DECREE NO. 4,042, OF December 3, 2001.

Disposes on the execution of the Thirtieth Third Protocol Additional to the Economic Supplementation Agreement No. 18, among the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, of July 20, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas, based on the Treaty of Montevideo of 1980, the Economic Supplementation Agreement No. 18 was struck by the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay in Montevideo on November 29, 1991, and incorporated into the Brazilian legal planning by means of the Decree No 550 of May 27, 1992;

Considering that it was signed, on November 20, 2000, in Montevideo, the Twenty-Fourth Additional Protocol to the Economic Supplementation Agreement no 18, incorporated into the Brazilian legal planning by means of Decree No. 3,757 of February 21, 2001, which adapts certain aspects of the ACE-18 origin regime;

Whereas on April 24, 2001, the Trade Commission of the Mercosur adopted, in Asuncion, Guideline 4/01, extending until June 30, 2001 the time frame provided for in Article 9o of the cited Twenty-Fourth Additional Protocol to the Economic Supplementation Agreement no 18, concerning the acceptance of models of certificates of origin;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay firmed up on May 17, 2001, in Montevideo, the Thirtieth Second Additional Protocol to the Economic Supplementation Agreement no 18, pursuant to the 1980 Treaty of Montevideo, which aims to implement the mentioned Guideline 4/01 of the Trade Commission of the Mercosur;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay struck on July 20, 2001, in Montevideo, the Trigth Third Additional Protocol to the Economic Supplementation Agreement no 18, of compliance with the 1980 Treaty of Montevideo, which aims to extend until September 30, 2001 the deadline for mandatory use of the model of certificate of origin instituted by the Twenty-Fourth Additional Protocol to the ACE-18 (MERCOSUR-CMC Decision no 3/00);

DECRETA:

Art. 1º It gets promulgated, for all intents and purposes, the Trigth Third Additional Protocol to the Agreement on Economic Supplementation No. 18, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay of July 20, 2001, apenso by copy to the present Decree.

Art. 2º This Decree enters into force on the date of its publication.

Economic Supplementation Agreement No. 18, Concluded between Argentina, Brazil, Paraguay, and Uruguay

Thirtieth Third Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, accredited by their respective Governments second powers that have been bestowed in good due form, deposited opportunely in the General Secretariat of the Latin American Integration Association (ALADI).

Considering the need to appropriate the deadline for the requirement of the new MERCOSUR Certificate of Origin approved by the Decision 3/00 of the Common Market Council, which coast of the Twenty-Fourth Additional Protocol to the ACE 18,

Concome in:

Article 1º-Extend to Fourth Additional Protocol to ACE 18 for compulsory of the use of MERCOSUR Source Certificate template, which results from the said Additional protocol.

Up to that date will be indistinctly accepted the Certificate of origin issued in the previous form template or new model, provided that it has been issued from the date of issuance of the corresponding future trade or in the 60 consecutive days.

Article 2º-This Protocol shall enter into force on the date of its signature.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly certified copies to the signatory Governments.

In faith of what, the respective Plenipotentiaries sign the present Protocol in the city of Montevideo, at the twenty days of the month of July two thousand and one, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
