DECREE NO. 4,477, OF November 21, 2002

Dislays on the execution of the Eighth Protocol Additional to the Economic Supplementation Agreement No. 39, among the Governments of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), of October 3, 2002.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by the Government of the Federative Republic of Brazil on August 12, 1980 and approved by the National Congress, through the Legislative Decree No. 66 of November 16, 1981, provides for modality of Economic Supplementation Arrangement;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), based on the Treaty of Montevideo of 1980, signed on August 11 from 1999, in Montevideo, the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andina community), incorporated into the national legal planning by means of Decree No. 3,138, of August 16, 1999;

Whereas the Sixth Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and of the Republic of Colombia, of the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), incorporated into the Brazilian legal order by means of the Decree No. 4,343 of August 26, 2002, extended to thirty of September 2002 the present Agreement;

Whereas the Plenipotentiaries of the Republic Federative of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), on the basis of the Treaty of Montevideo of 1980, signed on October 3, 2002, in Montevideo, the Eighth Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of the Venezuela (member states of the Andean Community);

D E C R E T A:

Art. 1º The Eighth Additional Protocol to the Agreement on Economic Supplementation No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree comes into effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT NO. 39 SIGNED BETWEEN THE REPUBLICS OF COLOMBIA, ECUADOR, PERU AND VENEZUELA, MEMBER COUNTRIES OF THE ANDINA COMMUNITY, AND THE FEDERATIVE REPUBLIC OF THE BRASIL

8th Additional Protocol

The Plenipotentiaries of the Republics of Colombia, Ecuador, Peru, and Venezuela, member states of the Andean Community, and of the Federative Republic of Brazil, duly authorized by their respective Governments, second powers presented in good and due form, deposited opportunely at the General Secretariat of the Latin American Integration Association (ALADI),

CONSIDERING The need to preserve and broaden existing trade currents between both Parties; and

REAFFIRMING the willingness to continue the negotiations of a supplementation agreement economic among the member states of MERCOSUR and the Andean Community to create a free trade zone,

CONVVE IN:

Article 1º-Extending, from 1º October 2002 to November 30, 2002, the term of the Economic Supplementation Agreement No. 39 and the pactuous preferences among its signatories.

Article 2º-This Protocol will enter into force, bilaterally, on the date on which each of the Signatary Parties, members of the Andean Community, together with the Federative Republic of Brazil, have incorporated the aforementioned Protocol to their domestic law, pursuant to their respective legislations. For such purposes, the Signatary Parties will be able to determine the provisional application of this Protocol, as per their legislations, until they comply with the tramites for their entry into force.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly authenticated copies to the Signatory Parts.

IN FÉ THAN, THE RESPECTIVE PLENIPOTENTIARIES SIGN THE GIFT Protocol in the city of Montevideo, to the days of the month of two thousand and two, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
