DECREE OF August 12, 2014

Declara of public utility, for the purposes of misappropriation, in favor of Transbrasiliana Concessionaire de Rodovia S.A., the real estate it mentions, located in the Municipality of Mirassol, State of São Paulo.

THE CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 on the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and in accordance with that appearing in the ANTT Process No. 50500.189510 /2013-87,

DECRETA:

Art. 1º shall be declared of public utility, for the purposes of dispropriation, in whole or in part, in favour of Transbrasiliana Concessionaire de Rodovia S.A., the real estate delineated by the topographical coordinates described below, excluded the goods from public domain, situated on the banks of the Transbrasiliana Highway, 153/SP, located in the Municipality of Mirassol, State of São Paulo, necessary for the execution of the works of implantation of device at km 084 + 880m:

Paragraph single. The coordinates described in the caput are georreferenced to the Brazilian Geodetic System, represented in the UTM System, referred to the Central Meridian 51 ° WGr, having as the Datum the SIRGAS2000, and the true azimutes and the distances, areas and perimeters calculated in the UTM projection plan.

Art. 2º Stay Transbrasiliana Concessionaire de Rodovia S.A. authorised to promote, with own resources, the disappropriation of the areas of land and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941 Art. 3º The declaration of public utility does not exonerate the dealership from the prior obtaining of the licensing and fulfilment of the obligations attached to the environmental and other bodies of the public administration, necessary for the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree comes into effect on the date of its publication.
