DECREE OF January 17, 2006.

Creates the Interministerial Commission to draw up the rules of arts regulation bill. 221 and 222 of the Constitution and of the organization and exploitation of electronic media services.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him the art. 84, inciso VI, paragraph "a" of the Constitution,

DECRETA:

Art. 1º Is created the Commission Interministerial to draw up forest-regulation of arts regulation law. 221 and 222 of the Constitution and of the organization and exploitation of electronic media services.

Art. 2º Compete to the Interministerial Commission advise the President of the Republic on the decisions regarding the establishment of principles and guidelines to be observed in the drafting of the anteproject of which it treats art. 1st, it shall be, among others, the following assignments:

I-making the elaboration of studies on issues concerning their purpose; and

II-promote broad debate, with the segments involved, on the different technical, political, economic, social and legal aspects to be observed in the fulfilment of the art. 221 and 222 of the Constitution.

Single paragraph. Established the principles and guidelines of which it treats the caput, the Interministerial Commission shall draw up the foregoing of the law referred to in the art. 1st.

Art. 3º Are members of the Interministerial Commission the holders of the following bodies:

I-Civil House of the Presidency of the Republic, who will coordinate it;

II-Ministry of Culture;

III-Ministry of Communications;

IV-Ministry of the Farm;

V-Ministry of Justice;

VI-Ministry of Development, Industry and Foreign Trade;

VII-Ministry of Education;

VIII-Ministry of Foreign Affairs;

IX-Ministry of Science and Technology;

X-Ministry of Planning, Budget, and Management;

XI-Secretaria de Institutional Relations of the Presidency of the Republic;

XII-General Secretariat of the Presidency of the Republic; and

XIII-Advocacy-General of the Union.

Paragraph single. The Minister of State Head of the Civil House of the Presidency of the Republic will be able to invite to attend the meetings representatives of bodies of the federal, state and municipal administration, and private entities, including organizations nongovernmental.

Art. 4º The Interministerial Committee will be able to constitute technical groups with the purpose of advising you in the exercise of your competencies.

Paragraph single. The composition, functioning and competencies of the technical groups will be detailed in the act of their creation.

Art. 5º The interministerial committee may, still, institute advisory committee, to which it will be able to offer the judged contributions required for drafting the foreproject referred to in art. 1st.

Single paragraph. The advisory committee will be integrated by representatives of the Civil House of the Presidency of the Republic, who will coordinate it, from civil society and entities related to audiovisual production and electronic media services, as well by experts in these areas.

Art. 6º The participation in the Interministerial Commission, in the technical groups and in the advisory committee will be considered to provide relevant, unpaid services.

Art. 7º The House Civil status of the Presidency of the Republic will provide technical and administrative support to the work of the Interministerial Commission.

Art. 8º The Interministerial Commission will terminate its proceedings with the presentation, to the President of the Republic, of the anteproject referred to in art. 1st.

Art. 9º This Decree comes into effect on the date of its publication.

Art. 10. The Decree of April 26, 2005, which creates Interministerial Working Group with the purpose of elaborating on the draft regulations of the arts regulations, is hereby repealed. 221 and 222 of the Constitution and of the organization and exploitation of electronic media services.
