DECREE NO. 4,806, OF August 12, 2003.

Promults the Relative Protocol to an Amendment to Article 50 a), of the Convention on Civil Aviation International.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso VIII, of the Constitution, and

Whereas the National Congress adopted, by means of the Legislative Decree no 70, of October 16, 1992, the text of the Protocol on an Amendment to Article 50 a), of the Convention on International Civil Aviation, signed in Montreal, on October 26, 1990;

Whereas the Charter of Ratification of the said Protocol was deposited on February 25, 1993;

Considering that the Protocol entered into force on November 28, 2002;

DECRETA:

Art. 1º The Protocol on an Amendment to Article 50 a), of the Convention on International Civil Aviation, signed in Montreal, on October 26, 1990, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º Are subject to approval of the National Congress any acts that may result in revision of the said Agreement or that carries charges or commitments engraved to the national heritage, pursuant to the art. 49, inciso I, of the Federal Constitution.

Art. 3º This Decree comes into force on the date of its publication.

PROTOCOL ON AN AMENDMENT

AO ARTICLE 50 a) OF THE CONVENTION ON INTERNATIONAL CIVIL AVIATION

The Assembly of the International Civil Aviation Organization,

Having gathered in its Twenty-XX_ENCODE_CASE_CAPS_LOCK_On eighth period (Extraordinary) of Sessions, in Montreal, to October 25, 1990;

Having taken note of the general desire of the contracting states to increase the number of Council members, in order to ensure a better balance by intermediate of a more expressive representation of the contracting States;

Having considered it appropriate to raise from 33 to 36 the number of members of that body;

Having considered necessary to amend, to that end, the Convention on International Civil Aviation, made in Chicago, to December 7, 1944,

1. Approved, in accordance with the provisions of paragraph (a) of Article 94 of the said Convention, the following proposal of Amendment to the aforementioned Convention:

" That in paragraph (a) of Article 50 of the Convention shall be amended the second sentence, replacing? thirty-three? by? thirty six?;

2. Fixed, in accordance with the provisions of paragraph (a) of Article 94 of the mentioned Convention, in one hundred and eight the number of the Contracting States, the ratification of which is necessary for the entry into force of the proposed Amendment of Amendment, and

3. It has decided that the Secretary General of the International Civil Aviation Organization will redeem a Protocol in the Spanish, French, English and Russian languages, each of the four equally authentic, which will contain the proposed Emenda above mentioned, thus as the provisions set out below:

a) This Protocol shall be signed by the President of the Assembly and its Secretary-General.

b) This Protocol shall be open to the ratification of all States that have ratified the International Civil Aviation Convention or to it have acceded.

c) Instruments of ratification shall be deposited with the Civil Aviation Organization International.

d) This Protocol shall enter into force, with respect to the States that ratify it, on the date on which it is deposited the hundredth eighth instrument of ratification.

e) O Secretary-General shall immediately communicate to all the Contracting States the date of deposit of each of the instruments of ratification.

f) The Secretary-General shall immediately notify all States Parties to the mentioned Convention of the date of entry into force of this Protocol.

g) This Protocol shall enter into force, with respect to each Contracting State which ratifies it after the date mentioned, from the moment in which to deposit its instrument of ratification with the International Civil Aviation Organization.

In consequence, pursuant to the aforementioned decision of the Assembly, the present Protocol was drawn up by the Secretary-General of the Organization.

In testimony to what, the President and the Secretary General of the aforementioned Twenty-XX_ENCODE_CASE_CAPS_LOCK_On eighth period (extraordinary) Assembly Sessions of the International Civil Aviation Organization, duly authorized by the Assembly, sign the present Protocol.

Made in Montreal, on the twenty-six of October one thousand nine hundred and ninety, in a single copy, drawn up in the Spanish, French, languages, both English and Russian, being each of the four equally authentic. This Protocol shall be deposited in the archives of the International Civil Aviation Organization and the Secretary-General of the Organization shall transmit certified copies of the same to all States Parties to the International Civil Aviation Convention, made in Chicago, on December 7, 1944.
