DECREE OF June 26, 2007.

Institui Inter-ministerial Working Group on the Globally Harmonized System of Classification and Labeling of Chemical Products.

The PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him the art. 84, inciso VI, point (? a?, of the Constitution,

DECRETA:

Art. 1st It is established Interministerial Working Group named GT-GHS-Brazil, with the assignment of draw up and propose strategies, guidelines, programs, plans and actions for the implementation of the Globally Harmonized System of Classification and Labeling of Chemicals-GHS in the Country, owing, to both:

I-identify and involve actors, public or private, who, directly or indirectly, come to suffer the impacts by the deployment of GHS in Brazil, stimulating the partnership, synergy and complementarity of the actions, respected the specificities of competence and acting of governmental bodies;

II-elaboration and approve term of reference containing the conceptual and methodological aspects of the System Globally Harmonized of Classification and Labeling of Chemicals-GHS; and

III- elaborate and approve the internal regiment of the GT-GHS-Brazil.

Art. 2º The GT-GHS-Brazil will be coordinated by the Ministry of Development, Industry and Foreign Trade, aided by two deputy coordinations exerted by the Ministry of Labour and Employment and Ministry of Health, being integrated by a representative, holder and deputy, from each body listed below:

I-Ministry of Development, Industry and Commerce Exterior;

II-Ministry of Justice;

III-Ministry of Defense;

IV-Ministry of Foreign Affairs;

V-Ministry of Transport;

VI-Ministry of Agriculture, Livestock and Supply;

VII-Ministry of Labour and Employment;

VIII-Ministry of Health;

IX-Ministry of Mines and Energy;

X-Ministry of Science and Technology;

XI-Ministry of the Environment; and

XII-Brazilian Agency of Intelligence.

Paragraph single. The members of the GT-GHS-Brazil will be nominated by the holders of the bodies represented and designated by the Minister of State for Development, Industry and Foreign Trade.

Art. 3rd The GT-GHS-Brazil will be able to:

I-constitute subgroups of work and subcommittees on specific themes;

II-invite representations from civil society, including from workers and from employers, to participate in the meetings of the GT-GHS-Brazil, of subgroups of work and subcommittees;

III-invite practitioners of notorious knowledge in the matter or specialists of other bodies to provide advice to their activities and participate in the subgroups of work and subcommittees; and

IV-use world technical references on the matter, in particular the Purple Book (Purple Book) published by the Organization of the United Nations.

Art. 4º Caberá to the Ministry of Development, Industry and Foreign Trade provide the administrative support and means necessary for the implementation of the activities of the GT-GHS-Brazil.

Art. 5º The members of GT-GHS-Brazil will not receive remuneration for this performance and the works by them developed will be considered to be provided relevant service public.

Art. 6th The expenses required for the execution of the works will be carried out by the integral organs of the GT-GHS-Brazil.

Art. 7th The GT-GHS-Brazil should present annual report of their activities to the Minister of State for Development, Industry and Foreign Trade.

Art. 8th The GT-GHS-Brazil will have three years' time frame, from its installation, for completion of its works, extended by equal period, upon justification submitted by its coordinator to the Minister of State for Development, Industry and Foreign Trade.

Art. 9th This Decree comes into effect on the date of its publication.
