DECREE OF June 5, 2001

Discuss on the Conservation and Revitalization Project of the San Francisco River Basin Hydrographic Basin, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him art. 84, inciso IV, of the Constitution, and with a view to the provisions of Law No. 9,433, of January 8, 1997,

DECRETA:

Art. 1º It is created the Project of Conservation and Revitalization of the River Basin Hydrographic San Francisco, comprised of actions designed and executed, in a participatory and integrated manner, by the federal, state, municipal, and federal governments and organized civil society.

Single paragraph. The Project mentioned in the caput of this article is for the purpose of promoting the improvement of the water supply conditions of the Basin, according to its priority uses, by consolidation of goals set by the Gestor Committee, of which it treats the art. 2º of this Decree, in accordance with the principles set out by the National Water Resources Policy.

Art. 2º It is created the Gestor Committee of the Conservation and Revitalization Project of the River Basin Hydrographic Francisco, responsible for the planning, coordination and control of the actions to be developed within the framework of its assignments and especially those of an environmental nature, in the San Francisco River.

Single paragraph. The Committee will be coordinated by the Ministry of the Environment, through its Executive Office, with the participation of its Office of Water Resources, the Secretariat of Infra? structure, of the Ministry of National Integration, of the National Agency of Águas, of the Brazilian Institute of the Environment and Renewable Natural Resources and, still, of the representations of the remaining federated ones that integrate the Basin.

Art. 3º The Project of which treats this Decree will understand the following components of:

I? depollution: support for sewage treatment, control and rational use of agrotoxic, in municipalities that make up the Basin, cabling to the National Water Agency to propose the actions and activities necessary to viabilize the participation of these municipalities in the National Hydrographic Basin Depollution Program, the object of Resolution No. 6 of March 20, 2001, of the National Agency of Waters;

II? soil conservation: support for actions aimed at the conservation of soils involving erosion control, the establishment of micro? basin management criteria and water reuse systems and support for nascent conservation projects;

III? coexistence with drought: support for actions directed towards ensuring the water supply of urban and rural populations dispersed, including the implementation of rural cisterns, underground dams and simplified supply systems for small municipal communities, being that the implementation of supply projects of the dispersed rural population will be at the discretion of the Gestor Committee, of which it treats art. 2º of this Decree, in articulation with the existing nongovernmental institutions in the Basin;

IV? reforestation and recomposition of ciliary mats: support for projects that aim to conserve the use of the forest resources of the Basin by stimulating actions aimed at the forest manor, implantation of ciliary mats, top forest and the recovery of recharging areas of the groundwater, protection of springs, deployment of mute production units and recovery of degraded areas;

V? management and monitoring: support for actions aimed at strengthening environmental management and monitoring of water resources in the San Francisco River Basin, through management's structuring plans, effective with the participation of organizations no? governament;

VI? integrated solid waste management: support for actions aimed at the implementation of the solid waste management plans in the Basin, understanding the monitoring, control, selective collection and sanitary landfill facility and of the plant recycling and composting;

VII? environmental education: support for integrated awareness and social mobilization actions for the development of Bacia environmental projects and gestions, the implementation of environmental education cores, and the empowerment of multiplier agents;

VIII? biodiversity conservation and preservation units: support for projects aiming at the creation, conservation and sustainable manhandling of the parks and environmental protection areas of the Basin and its entangers, as well as the conservation and sustainable use of the biodiversity and genetic resources.

Art. 4º The components of which it treats the previous article should guide the detailing of the actions in the states that integrate the Basin, partially or in their entirety.

Art. 5º The Project managed with budget credit allocated to the Ministry of the Environment, to meet the expenses arising from its execution, will be coordinated by its Executive Office, and administered second technical criteria, oriented by the environmental-environmental partner indicators of the Basin.

Single paragraph. Consider? if criteria for the establishment of priorities, the proposals that value employment or income generation, strengthen the institutional and operational capacity of the entities with acting in the Basin and result in reduction of public spending with hospital internations arising from water-vehicular diseases.

Art. 6º Caberá to the Ministry of the Environment, with the participation of the Ministry of National Integration and with the collaboration of the Gestor Committee, of which treats the art. 2º of this Decree, promote the institutional articulation, aiming at the detailing and implementation of the activities that integrate the Project.

Single paragraph. The Ministry of the Environment will be able to welcome suggestions from the member states of the San Francisco River Basin to define the scope, targets, priorities, means and institutional and community mechanisms of the Project.

Art. 7º This Decree takes effect on the date of its publication.
