Outorga to the Hydro Company Teles Pires concession of use of public good for exploration of the hydraulic power potential, named Hydroelectric Plant Teles Pires, in excerpt from the River Teles Pires, in the states of Mato Grosso and Pará, and gives other arrangements.
THE CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, inciso IV, of the Constitution, with a view to the provisions of the Laws nos 9,074, of July 7, 1995, and 10,848, of March 15, 2004, in the Decrees nos 2,003, of September 10, 1996, and 5,163, of 30 of is July 2004, and what appears in the Process no 48500.000629 /2011-14,
DECRETA:
Art. 1o It is bestoed to the Hydroelectric Company Teles Pires concession of use of public good for electric power generation, with views to the exploration of hydraulic power potential, by means of the Hydroelectric Power Plant Teles Pires, and the respective transmission facilities of restricted interest from the generating station, in excerpted stretch of the Rio Teles Pires, in the Municipalities of Paranaíta, State of Mato Grosso, and Jacareacanga, State of Pará.
Single paragraph. The electric power produced will be commercialized by the dealership, in view of its condition of Electrical Power Independent Producer, pursuant to the Laws nos 9,074, of July 7, 1995, and 10,848, of March 15 of 2004, and of the Decrees nos 2,003, of September 10, 1996, and 5,163, of July 30, 2004.
Art. 2o The granting of which it treats this Decree shall apply for the period of thirty-five years, counted from the date of signature of the respective Public Good Use Concession Contract.
Single paragraph. The Concession Contract is to be signed within the time limit stipulated by the Ministry of Mines and Energy, under penalty of ineffectiveness of the concession bestoed by this Decree.
Art. 3o The dealership is expected to deploy transmission facilities of restricted interest to the Hydroelectric Plant Teles Pires, by sending it to the negotiated acquisition of the respective servings, even if on public domain grounds and tracks of domain of public avenues, with subjection to administrative regulations.
Art. 4o The goods and facilities used for the production of electrical energy at the Hydroelectric Power Plant Teles Pires will only be able to be removed, yielded, transferred or disposed of upon prior and express authorization from the National Agency of Electrical Energy-ANEEL.
Single paragraph. End the term of the concession, the goods and facilities linked to the holding of the Hydroelectric Power Plant Teles Pires and the restricted interest transmission facilities of the generating plant will go on to integrate the Union's heritage, guaranteed compensation of those still unamortized, in the form of the legislation in force.
Art. 5o The dealership is obligated to satisfy the requirements of environment protection, flood control, reservoir management and respective protection areas, and too much acautelating prescriptions of the use of water, provided for in the art. 143 of Decree nth 24,643, of July 10, 1934-Code of Waters, and in the subsequent legislation.
Art. 6o This Decree comes into effect on the date of its publication.
