DECREE NO. 4,013, OF November 13, 2001

Disposes on the execution of the Fifty First Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotive vehicles), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, of August 27, 200l.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of the Uruguay, on the basis of the Treaty of Montevideo of 1980, signed, on December 20, 1982, in Montevideo, the Economic Supplementation Agreement No. 2, between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, which was incorporated into the Brazilian legal planning by means of the Decree No. 88,419 of June 20, 1983;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, on the basis of the Treaty of Montevideo of 1980, signed on August 27, 200l, in Montevideo, the Fifty First Additional Protocol to the Economic Supplementation Agreement No. 2 (Automotive vehicles), between the Governments of the Federative Republic of Brazil and of the Eastern Republic of Uruguay;

D E C R E T A:

Art. 1º It gets promulgated, for all intents and purposes, the Fourteenth Additional Protocol to the Economic Supplementation Agreement No. 2 (vehicles Automotors), between the Governments of the Federative Republic of Brazil and the Eastern Republic of Uruguay, apensed by copy to the present Decree.

Art. 2º This Decree takes effect on the date of its publication.

Economic Supplementation Agreement No. 2 Concluded between the Federative Republic Of Brazil

and the Eastern Republic Of Uruguay

Thurstieth First Additional Protocol

The Plenipotentiaries of the Federative Republic of Brazil and the Eastern Republic of Uruguay, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Latin American Association of Integration (ALADI),

Concome in:

Article 1º-The Federative Republic of Brazil Outorga to the Eastern Republic of Uruguay, for the period from 1º to September 30 of 2001, a quota of one thousand and eighty four units of automotive vehicles, ranked in the NALADI/SH 87.02, 87.03 and 87.04 positions, for any category.

Article 2º-The Eastern Republic of Uruguay outorates to the Republic Federative of Brazil, for the period from 1º to September 30, 2001, a quota of three hundred and thirty-four units of automotive vehicles, ranked in the NALADI/SH 87.03 and 87.04 positions, for units of up to 4,000 kg of total gross weight.

Article 3º-The units of automotive vehicles, constants of the quotas bestowed by the Federative Republic of Brazil and the Eastern Republic of Uruguay in the Twenty-First, Twenty-eighth, Twentieth, Thirtieth, Thirtieth, Thirtieth First, Thirtieth Second, Thirtieth Third, Thirtieth Fifth, Thirtieth Seventh, Thirtieth Nono, Quadrageth First, Quadrageth Third, Quadragumeth Fifth, Quadrageth Seventh and Quadragumth Ninth Additional Protocols, which were not used in the period 1º from January 2000 to August 31, 2001, may be availed in the period from 1º until September 30, 2001, without prejudice to the quotas set out in Articles 1º and 2º of this Protocol.

Article 4º-Fixed as a source standard 60/40% for the models in production and 55/45% for the new models.

Article 5º-The percentage of regional origin parts applicable to the models in production, Article 4º of the Seventeenth Additional Protocol to ACE No. 2, will be from 25%.

Article 6º-The present Protocol vigour since 1º September 2001 to September 30, 2001. Notwithstanding, it will lapse at the time of the entry into force of the "Agreement on the Automotive Policy of Mercosur".

The General Secretariat of the ALADI shall be a depositary of this Protocol, of which it will send duly certified copies to the Signatory governments.

In faith of what, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the twenty-seven days of the month of August two thousand and one, in an original in the Portuguese languages and Spanish, being both texts being equally valid.
