DECREE OF May 25, 2009.

Declara of social interest, for purposes of agrarian reform, the rural real estate named?Dulcinea farm?, situated in the Municipality of Chorozinho, State of Ceará, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2^o of the Supplemental Act n^o 76, of July 6, 1993, 18 and 20 of the Act n^o 4,504, of November 30, 1964, and 2^o of the Law n^o 8,629, of February 25, 1993,

DECRETA:

Art. 1^o Is it declared of social interest, for purposes of agrarian reform, the rural real estate named?Farm Dulcinea?, with registered area of four hundred and fifty hectares and ninety airs, and measured area of four hundred and forty-seven hectares, eighty and three airs and fifty three centiars, situated in the Municipality of Chorozinho, object of the Register n^o R-1-79, fls. 79, Book 2, of the Estate Registration Office of the Comarch of Chorozinho, State of Ceará (Process INCRA/SR-02/n^o 54130.000229 /2008-53).

Art. 2^o This Decree, regardless of discrimination or fundraising, did not hear particular compensation effects, in respect of areas of public domain consisting of law or registration and the private domain areas harvested by nullity, prescription, comb or ineffectiveness operated solely to benefit of any legal person of public law, excepted the good faith benfeons in them existing previously to the science of the beginning of the administrative procedure, excluding still from their effects the semovents, machines and the agricultural implements and any benfeitory introduced by anyone who comes to benefit from their targeting.

Art. 3^o The National Institute of Colonization and Agrarian Reform-INCRA, attested to the private dominial legitimacy of the mentioned planimetry area, is hereby authorized to promote the disappropriation of the rural real estate of which it treats this Decree, in the manner provided for in the Supplementary Act n^o 76, of July 6, 1993, and to maintain the areas of Legal Reserve and permanent preservation provided for in Law n^o 4,771, of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4^o This Decree comes into effect on the date of its publication.
