DECREE OF August 2, 2005.

Declares of social interest, for the purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

The PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2nd of the Supplemental Act no 76, of July 6, 1993, 18 and 20 of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993,

DECRETA:

Art. They are declared to be of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993, the following rural real estate:

I-"Futurosa farms and others", with recorded area of three hundred and thirty-five hectares, eighty-two ares and ninety-seven centiars, and measured area of three hundred hectares, forty three airs and fifty seven centiars, situated in the Municipality of Coaraci, object of the Records in the R-1-3.586, Book 2, R-1-3.587, Book 2, R-2-3.587, Book 2, R-1-3.588, Book 2, and R-3-190, Book 2, of the Estate Registration Office of the Comarch of Coaraci, State of Bahia (Case INCRA/SR-05/no 54160.001655 /2004-23);

II-"Fazenda Lebre", with area of two thousand, six hundred and fifty and nine hectares, thirty-three airs and thirty-one centiars, situated in the Municipality of Doverland, object of the Registry in the R-1-1.178, fls. 178, Book 2-E, of the Estate Registration Office of the Comarch of Doverland, State of Goiás (Process INCRA/SR-04/no 54150.001168 /2004-80);

III-"Farm Conquest", with area of three thousand, three hundred and thirty-two hectares and twenty one centiars, situated in the Municipality of Minaçú, object of the Registry in the R-43-058, fls. 58, Book 2-A, from the Estate Registration Office of the Comarch of Minaçú, State of Goiás (Process INCRA/SR-04/no 54150.000280 /2005-84);

IV-"Fazenda Santo Antônio dos Campos New", with area of three thousand, three hundred and ninety nine hectares, ninety-nine airs and twenty-one centiars, situated in the Municipality from Grajaú, object of the Records in the R-1-6.749, fls. 54, Book 2-AJ, and R-1-6.750, fls. 55, Book 2-AJ, of the Carthorium of the 1st Offender Real Estate of the Comarch of Grajaú, State of the Maranhão (Case INCRA/SR-12/no 54234.000096 /2004-23);

V-"Fazenda Calumbys", with registered area of a thousand, one hundred and seventy-nine hectares and ninety airs, and measured area of a thousand, one hundred and seventy seven hectares and thirty airs, situated in the Municipality of Captain Enéas, object of the Registry in the R-2-4.210, fls. 111v, Book 2-O, of the Estate Registration Office of the Comarch of Francisco de Sá, State of Minas Gerais (Case INCRA/SR-06/no 54170.001582 /2005-31);

VI-"Fazenda Santa Cruz and California", with registered area of a thousand, one hundred and fifteen hectares, seventy-eight airs and eighty centiars, and measured area of a thousand, two hundred and Eighty and one hectares, eighty ares and ninety seven centiars situated in the Municipality of Verissima, object of the Records in the R-2-44.974, Ficha 3, Book 2, R-2-44.975, Ficha 4, Book 2, and R-4-18.214, Ficha 12, Book 2, of the Comarch's 1st Offender's Office de Uberaba, State of Minas Gerais (Process INCRA/SR-06/no 54170.007231 /2004-53);

VII-"Braspar Fazenda", with area of four thousand, six hundred and thirteen hectares, seventy and four airs and fifty centiars, situated in the Goianesian Municipalities of Pará and Breu Branco, object of the Matriculation on the 3,356, fls. 56, Book 2-M, of the Estate Registration Office of the Rondon Comarch of Pará, State of Pará (Process INCRA/SR-27/no 54600.002098 /2002-70);

VIII-"Fazenda Paulista", with area of novecents and fifty-two hectares and thirty-three airs, situated in the Municipality of Serra Talhada, object of the Registry in the R-1-15.083, fls. 209, Book 2-AU, from the Estate Registration Office of the Comarch of Serra Talhada, State of Pernambuco (Process INCRA/SR-29/no 54141.000053 /2005-68);

IX-"Fazenda Piramdrink", with area of two thousand hectares, situated in the Municipality of Betania, object of the Registry in the AV-1-623, fls. 31v, Book 2-D, of the Estate Registration Office of the Comarch of Betania, State of Pernambuco (Process INCRA/SR-29/no 54141.000580 /2004-91);

X-"Tucuns", with area of a thousand, five hundred and eighteen hectares, fifty and eight airs and fifty centiars, situated in the Municipality of José de Freitas, object of the Registration on R-1-3.631, fls. 192, Book 2-M, of the Carthorium of the 1st Oftice of the Comarch of José de Freitas, State of the Piauí (Process INCRA/SR-24/no 54380.000526 /2004-23); and

XI-"Farm Cachoeira", with area of ninety and ninety and two hectares and twenty ares, situated in the Municipality of Itapura, object of the Registry in R-5-15.193, Ficha 01, Book 2, from the Estate Registration Office of the Comarch of Pereira Barreto, State of São Paulo (Process INCRA/SR-08/no 54190.000320 /2002-79).

Art. 2nd Excludes from the effects of this Decree the soothing, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1st and belonging to those who will be benefited from their destination.

Art. 3rd The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the rural real estate dispropriations of which it treats this Decree, in the manner provided for in the Supplementary Act no 76, of July 6, 1993, and to maintain the areas of Reserva Legal and permanent preservation provided for in the Law no 4,771, of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4th This Decree goes into effect on the date of its publication.
