Decree No. 4806, 12 AUGUST 2003.
Promulgates the Protocol relating to an amendment to Article 50 a), of the Convention on International Civil Aviation.
The PRESIDENT of the REPUBLIC, in the use of the role that gives the art. 84, item VIII of the Constitution, and whereas the National Congress approved, by means of legislative decree in 70, of 16 October 1992, the text of the Protocol relating to an amendment to Article 50 a), of the Convention on International Civil Aviation, signed at Montreal, on 26 October 1990;
Whereas the letter of ratification of that Protocol was deposited on 25 February 1993;
Whereas the Protocol entered into force on 28 November 2002;
DECREES: Art. 1st Protocol relating to an amendment to Article 50 a), of the Convention on International Civil Aviation, signed at Montreal, on 26 October 1990, attached a copy to this Decree, shall be executed and delivered as fully as it contains.
Art. 2 Are subject to the approval of the National Congress any acts that may result in a revision of the agreement or which entail charges or demanding commitments to national heritage, pursuant to art. 49, item I, of the Federal Constitution.
Art. 3 this Decree shall enter into force on the date of its publication.

LUIZ INACIO LULA DA SILVA Celso Luiz Nunes Amorim Protocol relating to an amendment to ARTICLE 50 a) of the CONVENTION ON INTERNATIONAL CIVIL AVIATION Organization Assembly of International Civil Aviation, having met in its twenty-Eighth (extraordinary) sessions in Montreal, the October 25 1990;
Having taken note of the general desire of Contracting States to increase the number of members of the Council, in order to ensure a better balance through a more expressive representation of Contracting States;
Having considered opportune to raise from 33 to 36 the number of members of that body;
Having considered it necessary to amend, to this end, the Convention on International Civil Aviation, done at Chicago on 7 December 1944, 1. Adopted, in accordance with the provisions of subparagraph a) of article 94 of the Convention, the following proposed amendment to the said Convention: "That in the paragraph to article 50 of the Convention) If you amend the second sentence, replacing? 33? by? 36?;
2. Fixed in accordance with the provisions of paragraph a) of article 94 of the Convention, in 108 the number of Contracting States, whose ratification is necessary for the entry into force of the said proposed amendment, and 3. Decided that the Secretary-General of the International Civil Aviation Organization draw up a Protocol on languages Spanish, French, English and Russian languages, each of the four also authentic, which will contain the proposed amendment mentioned above, as well as the provisions set out below: a) this Protocol shall be signed by the President of the Assembly and by the Secretary-General.
b) this Protocol shall be open for ratification of all the States which have ratified the Convention of International Civil Aviation or she acceded.
c) the instruments of ratification shall be deposited with the International Civil Aviation Organization.
d) this Protocol shall enter into force, with respect to States that ratify, as at the date on which it is deposited the instrument of ratification 108th.
and communicate) the Secretary-General immediately to all Contracting States of the date of each deposit of the instruments of ratification.
f) the Secretary General shall immediately notify all States parties to the Convention from the date of entry into force of this Protocol.
g) this Protocol shall enter into force, in respect of each Contracting State to the ratification after the date mentioned, from the time when depositing its instrument of ratification with the International Civil Aviation Organization.
As a result, in accordance with the aforementioned decision of the Assembly, this Protocol shall be drawn up by the Secretary General of the organization.
In witness whereof, the President and the Secretary General of the mentioned Twenty-Eighth (extraordinary) session of the Assembly of the International Civil Aviation Organization, duly authorised by the Assembly, sign this Protocol.
Done at Montreal, on 26 October 1990, in a single copy, written in Spanish, French, English and Russian, with each of the four also authentic. This Protocol shall be deposited in the archives of the International Civil Aviation Organization and the Secretary-General of the organisation shall transmit certified copies to all the States parties to the Convention of International Civil Aviation, done at Chicago, on 7 December 1944.
