DECREE NO. 4,160, OF March 12, 2002

Disposes on the execution of the Twelfth Additional Protocol to the Economic Supplementation Agreement No. 36, between the Governments of the Republic Federative of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to Mercosur, and the Government of the Republic of Bolivia, of June 19, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives you the art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by the Legislative Decree No. 66, of November 16, 1981, provides for the modality of Partial Reach Agreement of Economic Supplementation;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, of the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the Common Market of the South (Mercosur), and of the Republic of Bolivia, based on the Treaty of Montevideo of 1980, signed on June 19, 2001 in Montevideo, the Twelfth Additional Protocol to the Economic Supplementation Agreement No. 36 (Resolution No. 05/00 of the Administrative Commission of the ACE-36-Magnification of Quotas for items 6205.20.00 and 6205.30.00), between the Governments of the Federative Republic of Brazil, of the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to Mercosur, and the Government of the Republic of Bolivia;

D E C R E T A:

Art. 1º The Twelfth Second Additional Protocol to the Economic Supplementation Agreement No. 36 (Resolution No. 05/00 of the Administrative Commission of the ACE-36-Extension of Quotas for items 6205.20.00 and 6205.30.00), between the Governments of the Federative Republic of Brazil, of the Republic Argentina, of the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to the Common Market of the South (Mercosur), and the Government of the Republic of Bolivia, aped by copy to the present Decree, shall be executed and fulfilled as entirely as in it contains.

Art. 2º This Decree takes effect on the date of its publication.

CONCLUDED BETWEEN THE GOVERNMENTS OF THE STATES PARTIES OF MERCOSUR AND THE GOVERNMENT OF THE REPUBLIC OF BOLIVIA

Twelfth Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of States Parties to the Common South Market (MERCOSUR), on the one hand, and of the Republic of Bolivia, on the other, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Association Latin American Integration (ALADI),

HAVING SEEN Resolution MCS-BO N ° 05/00 of the ACE Administrative Commission 36,

DECK IN:

Article 1º-The Argentine Republic outward to the Republic of Bolivia, for items 6205.20.00 y 6205.30.00, under the Transient Regime of Origin established by Article 2 of the Tenth Additional Protocol, the following quotas, which will benefit from a preference of 85%, by 12/31/2001, of conformity with the set out in Annex 2 of the ACE 36:

ITEM NALADI/SH (93) 6205.20.00 quota: 4000 kg

ITEM NALADI/SH (93) 6205.30.00 quota: 3000 kg

Article 2º-This Protocol will enter into force in the date of its signature.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly certified copies to the signatory Governments.

IN FÉ DO WHAT, THE RESPECTIVE Plenipotentiaries sign the present Protocol in the city of Montevideo, to the nineteen days of the month of June two thousand and one, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
