DECREE OF August 20, 2012

Declara of social interest, for the purposes of agrarian reform, the rural real estate named Plant Tanks / Capoeira, situated in the Municipality of Alagoa Grande, State of Paraíba.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, caput, inciso IV, and 184, caput, of the Constitution, and in the terms of the art. 2 ° of the Supplementary Act n ° 76 of July 6, 1993, arts. 18 and 20 of Law No. 4,504, of November 30, 1964, and art. 2 ° of Law No. 8,629, of February 25, 1993,

D E C R E T A:

Art. 1 ° It shall be declared of social interest, for purposes of agrarian reform, rural real estate named Plant Tanks / Capoeira, with indefinite registered area, and measured area of eight hundred and sixty hectares, forty three airs and forty-six centiars, situated in the Municipality of Alagoa Grande, State of Paraíba, object of the Matriculation n ° 2,878, fls. 131, Book 2-P, and Registration n ° R-1-1.075, Book 2-F, of the Notarial Service and Real Estate Registration of the Comarch of Alagoa Grande, State of the Paraíba (Case INCRA/SR-18/n ° 54320.001107 / 2009-28).

Art. 2 ° This Decree, regardless of discrimination or fundraising, does not hear particular indemnifying effects, in respect of areas of public domain consisting of law or registration and the areas of private domain harvested by nullity, prescription, comb or ineffectiveness operated solely for the benefit of any legal person of public law, excepted good-faith benefactions existing in them previously to the science of the beginning of the administrative procedure, excluding still from its effects the soothing, the machinery and the agricultural implements and any benfeitory introduced by anyone who comes to benefit from their targeting.

Art. 3 ° The National Institute of Colonization and Agrarian Reform-INCRA, attested to the private dominial legitimacy of the mentioned planimetry area, is allowed to promote the disappropriation of the rural real estate of which it treats this Decree, in the form provided for in the Act Supplementary n ° 76 of July 6, 1993 and to keep the areas of Legal Reserve and permanent preservation provided for in Law No. 12,651 of May 25, 2012, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4 ° This Decree comes into effect on the date of its publication.
