Approves the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and of the Gratified Functions of the Ministry of Sport and Tourism, and gives other arrangements.
THE VICE PRESIDENT OF THE REPUBLIC, in the exercise of the post of President of the Republic, using the assignments that gives him the art. 84, Incisos IV and VI, of the Constitution,
DECRETA:
Art. 1º Stay approved the Regimental Structure and the Demonstrative Framework of the Cargos in Commission and of the Gratified Functions of the Ministry of Sport and Tourism, in the form of Annexes I and II to this Decree.
Art. 2º On the basis of the provisions of the preceding article, they shall be remanded, in the form of Annex III to this Decree, of the Office of the Management Office, of the Ministry of Planning, Budget and Management, from the extinction of organs of the Federal Public Administration, to the Ministry of Sport and Tourism, the following posts in committee of the Group-Direction and Superiors Superiors-DAS: a DAS 101.6; four DAS 101.5; eleven DAS 101.4; four DAS 101.3; ten DAS 101.2; two DAS 102.4, eight DAS 102.2; and six DAS 102.1.
Art. 3º The apostilaments arising from the approval of the Regimental Structure, of which it treats art. 1º should occur within twenty days, counted from the date of publication of this Decree.
Single paragraph. After the apostilaments, provided for in the caput of this article, the Minister of State for Sport and Tourism will make it published, in the Official Journal of the Union, within thirty days, counted from the date of publication of this Decree, nominal relation of the holders of the posts in committee of the Group-Direction and Superiors Superiors-DAS, referred to in Annex II, indicating, including, the number of posts vacant their denomination and their respective level.
Art. 4º The Internal regiments of the organs of the Ministry of Sport and Tourism shall be approved by the Minister of State and published in the Official Journal of the Union, within ninety days, counted from the date of publication of this Decree.
Art. 5º This Decree takes effect on the date of its publication.
Art. 6º It is repealed the Decree No. 3,623, of October 5, 2000.

STRUCTURE REGIMENTAL OF THE MINISTRY OF SPORT AND TOURISM
CHAPTER I
OF THE NATURE AND COMPETENCE
Art. 1º The Ministry of Sport and Tourism, the body of direct administration, has as area of competence the following subjects:
I-national tourism development policy and sports practice;
II-promotion and dissemination of tourism and national sport, in the Country and in the exterior;
III-stimulus to public and private initiatives to encourage tourism and sports activities; and
IV-planning, coordination, supervision and evaluation of incentive plans and programs to tourism and sports.
CHAPTER II
OF THE ORGANIZATIONAL STRUCTURE
Art. 2º The Ministry of Sport and Tourism has the following Organizational Structure:
I-bodies of direct and immediate assistance to the Minister of State:
a) Cabinet;
b) Secretariat-Executives;
I-Undersecretary of Planning, Budget and Administration; e
2-Department of Resource Capability;
C) Legal Consultancy;
II-specific organ-specific organ:
a) National Registry of Sport;
1 Department of Social Programs;
2-Department of Development and Technology; and
3-Department of Income Sports;
III-Collegiate Organ: Development Council of the Brazilian Sport-CDDB; and
IV-linked entity:
a) Autarchy: Brazilian Institute of Tourism-EMBRATUR.
Chapter III
OF THE COMPETENCE OF THE ORGANS
From the Direct and Immediate Assistance Bodies to the Minister of State
Art. 3º To the Cabinet of the Minister competes:
I-attend the Minister of State in his representation political and social, to occupy yourself with the public relations and the prepares and dispatch of your personal expediency;
II-follow up the progress of the Ministry's interest projects, in tramway in the National Congress;
III-provide the fulfillment of the consultations and the requirements formulated by the National Congress;
IV-provide for the official publication and disclosure of the subjects related to the area of acting of the Ministry; and
V-exercise other assignments that are committed to you by the Minister of State.
Art. 4º To the Secretary-Executive competes:
I-attend the Minister of State in the supervision and coordination of the activities of the member units of the Structure of the Ministry and of the entities to it linked;
II-supervise and coordinate the activities related to the Federal Planning Systems and of Budget, Organization and Administrative Modernization, Accounting, Financial Administration, Administration of Information Resources and Informatics, Human Resources and General Services, within the Ministry;
III-supervise and coordinate the actions of the Ministry aimed at capturing resources for the financing of programs and projects concerning tourism development; and
IV-assist the Minister of State in the definition of the guidelines and the implementation of the policies and actions of the Ministry's area of competence.
Single paragraph. The Executive Secretariat exercises, still, the role of the sectoral body of the Civil Personnel Systems of the Federal Administration-SIPEC, of Organization and Administrative Modernization-SOMAD, of Information Resources Administration and Informatics-SISP, of General Services-SISG, of Planning, Federal Budget, through the Undersecretary of Planning, Budget and Administration to her subordinate.
Art. 5º To the Undersecretary of Planning, Budget and Administration compete:
I-plan, coordinate and supervise the execution of the activities related to the Federal Planning and Budget, Organization and Administrative Modernization Systems, of Accounting, of Information and Informatics, Human Resources and General Services, within the Ministry;
II-promote the articulation with the central bodies of the federal systems, referred to in the previous inciso, and inform and guide the organs of the Ministry as to the fulfillment of established administrative standards;
III-promote and coordinate the drafting and consolidation of the plans and programs of the activities of their area of competence and submit them to the decision higher;
IV-follow up and promote the evaluation of projects and activities;
V-develop the budgeting, financial and accounting execution activities, within the Ministry; and
VI-carry out taken care of the expense ordinators and too much responsible for public goods and values and of all the one that gives cause to loss, stray or other wrongdoing that results in damage to the erarium.
Art. 6º To the Resource Capitation Department competes:
I-advise the Executive Secretariat in the matters related to the capturing of technical, material and financial resources, intended for programs and projects concerning the development of tourism activities;
II-identify caries and resource sources, promoting gissues that will enable plans, programs, projects or actions considered to be prioritised;
III-identify, enroll and maintain systematic contacts with national or international bodies and institutions, which may induce or viabilize the capturing of resources;
IV-elaboration and market diagnostics and project profiles, such as induction instruments, support and guidance to potential investors interested in the area of tourism; and
V-promote and coordinate the achievement of national resources and international for the financing of plans and programmes concerning the development of tourism.
Art. 7º À Legal Consultancy competes:
I-advise the Minister of State in matters of legal nature;
II-exercise the coordination of the legal activities of the Ministry and the linked entities;
III-fixing the interpretation of the Constitution, laws, treaties, and the remaining acts normatives to be uniformly followed in their areas of acting and coordination, when there is no normative orientation of the Union Advocate General;
IV-elaborate studies and prepare information, by request of the Minister of State;
V-assist the Minister of State in the internal control of the administrative legality, of the acts by him practiced or already effective and of those arising from organs or entities under his coordination;
VI- examine, prior and conclusively, within the Ministry:
a) the edital texts of bidding, as well as those of the respective congenneric contracts or instruments, to be published and concluded;
b) the acts by which it is going to recognize the inexigsibility or decide the bidding dispensation;
c) proposals,. Studies, proteges, anteprojects and minutes of normative acts of interest of the Ministry; and
d) the processes and documents involving subjects concerning administrative or judicial draft matters;
VII -provide grants for the defense of the rights and interests of the Union and provide, to the Minister of State, information requested by the judiciary and the Public Prosecutor's Office; and
VIII-examine orders and judicial sentences and mentored Ministry officials as to their exact compliance.
Single paragraph. The Legal Consultancy, the administratively subordinate body to the Minister of State, still exercises the role of the sectoral body of the Advocate General of the Union.
SECTION II
From the Singular Specific Organ
Art. 8º To the National Registry of Sport competes:
I-propose, heard the Development Council of the Brazilian Sport-CDDB, the National Sport Plan;
II-deploy the decisions regarding the Plan and the sport's development programs;
III-carry out studies, plan, coordinate and supervise the development of the sport and the execution of the event promotion actions;
IV-ensure compliance with sports legislation;
V-providing technical cooperation and supplementation financial assistance to other bodies of the Federal Public Administration, the States, the Federal District and the Municipalities;
VI-maintaining exchange with public and private bodies, national, international, and foreign governments;
VII-articulating with the remaining segments of the Federal Public Administration, having in view of the execution of integrated actions in the area of sport;
VIII-providing technical and administrative support to the CDDB;
IX-elaboration project of providing sports practice for persons with Disability; and
X-coordinate, formulate and implement the policy regarding the area of sport by the actions of planning, evaluation and control of the programs, projects and activities.
Art. 9º Ao Department of Social Programs competes to plan, coordinate, and supervise:
I-the actions aimed at the supportive and educational sport;
II-the development of special programs; and
III-the empowerment of human resources in both grassroots and leisure sport.
Art. 10 To the Department of Development and Technology compete to plan, coordinate and supervise:
I-o exchange and cooperation for technical feasibility studies of sports projects and the standardization of actions and projects;
II-the development of research in anti-doping and scientific laboratory, and the maintenance of laboratories;
III-the empowerment of professionals from science applied to the sport.
Art. 11 To the Department of Throughput Sports compete to plan, coordinate and supervise:
I-the execution of actions aimed at the development of the sport for persons with disabilities;
II-the promotion of competitions and events;
III-the institutional relations with the National Sport System; and
IV-the support for athletes and technicians, as well as the empowerment of technicians and referees for sport of income.
Section III
Of The Collegiate Body
Art. 12 To the Brazilian Sport Development Board-CDDB is to exercise the competences set out in Law No. 9,615 of March 24, 1998 and in Law No. 9,981 of July 14, 200.
CHAPTER IV
OF THE ASSIGNMENTS OF THE LEADERS
Section I
OF the Executive Secretary
Art. 13 To the Executive Secretary It is incumbent:
I-coordinate, consolidate and submit to the Minister of State the Ministry's overall plan of action;
II-supervise and evaluate the execution of the projects activities and Ministries;
III-supervise and coordinate the articulation of the Ministry's bodies with the organs of the Ministry with the central bodies of the systems, affections to the area of competence of the Executive Secretariat.
IV-implement the policy of development of tourism by the actions of planning, evaluation and control of the programs, projects and activities;
V-ensuring the length of tourism's sectoral objectives, of acronym with the strategic orientations of the Presidency of the Republic; and
VI-exercise other assignments that are committed to you by the Minister of State.
Section II
From the Secretary and Too Many Leaders
Art. 14 To the Secretary to the Chief Minister of The Minister's Office, the Legal Adviser, the Undersecretary, the Department Directors, the Coordinators-General and the remaining leaders, it is incumbent on planning, directing, coordinating and directing the implementation of the activities of the respective units and exercise other assignments that are committed to them in their areas of competence.
Single paragraph. IncuMbe further, to the Secretary to exercise the assignments expressly delegated to him, admitted to the sub-delegation to the subordinate authority.
CHAPTER V
OF THE GENERAL AND TRANSITIONAL PROVISIONS
Art. 15 Internal regiments will define the detailing of the integral organs of the Regimental Structure, the competencies of the respective units and the assignments of their leaders.
