DECREE OF November 18, 2005.

Declares of social interest, for the purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2nd of the Supplemental Act no 76, of July 6, 1993, 18 and 20 of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993, the following rural real estate:

I-"Veada Morta", with area of one hundred and thirty hectares, seventy and an airs and fifty centiars, situated in the Municipality of Caruaru, object of the Records in the R-2-23.876, fls. 213 /213v, Book 2; R-3-23.876, fls. 213 /213v, Book 2; R-8-4.113, fls. 213 /213v, Book 2-N; R-9-4.113, fls. 213 /213v, Book 2-N; R-4-16.247, fls. 296 /296v, Book 2-BG; and R-5-16.247, fls. 296 /296v, Book 2-BG, of the Estate Registration Office of the Comarch of Caruaru, State of Pernambuco (Process INCRA/SR-03/no 54140.001277 /2003-35);

II-"Fazenda Garrote", with area of two hundred and eighty-eight hectares, situated in the Municipality of Brejo of the Mother of God, object of the Registry in the R-1-10.130, fls. 30, Book 2-L, from the Estate Registration Office of the Brejo Comarch of the Mother of God, State of Pernambuco (Process INCRA/SR-03/no 54140.000760 /2001-31); and

III-"Fazenda Riacho do Caroá", with area of two hundred and forty-two hectares, situated in the Municipality of Beautiful Waters, object of the Registry in the R-2-630, fls. 31, Book 2-G, of the Estate Registry Office of the Comarch of Fine Water, State of Pernambuco (Process INCRA/SR-03/no 54140.000467 /2005-05).

Art. 2º Excludes from the effects of this Decree the soothing, the machines, and the implements agricultural, as well as the existing benfeits in the real estate referred to in art. 1st and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which it treats this Decree, in the form provided for in the Supplementary Act no 76 of July 6, 1993 and to keep the areas of Legal Reserve and permanent preservation provided for in the Act No 4,771 of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
