DECREE NO. 6,896, OF July 14, 2009.

Promulgate the Agreement between the Government of the Federative Republic of Brazil and the Government of the Republic of Panama of Cooperation in the Area of Tourism, firming in Brasilia, on May 25, 2007.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and

Whereas the Government of the Federative Republic of the Brazil and the Government of the Republic of Panama celebrated, in Brasilia, on May 25, 2007, a Cooperation Agreement in the Area of Tourism;

Whereas the National Congress has approved this Agreement through Legislative Decree no 42, of March 30, 2009;

Considering that the Agreement entered into international force on April 2, 2009, pursuant to its Article VII;

DECRETA:

Art. 1o The Cooperation Agreement in the Area of Tourism between the Government of the Federative Republic of Brazil and the Government of the Republic of Panama, firming in Brasília, in May 25, 2007, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2o Are subject to the approval of the National Congress any acts that may result in revision of the said Agreement, as well as any further adjustments which, pursuant to the art. 49, inciso I, of the Constitution, carries charges or gravy commitments to the national heritage.

Art. 3o This Decree comes into effect on the date of its publication.

AGREEMENT OF COOPERATION IN THE AREA FROM TOURISM BETWEEN THE

GOVERNMENT OF THE FEDERATIVE REPUBLIC OF BRAZIL AND THE

GOVERNMENT OF THE REPUBLIC OF PANAMA

(henceforth named "Parties"),

Considering the ties of existing friendship and cooperation between both countries;

Convinced that tourism is an excellent tool to promote not only economic development, but also understanding, good will and rapprochement among their peoples;

Consent of the need to promote the cooperation between the two countries in the field of tourism,

Wake up the next:

ARTICLE I

1.The Parties shall foster and support, on the basis of reciprocal benefits, cooperation in the area of tourism, facilitating and encouraging the tourist flow in both directions.

2.The Parties, in consonance with their respective legislations, will stimulate collaboration between their official tourism bodies and other correlates organizations. Such cooperation will be able to contemplate both the exchange of information and the transfer of technology in the field of tourism industry, the development of joint promotional activities and the exchange of technicians and officials from the area of the tourism.

3.The Parties will seek to promote cooperation between private-sector entities of their respective countries, aiming at the development of the infrastructure for tourist trips.

ARTICLE II

1.The Parties, through their official tourism bodies, will interchange information about their legislations in force, including those related to the protection and conservation of their natural and cultural resources, lodging for tourists, travel agencies, facilities for fairs and exhibitions, conventions, congresses and other events in their respective countries.

2.The Parties will seek to ensure that the tourist organizations tasked with promoting propaganda or information respect the cultural, historical and social reality of each country.

3.The Parties, in concordance with their respective legislations, shall seek to facilitate the import and export of documents and of tourism promotion material.

4.The Parties should promote the discussion and exchange of information on fees, investments, as well as incentives that each country offers to foreign investors.

ARTICLE III

1.The Parties shall facilitate the establishment and operation of official tourism bodies of the other country in their respective territories, becoming vetted, to the official tourism bodies, to exercise any commercial activity.

2.The Parties will promote cooperation between experts from both countries, aiming to raise the level of specialization and professionalism of people involved in the promotion and development of tourism.

3.The Parties will promote the exchange of information on planning, study programs, methods and training systems for teachers and instructors in technical subjects.

4.The Parties will stimulate students and tourism teachers to take advantage of the scholarship opportunities offered by colleges, universities and training centers of the other country.

ARTICLE IV

1.The Parties will give priority, in the promotion of tourism, to the sectors in which each of them has identified their specific needs, especially in the culturally most representative areas.

2.The Parties will promote reciprocal visits by media representatives, travel agents and tour operators, with the aim of ensuring that the information on the tourist attractions of each of the countries is disclosed in the other.

3.Each of the Parties shall participate, where possible, at their own expense, from exhibitions, congresses, fairs and other promotional activities organized by the other Party.

4.The Parties, aiming at the effect of the envisaged in paragraph 3, will interchange annual event calendars, both international and national.

ARTICLE V

l.The Parties shall act in accordance with the recommendations of the World Tourism Organization, stimulating the adoption of recommended standards and practices, which, applied by the Governments, will facilitate the development of tourism.

2.The Parties will promote their cooperation and effective participation together with the World Tourism Organization.

3.The Parties undertake to make efforts in order to curb the tourist activities related to the abuses of a sexual and other nature that affect human dignity.

4.Do the Parties agree to exchange information and results of research and projects carried out in the framework of?Combating the Sexual Exploitation of Children and Adolescents in Tourism?, taking the basis of the World Tourism Organization Declaration adopted by General Assembly Resolution 338, celebrated in Cairo, Egypt, from 17 a to October 22, 1995.

ARTICLE VI

1.The Parties agree that matters pertaining to tourism and the tourist industry, as well as the results obtained through mutual collaboration, will be discussed in bilateral meetings by representatives of their official tourism bodies. Such meetings will be scheduled by diplomatic channels, with the frequency required, and carried out, alternately, in each of the countries.

ARTICLE VII

l.This Cooperation Agreement will enter into force on the date of the last notification by which the Parties inform themselves, by diplomatic way, of compliance with the established formalities by the legislation of each country for this purpose.

2.The present Cooperation Agreement shall be effective for five (5) years, automatically renewable for equal periods. It may be denounced by any of the Parties upon written notification, by diplomatic means, in advance of ninety (90) days of the date of completion of an effective period of time.

3.This Cooperation Agreement may be revised, amended or supplemented by the Parties, by mutual agreement, by entering into the amendments in force in the form set out in paragraph 1 of this Article. Any divergence on its interpretation or execution will be resolved by diplomatic avention.
