DECREE OF February 3, 2004.

Declares of social interest, for purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993, the following rural real estate:

I-"Fazendas Sohém and others", with area registered from nine thousand, one hundred and eighteen hectares and seventeen ares, and measured area of nine thousand, two hundred and nineteen hectares, ninety-five airs and forty-two centiars, situated in the Municipalities of Utinga, Morro do Chapéu and Bonito, object of the Records in the R-1-2.044, fls. 53, Book 2-T; R-1-1.109, fls. 11, Book 2-K; R-1-819, fls. 20, Book 2-H; R-1-820, fls. 21, Book 2-H; R-1-1.440, fls. 43, Book 2-N and R-1-1.439, fls. 42, Book 2-N, of the Estate Registration Office of the Morro Comarch of the Hat, State of Bahia (Case INCRA/SR-05/nº 54160.003706 /2002-90);

II-"Muxuré", with area of six thousand, four hundred and sixty-four hectares and fifty five airs, situated in the Municipality of Quixeramobim, object of the Registry # R-5-291, fls. 02, Book 2, of the Carthorium of the 2º Oftice of the Comarch of Quixeramobim, State of the Ceará (Process INCRA/SR-02/nº 54130.000168 /2003-10);

III-"Fazenda São José", with area of two hundred and ten hectares, situated in the Municipality of Itaberaí, object of the Matriculation No. 4,599, fls. 115, Book 2-Q, of the Estate Registration Office of the Comarch of Itaberaí, State of Goiás (Case INCRA/SR-04/nº 54150.001245 /2001-59);

IV-"Farm Pau D' Garlic-III", with area of six hundred and seven hectares, twenty and seven ares and eighty and one centiars, situated in the Municipality of Rondonópolis, object of the Matriculation No. 57,793, Ficha 01, Book 2, of the Cartoire of the 1º Oftice of the Comarch of Rondonópolis, State of Mato Grosso (Case INCRA/SR-13/nº 54240.000094 /2002-93);

V-"Fazenda Cocalinho", with area of one thousand, two hundred and eighty and one hectares, forty-two airs and seventy six centiars, situated in the Municipality of Conception of the Araguaia, object of the Registration # R-3-7.915, of the Carthorium of Registration of Real estate of the Comarch of Redemption, State of the Pará (Process INCRA/SR-27/nº 54600.002094 /2002-91);

VI-"Farm Panorama II", with area of three thousand, four hundred and sixty-two hectares, eighty-two airs and Eighty-four centiars, situated in the Municipality of Santa Maria of the Barriers, object of the Records in the R-1-23.483, Ficha 01, Book 2; R-1-23.484, Ficha 01, Book 2; R-1-23.485, Ficha 01, Book 2, of the Estate Registry Office of the Comarch of Conception of the Araguaia and R-1-3.445, Ficha 01, Book 2-R, of the Estate Registration Office of the Santana Comarch of the Araguaia, State of Pará (Case INCRA/SR-27/nº 54600.002837 /99-85);

VII-"Mendonça Farm", with area of a thousand and four hundred hectares, situated in the Municipalities of Mogeiro, Itabaiana and São José dos Ramos, object of the Matriculation No. 3,300, fls. 27, Book 2-I, of the General Registration Service of Real estate of the Comarch of Itabaiana, State of Paraíba (Case INCRA/SR-18/nº 54320.000193 /2003-66);

VIII-"Engineer St. Peter", with area of one hundred and seventy four hectares and twenty-six airs, situated in the Municipality of Jaboatão dos Guararapes, object of the Registry # R-3-29.061, fls. 52, Book 2-F-E-1, of the Estate Registration Office of the Comarch of Jaboatão dos Guararapes, State of Pernambuco (Case INCRA/SR-03/nº 54140.000220 /00-96);

IX-"Farm Paradise", with area of a thousand, five hundred and twenty hectares and sixty ares, situated in the Municipality of Serra Talhada, object of the Registry # R-1-3.306, fls. 90, Book 2-Q, of the Cartoire of the 1º Oftice of the Comarch of Serra Talhada, State of Pernambuco (Process INCRA/SR-29/nº 54141.000718 /2003-71); and

X-"Farm Well of the Serrote and Cedro", with area of a thousand, three hundred and sixty and nine hectares and seventy five airs, situated in the Municipality of Serra Talhada, object of the Records in the R-6-2.913, fls. 297, Book 2-O; AV-2-7.610, fls. 194, Book 2-AF and R-4-1.562, fls. 246, Book 2-K, of the Carthorium of the 1º Oftice of the Comarch of Serra Talhada, State of Pernambuco (Case INCRA/SR-29/nº 54141.000635 /2002-00).

Art. 2º Excludes from the effects of this Decree the semovents, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which treats this Decree, in the form provided for in the Supplementary Act No. 76 of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771, of September 15, 1965 preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
