DECREE OF February 13, 2006.

Creates the Jamanxim National Park, located in the Municipalities of Itaituba and Trawill, in the State of Pará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and with a view to the provisions of the art. 11 of the Law no 9,985, of July 18, 2000, and in the Decree no 4,340, of August 22, 2002,

DECRETA:

Art. 1º Stay created the Jamanxim National Park, located in the Municipalities of Itaituba and Trawill, in the State of Pará, with the aim of preserving natural ecosystems of great ecological relevance and scenic beauty, enabling the realization of research scientific and the development of activities of environmental education and interpretation, of recreation in contact with nature and eco-tourism.

Art. 2º The Jamanxim National Park has the limits described from the Cards Topographical, in scale 1:100.000, MI 861, 938 and 1015, edited by the Directorate of Geodesia and Cartography of the Brazilian Institute of Geography and Statistics-IBGE, and in scale 1:250.000, MI 167 and 194, edited by the Directorate of Geographic Service of the Ministry of the Army, with the following c.g.a. 05º33 '44 "S and 56º10' 36" Wgr., corresponding to the landmark P-6, of the descriptive memorial of the National Forest of Itaituba I; of this point, follows by straight line up to the point 1, beginning of the description of this perimeter, by perdoing an area approximate 859,722 ha (eight hundred and fifty and nine thousand, seven hundred and twenty-two hectares).

§ 2º It is excluded from the boundaries of the Jamanxim National Park, described in the caput of this article, the berth and the domain strip of the BR-163.

§ 3º The subsoil of the area described in the caput of this article integrates the boundaries of the Jamanxim National Park.

Art. 3º They become declared of public utility, for the purposes of misappropriation, by the Brazilian Institute of the Environment and Renewable Natural Resources-IBAMA, the rural real estate of legitimate private domain and its benfeits that come to be identified in the limits described in the art. 2nd of this Decree, in the terms of art. 5th, paragraph "k", and 6th of the Decree-Law no 3,365, of June 21, 1941.

Para. single. The Advocate General of the Union, through its legal unit of implementation with the IBAMA, shall be authorized to promote the relevant administrative and judicial measures, aiming at the declaration of nullity of any property titles and respective real estate records considered irregular, incidents in the conservation unit of which it treats this Decree.

Art. 4º The lands contained in the boundaries of the Jamanxim National Park, of which it treats the art. 2nd, belonging to the Union, will be ceded to the IBAMA by the Union Heritage Office of the Union Ministry of Planning, Budget and Management in the form of the Act.

Art. 5º This Decree comes into effect on the date of its publication.
