.a. 548847 E and 7217426 N and a c.p.a. 550484 E and 7215269 N, the stretch of the Municipality Road de Teixeira Soares OM-102, between c.p.a. 550051 E and 7209300 N, c.p.a. 549848 E and 7209091 N and a c.p.a. 551629 E and 7208374 N, the stretch of road from the Municipality of Teixeira Soares OM-404, between c.p.a. 561011 E and 7203042 N and c.p.a. 562405 E and 7201472 N, as per the Road Political Map of the State of Paraná-2005, published by the State Secretariat of Transport-Department of Rhode Roads of Paraná and the Road Map of the Municipal Tea Town Hall of Teixeira Soares.

§ 2º The subsoil of the areas described in the caput of this article integrate the boundaries of the Reservoe Biological of the Araucaries.

Art. 3º The Biological Reserve of Araucaries will be managed by the Brazilian Institute of the Environment and Renewable Natural Resources-IBAMA, which is expected to adopt the necessary measures to its effective protection and deployment.

Art. 4º The limit of the buffer zone of the Biological Reserve of the Araucaries is five hundred metres, in horizontal projection, from its perimeter.

Art. 5º The lands contained within the limits of the Biological Reserve of the Araucaries, of which it treats art. 2nd of this Decree, belonging to the Union, will be ceded to the IBAMA by the Union Heritage Secretariat of the Ministry of Planning, Budget and Management, in the form of the law.

Art. 6º Ficam declared of public utility, for purposes of dispropriation by IBAMA, the real estate private rural existing in the limits described in art. 2nd of this Decree, in the terms of the arts. 5º, paragraph "k", and 6th of the Decree-Law no 3,365, of June 21, 1941.

Para. single. The Advocate General of the Union, through its legal unit of implementation with the IBAMA, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of any property titles and respective real estate records considered irregular, incidents in the conservation unit of which it treats this Decree.

Art. 7º This Decree goes into effect on the date of its publication.
