Declarations of public utility, for the purposes of dispropriation, in favor of the Autopista Plateau Sul S.A. dealership, the estate it mentions, located in the Municipality of Curitiba, State of Paraná.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, caput, inciso IV, of the Constitution, and with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 on the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987 of February 13, 1995, and in accordance with what appears in the ANTT Process No. 50500.104465 /2012-18,

D E C R E T A:

Art. 1º It shall be declared of public utility, for the purposes of dispropriation, in whole or in part, in favour of the Autopista South S.A. dealership, the immovable bounded by the topographical coordinates described below, excluded the public domain goods, situated on the shores of the 116/PR Rodovia, located in the Municipality of Curitiba, State of Paraná, necessary to the complementation of the execution of the intersection implantation works at deslevel with collector tracks at km 116 + 500m.

§ 1º A description starts with the following boundaries and confrontations: west, with domain strip of the Southern 116/PR; Rodovia, with the Rua Dilson Luiz; east, with CEASA/PR-Central Supply of the Paraná S.A.; and north, with CEASA/PR-Central Supply of Paraná S.A.; it starts the perimeter at the vertex A (N= 7,172,836 ,931m and E= 670,310 ,059m); of this, it follows with true azimut of 192 ° 59 ' 57 " and distance of 207 ,05m, craved in common in this stretch with domain strip of the 116/PR Highway, up to the vertex B (N= 7,172,625 ,446m and E= 670,261 ,236m); of this, follows with true azimuth of 162 ° 27 ' 51 " and distance of 30 ,37m, craved in common on this stretch with Dilson Luiz Street, up to the vertex C (N=7.172.596, 487m and E= 670,270 ,387m); of this, follows with true azimut from 43 ° 19 '53 "and distance of 23 ,36m, up to the vertex D (N= 7,172,613 ,479m and E= 670,286 ,418m); of this, follows with true azimuth of 12 ° 50' 14" and distance of 11 ,20m, up to the vertex E (N= 7,172,624 ,400m and E= 670,288 ,906m); of this, follows with true azimuth of 12 ° 58 '25 "and distance of 53 ,13m, up to the vertex G (N= 7,172,696 ,662m and E= 670,282 ,488m); of this, follows with true azimuth of 11 ° 38' 09" and distance of 142 ,92m, up to the vertex H (N= 7,172,836 ,642m and E= 670,311 ,313m); of this, follows with true azimuth of 282 ° 59 ' 57 " and distance of 1.29m, all lines craved in common in this stretch with CEASA/PR-Central Supply of Paraná S.A., up to the vertex A; with area of one thousand, five hundred and forty-seven square meters and six square centimeters.

§ 2º The coordinates described in the § 1st are georreferenced to the Brazilian Geodetic System and are found to be represented in the U.T.M. system, referred to the Central Meridian 51 ° WGr, having as Datum the SIRGAS2000; all the azimutes and distances, areas, and perimeters were calculated in the U.T.M. projection plan.

Art. 2º Stay the concessionary Autopista South S.A. authorised to promote, with own resources, the disappropriation of the land areas and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and the fulfilment of the obligations attached to the environmental entities and too many organs of the public administration.

Art. 4º This Decree takes effect on the date of its publication.
