DECREE OF May 20, 2002

Institutes the Committee of the Basin Hydrographic of the Rios Piracicaba, Capivari and Jundiaí, located in the states of Minas Gerais and São Paulo, and gives others providences.

THE PRESIDENT OF THE FEDERAL SUPREME COURT, in the exercise of the office of President of the Republic, using the assignment that gives him the art. 84, inciso IV, of the Constitution, and with a view to the provisions of the Laws 9,433, of January 8, 1997, and 9,984, of July 17, 2000,

D E C R E T A:

Art. 1º It is established the Committee of the Basin Hydrographic of the Rios Piracicaba, Capivari and Jundiaí, collegiate body, with normative, deliberative and consultative assignments within the framework of jurisdiction of the respective river basins, linked to the National Council of Water Resources, in the terms of Resolution No. 5, of April 10, 2000.

Single paragraph. The acting area of the Committee of the Hydrographic Basin of the Rios Piracicaba, Capivari and Jundiaí is located in the states of Minas Gerais and São Paulo, is defined by the geographical boundaries of the river basin of the Piracicaba River, of the Union's domain, and of the Rivers Capivari and Jundiaí, of dominion of the State of São Paulo, bordered by the drainage areas with their exuttories, located, in scale 1:1.000.000, in the coordinates 48º20 `, west longitude, and 22º37 `, south latitude, at coordinates 47º46 `, west longitude, and 22º59 `, south latitude, and in the coordinates 47º18 `, west longitude, and 23º14 `, south latitude, respectively.

Art. 2º The Committee of the Basin Hydrographic of the Rios Piracicaba, Capivari and Jundiaí will be composed of Representatives:

of the Union;

I-of the States of Minas Gerais and of São Paulo;

II-of the Municipalities situated, in whole or in part, in their area of acting;

V-dos users of the waters of their acting area; and

V-of the civil entities of water resources with proven acting in the basins.

§ 1º The number of representatives, holders and supplers, of each sector mentioned in this article, as well as the criteria for their choice and referral, will be established in the internal regiment of the Committee, limited the representation of the Executive Powers of the Union, of the states and of the Municipalities at half of the total members.

§ 2º The process of choosing the representatives of the Committee will be public, with ample and prior dissemination.

Art. 3º The functioning of the Basin Committee of the Rios Piracicaba, Capivari and Jundiaí will be defined by its internal regiment, in accordance with the precepts contained in Law No. 9,433 of January 8, 1997, and in Resolution No. 5, 2000.

Single paragraph. The internal regiment of the Committee will be approved by its members and published in the Official Journal of the Union.

Art. 4º The meetings of the Committee will be public, giving itself to its broad convocation.

Art. 5º This Decree takes effect on the date of its publication.
