DECREE OF 1º OF SEPTEMBER 2000.

Outorga to the Energetical Company of Minas Gerais-CEMIG concession for public service exploration of electric power transmission, pertaining to the Itajubá 3 Substation, located in the Municipality of Itajubá, State of Minas Gerais, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, using the attribution that confers it on art. 84, incisus IV, of the Constitution, and with a view to the provisions of the Laws in the 8,987, of February 13, 1995, and 9,074, of July 7, 1995, and what appear in Process No. 48500.000691 /00-38,

DECRETA:

Art. 1º It is bestoed to the Energy Company of Minas Gerais-CEMIG grant of public service of electric power transmission, for deployment, operation and maintenance of the Itajubá 3 Substation, with two transformative units of 300 MVA, 525-138 kV, two transmission line excerpts, with approximately 3 km extension, with origin in Itajubá 3 Substation, at 500 kV, and termination at the sectioning point of the Transmission Line Wellings of Caldas-Cachoeira Paulista, located in the Municipality of Itajubá, in the State of Minas Gerais, and replacement of the protection, supervision and telecommunications systems in the substations of the Wells and Cachoeira Poices Paulista, belonging to Furnas-Central Elétricas S.A., located respectively in the Municipalities of Wells of Caldas, State of Minas Gerais, and Cachoeira Paulista, State of São Paulo.

Art. 2º The granting of which treats this Decree will be invigorated by the thirty-year term, counted from the date of the signature of the respective Electrical Power Transmission Public Service Contract Award.

§ 1º The Contract is to be signed within thirty days, counted from the date of the publication of this Decree, under penalty of ineffectiveness of the concession ora outorgada.

§ 2º The application of the Energy Company of Minas Gerais-CEMIG, presented up to thirty-six months before the end of the constant deadline in the caput of this article, the concession may be extended, under the conditions that are stipulated.

Art. 3º The existing goods and facilities in function of the electric power transmission service are bound to the public services granted, vetoed the divesture, assignment, transfer or dation in warranty, without prior and express authorization of the National Electrical Energy Agency-ANEEL.

Paragraph single. Fining the term of the concession, the goods and facilities linked to the provision of the service granted will revert to the Union, in the manner provided for in law and in the Grant Agreement.

Art. 4º This Decree goes into effect on the date of its publication.
