Altera the Act No. 10,683 of May 28, 2003, which provides on the organization of the Presidency of the Republic and of the Ministries, creating the Registry of the Micro and Small Company, post of Minister of State and positions in committee, and the Supplemental Act No. 123 of December 14, 2006; and gives other arrangements.

A P R E S D E N T A R And P B L I C A I do know that the National Congress decrees and I sanction the following Law:

Art. 1 ° The Law No. 10,683 of May 28, 2003 shall become invigorating with the following amendments:

II-by the Ministers of State Heads of the Civil House, of the General Secretariat, of the Security Cabinet Institutional, of the Secretary of Strategic Affairs, of the Policy Secretariat for Women, of the Human Rights Office, of the Registry of Racial Equality Promotion Policies and the Registry of Micro and Small Business;

" Art. 24-E. The Office of the Micro and Small Company competes to advise directly and immediately the President of the Republic, especially:

I-in the formulation, coordination and articulation of:

a) policies and guidelines for support for microenterprise, small business and craft and strengthening, expansion and formalization of Micro and Small Enterprises;

b) incentive programs and promotion of local productive arrangements related to the microenterprises and small business and promotion of the development of production;

c) programs and actions of qualification and business extension aimed at microenterprise, small business and handicraft company; and

d) programs of promoting competitiveness and innovation aimed at microenterprise and small business enterprise;

II-in the coordination and supervision of Small Sized Business Support Programs costed with resources of the Union;

III-in the articulation and incentive to the participation of the microenterprise, small business and handicraft company in Brazilian exports of goods and services and its internationalization.

§ 1 ° The Registry of Micro and Small Company will participate in the formulation of policies aimed at microentrepreneurship and microcredit, exercising their competencies in articulation with the other organs of the federal public administration, in particular with the Ministries of the Development, Industry and Foreign Trade, Farm, Science, Technology and Innovation and Labour and Employment.

§ 2 ° The Office of the Micro and Small Business has as basic structure the Cabinet, the Executive Office and up to 2 (two) Secretaries. "

Art. 2 ° Stay transferred the competences regarding the microenterprise, small business and handicrafts company of the Ministry of Development, Industry and Foreign Trade to the Registry of Micro and Small Business.

Art. 3 ° The patrimonial of the organs that have had their competencies absorbed will be transferred to the Registry of the Micro and Small Company.

Single paragraph. The framework of effective servers of the organs of which it treats this article will be transferred to the Registry of the Micro and Small Company.

Art. 4 ° The Ministries of Development, Industry and Foreign Trade and Planning, Budget and Management shall adopt, until 90 (ninety) days after the date of the entry into force of this Act, the necessary arrangements for effecting the effectivation of the transfers of which treats this Act, including as to the movement of budget allocations.

Single paragraph. Within the time frame that it treats the caput, the Ministry of Development, Industry and Foreign Trade will provide the necessary administrative and legal support to ensure the continuity of the activities of the Registry of the Micro and Small Company.

Art. 5 ° The Supplementary Law No. 123, of December 14, 2006, passes the following with the following amendments:

§ 5 ° O Forum referred to in the inciso II of the caput of this article aims to guide and advise the formulation and coordination of the national development policy of microenterprises and small-sized enterprises, as well as to follow up and evaluate their deployment, being chaired and coordinated by the Secretariat of the Micro and Small Company of the Presidency of the Republic.

" Art. 76. For compliance with the provisions of this Supplementary Act, as well as to develop and follow up public policies aimed at microenterprises and small businesses, the public power, in line with the Permanent Forum of Microenterprises and Enterprises Small Porte, under the coordination of the Secretariat of the Micro and Small Company of the Presidency of the Republic, should encourage and support the creation of forums with participation of the competent public bodies and the entities linked to the sector.

Single paragraph. The Secretariat of the Micro and Small Company of the Presidency of the Republic will coordinate with the representative entities of microenterprises and small-sized enterprises the implementation of the regional forums in the federation's units. " (NR)

§ 3 ° The Registry of the Micro and Small Company of the Presidency of the Republic together with the municipality and supporting entities and corporate representation shall support the said agents in the form of capacity-building, studies and research, publications, promotion of exchange of information and experiences. " (NR)

Art. 6 ° It shall be created the post of Minister of State Head of the Secretariat of the Micro and Small Company of the Presidency of the Republic.

Art. 7 ° It shall be created the post of special nature of Executive Secretary of the Secretariat of the Micro and Small Company of the Presidency of the Republic.

Art. 8 ° Ficam created the following posts in committee of the Group-Direction and Superiors Superiors destined for the Registry of the Micro and Small Company of the Presidency of the Republic:

I-2 (two) DAS-6;

II-7 (seven) DAS-5;

III-17 (Seventeen) DAS-4;

IV-18 (eighteen) DAS-3;

V-15 (fifteen) DAS-2; and

VI-7 (seven) DAS-1.

Art. 9 ° This Law shall come into force on the date of its publication.

Art. 10. It shall be repealed to point h of the inciso IX of the art. 27 of Law No. 10,683, of May 28, 2003.
