DECREE OF June 23, 2010.

Outorga à Furnas Central Electric S.A. grant for exploration of the public service of electric power transmission, relative to the Transmission Line Mascarenhas-Linhares, Simple Circuit, at 230 kV, and Substation Linhares, 230/138 kV, in the State of the Holy Spirit

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, with a view to the provisions of the Laws in the 8,987, of February 13, 1995, 9,074, of July 7, 1995, 9,491, of September 9, 1997, and 9,648, of May 27, 1998, and what is stated in the Process in the 48500.003834 /2009-17,

DECRETA:

Art. 1º Stay outed to Furnas Central Electric S.A. grant for exploration of the public service of electric power transmission upon construction, operation, maintenance and too much associated facilities required for the functions of measurement, supervision, protection, command, control, telecommunication, administration and support of the endeavors Line of Transmission Mascarene-linches, Simple Circuit, in 230 kV, and Substation Linhares, 230/138 kV, in the State of the Holy Spirit.

Art. 2º The granting of which treats this Decree will be vigorated by the thirty-year term, counted from the date of signing of the respective Electrical Power Transmission Public Service Contract Agreement.

§ 1º The Contract is to be signed within thirty days, counted from the convocation made by the National Electrical Energy Agency-ANEEL, under penalty of ineffectiveness of the concession ora outorgada.

§ 2º Mediant application of Furnas Central Electric S.A. to ANEEL, presented until thirty-six months prior to the expiry of the caput's constant deadline of this article, the concession may be extended under the conditions laid down.

Art. 3º The existing goods and facilities as a function of the transmission service of electric power is linked to the public services granted, vetting the divesture, assignment, transfer or dation in warranty, without prior and express authorization from ANEEL.

Single paragraph. Fining the term of the concession, the goods and facilities linked to the provision of the service granted will revert to the Union, in the manner provided for in law and in the Concession Contract.

Art. 4º This Decree comes into effect on the date of its publication.
