DECREE N. 4,508? FROM December 11, 2002

Dispose about the specific regulation that defines the minimum energy efficiency levels of triphasic electric motors of induction rotor squirrel cage, of national or imported manufacture, for marketing or use in Brazil, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, incisus IV, of the Constitution, and with a view to the provisions of Law No. 10,295 of October 17, 2001 and in Decree No. 4,059 of December 19, 2001,

DECRETA:

Art. 1º It gets approved the specific regulation that defines the levels minimum energy efficiency of triphasic electric motors of induction rotor squirrel cage, of national or imported manufacture, for marketing or use in Brazil, in the form of Annexes I and II of this Decree.

Art. 2º The establishment of the maximum energy consumption levels, or energy efficiency minimums of the remaining appliances and machines, as well as the target programmes provided for in the art. 2º of Law No. 10,295 of October 17, 2001 will be the subject of specific regulations by means of interministerial portaries of the Ministries of Mines and Energy, Science and Technology and Development, Industry and Foreign Trade, after Approval of the Gestor Committee of Indicators and Energy Efficiency Levels-CGIEE.

Art. 3º This Decree comes into force on the date of its publication.

ANNEX I

SPECIFIC REGULATION THAT DEFINES THE MINIMUM ENERGY EFFICIENCY LEVELS OF TRIPHASIC ELECTRIC MOTORS OF INDUCTIVE SQUIRREL CAGE ROTOR

CHAPTER I

CHARACTERIZATION OF THE PRODUCT

Art. 1º The object equipment of this regulation corresponds to the triphasic electric motors of induction squirrel cage rotor, of national or imported manufacture, for marketing or use in Brazil, including both the marketed motors isolately as those that are part of other equipment.

Single paragraph. The object motors of this regulation have the following characteristics:

I? for operation on 60 Hz triphasic AC distribution network, and nominal voltage up to 600V, individually or in any combinations of stresses;

II? nominal frequency of 60 Hz or 50 Hz for operation in 60 Hz;

III? a single rated speed or multiple velocities for operation at a single rated speed;

IV? in the nominal powers of 1 a 250cv or hp (0.75 a 185kW) in the polarities of 2 and 4 poles; in the powers of 1 a 200cv or hp (0.75 a 150kW) in the polarity of 6 poles and in the powers of 1 a 150cv or hp (0.75 a 110kW) in the polarity of 8 poles;

V? for continuous operation, or classified as operation S1 as per the Brazilian Standard? NBR 7094/2000, of the Brazilian Association of Technical Standards? ABNT;

VI? starting performance according to the characteristics of categories N and H of ABNT's NBR 7094/2000 standard, or equivalent categories, such as A or B or C of the " National Equipment Manufacturers Association?? NEMA; and

VII? is of the fully enclosed type with external ventilation, coupled or sympathetic to the electric motor's own actuation axis.

Art. 2º The Annex II provides additional clarifications that contribute to the characterization of the covered motors.

Paragraph single. The Committee Manager of Indicators and Levels of Energy Efficiency? CGIEE, established by Decree No. 4,059 of December 19, 2001, will be able, with technical group support, to draw up supplementary documents that are necessary to identify the engines of which it treats this regulation.

CHAPTER II

MINIMUM NOMINAL YIELDS AND REHEARSAL PROCEDURES

Art. 3º The indicator of energy efficiency to be used is nominal throughput.

Art. 4º The test method for determination of the nominal yield is the variation of Method 2? Dynamometric Testing with indirect measurement of the supplementary losses and direct measurement of the losses in the stator (I2R), in the rotor (I2R), in the nucleus and by friction and ventilation, described in the NBR 5383 standard? 1 /2001 from ABNT? Spinning Electric Machines? Part 1? Triphasic Induction Motors? Rehearsals. The nominal throughput shall be determined in the nominal voltage conditions, nominal frequency and nominal output power on the engine shaft.

Art. 5º The minimum nominal throughput levels to be met are set in the table below, including the standard and high-throughput engine lines.

§ 1º These values are subject to the tolerances described in the NBR 7094/2000 standard of ABNT.

§ 2º Understanding by standard line motors and the high-throughput line the triphasic electric motors of induction cage rotor squirrel characterize technically in the arts. 1º and 2º and with minimum nominal yields equal to or higher than those set in the table below.

CHAPTER III

ENGINE IDENTIFICATION PLATE

Art. 6º The permanent identification plate of an engine must clearly contain the yield and nominal power factor of the engine, observed the remaining requirements set out in the NBR standard 7094 from ABNT.

CHAPTER IV

CONFORMITY ASSESSMENT AND LABS

Art. 7º The conformity assessment process for verification of the minimum energy efficiency levels of the three-phase motors, characterized in accordance with Chapter I of this regulation, is it the one of the labelling, carried out by the National Institute of Metrology, Normalization and Industrial Quality? Inmetro, by means of the Brasileiro de Etiqutage Program? PBE.

§ 1º Prior to the marketing of a basic engine model, this should be submitted by the manufacturer or importer to Inmetro for marketing authorization in Brazil. It is understood by basic model an engine that represents a set of motors with the same electrical and mechanical characteristics and produced by a same manufacturer.

§ 2º The marketing authorization conferred by the Inmetro does not exempt the manufacturer or importer from the responsibility to commercialize their equipment within the minimum efficiency indices defined in this regulation.

Art. 8º The laboratories responsible for the trials that will prove the fulfillment of the minimum nominal income levels of the engines manufactured or marketed in the Country are those accredited or assigned by the Inmetro.

Paragraph single. The labs accredited or assigned by the Inmetro are related in the specific field, for this regulation, on the Inmetro's electronic page.

Art. 9º The CGIEE could, eventually, and with the knowledge of the Inmetro, designate other capable labs to carry out the relevant tests, when accredited or recognized cannot meet the requests or stay prevented momentarily from meeting the requests. In such a case, the laboratories are to be previously audited by technicians indicated by the Inmetro, based on the NBR ISO 17.025 standard; from ABNT, and the test accompanied by specialist indicated by the Inmetro.

CHAPTER V

ENGINES COMPONENTS OF OTHER MACHINES

Art. 10. Final-use driving machines that have specific regulation regarding minimum efficiency or maximum energy consumption levels, as per Decree No. 4,059, of 2001, are not covered by this regulation.

Paragraph single. It is understood by end-use driving machines the equipments that have motors as one of their components.

Art. 11. The end-use driving machines that do not fall into the art. 10 must possess, on their identification plate or on additional plate, the data of the engine or the component motors, explaining the yield information and nominal power factor.

Art. 12. It will be up to the manufacturers of the end-use driving machines, the proving before the Ministry of Development, Industry and Foreign Trade or the organ by it indicated, that a particular motor component of a basic model of the driving machine of end use, is not covered by this regulation.

Art. 13. The motors, both of the standard and high-throughput line, components of end-use driving machines that are manufactured or imported in carcasses lower than those referenced by the NBR standard? 7094/2000, of the ABNT, as correspondence between nominal power and synchronous velocity, are also covered by this regulation.

Paragraph single. The time frame and condition of suitability for the engines covered by the caput of this article, when it comes to costly modifications, are explained in the arts. 19 and 20 of this regulation.

CHAPTER VI

IMPORTED END-USE MOTORS AND MACHINES IMPORTED

Art. 14. The companies importing motors and end-use driving machines, covered by this regulation, must substantiate the fulfilment at minimum energy efficiency levels during the import process.

Art. 15. In the process of importing the motors and end-use driving machines of which it treats this regulation, there should be the Inmetro's annuence for granting the Import License, obtained in advance of the shipment abroad.

CHAPTER VII

SURVEILLANCE AND PENALTIES

Art. 16. The surveillance of compliance with the provisions contained in this regulation, throughout the national territory, shall be effected by the Inmetro and the entities of public law with it convenienced.

Paragraph single. Failure to comply with this regulation, shall entail offenders, the application of penalties provided for in Law No. 10,295 of October 17, 2001.

CHAPTER VIII

DURATION

Art. 17. The cut-off date for manufacturing in the country or import from the exterior of motors that are not part of the end-use driving machine and which do not meet the provisions of this regulation is that of the entry into force of this Decree.

Art. 18. The cut-off date for marketing of the engines manufactured in the country or imported from abroad that are not part of the end-use driving machinery and which do not meet the provisions of this regulation is February 28, 2003.

Paragraph single. The knowledge of shipment of the imported motors referring to the caput of this article, should have been issued until the date of entry into force of this regulation.

Art. 19. The cut-off date for manufacturing in the country or import from the exterior of end-use driving machines whose component engines are covered and which do not meet the provisions of this regulation is February 28, 2003.

Paragraph single. For end-use driving machines for which the fulfillment of this regulation entails in onerous modifications, financially, technically or operationally, proven together with the Ministry of Development, Industry and Commerce Exterior-MDIC or the organ by it indicated, the term of the caput stays extended to September 30, 2003.

Art. 20. The cut-off date for commercialization of end-use driving machines whose component motors do not meet the provisions of this regulation is July 31, 2003.

Paragraph single. For end-use driving machines for which the fulfillment of this regulation entails in onerous modifications, financially, technically or operationally, proven together with the Ministry of Development, Industry and Commerce Exterior-MDIC or the organ by it indicated, the term of the caput is extended to December 30, 2003.

ANNEX II

CLARIFICATIONS FOR THE CHARACTERIZATION OF THE OBJECT PRODUCTS OF THIS REGULATION

This Annex presents additional clarifications to characterize the object motors of this regulation, as described below:

I? Variable Speed Motors

Motors of various nominal speeds and motors with built-in inverters not are equipment covered by this regulation, as their projects are for use at variable speed.

However, the engines that are single-speed, that meet the other criteria defined in this Attachment, and which can be used with inverters in variable speed applications as a additional characteristic, are equipment covered by this regulation. In other words, being suitable for use with an inverter does not exime an engine of the demands set out here.

II? Motors with Mechanical Seal or Retainers

When the engine without mechanical seal or retainer is covered by this regulation, the motor with corresponding mechanical seal is also covered. It is mandatory that the yield of the said motor is to be affixed in tests with the withdrawal of the seals or retainers installed.

III? Intermediate Power Motors

The electric motors built for intermediate powers to the powers defined in the art TABLE. 5º of Annex I will be referred to as? engines with intermediate powers?.

The motors with intermediate powers are covered by this regulation. The value of the minimum income that applies is that of the adjacent power closest to the nominal power of the same. For engines with equidistant intermediate powers from two adjacent powerhouses, the engine yield with rated power higher than it should be required.

IV? Motors for Monobloco Bombs

An electric motor, with the characteristics set out in the art. 1º of Annex I, and which can be docked to a pump is covered by this regulation.

V? Motor Coupled to Mechanical Actioners

An electric motor, with the characteristics set out in the art. 1º of Annex I, which is connected to a mechanical actuator of gears or to a set of gears by direct coupling, straps, screws, or other means, is equipment covered by this regulation.

VI? Motors with Special Roles

An electric motor, with the characteristics set out in the art. 1º of Annex I, the application of which requires roller bearings or roller bearings for axial load, is covered by this regulation. It is permissible for the engine yield to be awounded in tests with the use of radial ball bearings.

VII? Special Engines

Triphasic induction electric motors with special electrical and mechanical designs for specific applications are excluded from this regulation. The manufacturers of these engines are expected to substantiate this exclusion from the Ministry of Development, Industry and Foreign Trade or to the body by it indicated.

VIII? Engines in Classified Areas

Certified electric motors for classified areas, with the exception of those of the non-acendable type, are not covered by this regulation. The manufacturers of these engines are expected to substantiate this exclusion from the Ministry of Development, Industry and Foreign Trade or to the body by it indicated.
