DECREE NO. 4,473, OF November 18, 2002

Disposes on the execution of the Thirteenth Additional Protocol to the Economic Supplementation Agreement No. 35, among the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile, of September 9, 2002.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by the Federative Republic of Brazil on August 12, 1980 and approved by the National Congress, through the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas, on June 25, 1996, the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile have signed the Agreement Economic Supplementation No. 35, incorporated into the Brazilian legal planning by the Decree paragraph 96 of September 12, 1996;

Whereas the Plenipotentiaries of the Republic Federative of Brazil, the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile, on the basis of the 1980 Treaty of Montevideo, signed on September 9, 2002 in Montevideo, the Trigth Third Additional Protocol to the Agreement on Economic Supplementation No. 35, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile;

D E C R E T A:

Art. 1º The Thirtieth Third Protocol to the Economic Supplementation Agreement No. 35, between the Governments of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay, of the Eastern Republic of Uruguay and the Republic of Chile, apensed by copy to the present Decree, shall be executed and fulfilled as entirely as it contains.

Art. 2º This Decree goes into effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT NO. 35 CONCLUDED BETWEEN THE GOVERNMENTS OF THE STATES PARTIES OF MERCOSUR AND THE GOVERNMENT OF THE REPUBLIC OF CHILE

Thirtieth Third Additional Protocol

The Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and of the Eastern Republic of Uruguay, in its condition of States Parties to the Common Market of the South (MERCOSUR), on the one hand, and of the Republic of Chile, on the other, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely at the General Secretariat of the Latin American Integration Association (ALADI),

HAVING IN VIEW THE MCS-CH Resolution No. 04/2002,

CONVVE IN:

Article 1º-Extend the Agreement Liberalization of Agreement by incorporating the bilaterally paced preferences between the Argentine Republic and the Republic of Chile, in the following terms and conditions:

a) inclusion in Annexes 1 and 5 of ACE 35 of the outward preferences for the products included in Annex I of this Protocol; and

b) modification in Annex 1 of the ACE 35 of the preferences bestoed for the products included in Annex II of this Protocol.

Article 2º-This Protocol will enter into vigour, bilaterally, on the date on which the Argentine Republic and the Republic of Chile have incorporated it into their domestic law, in the terms of their respective legislations.

The Signatary Parties shall communicate to the General Secretariat of the ALADI the fulfillment of the corresponding trames.

The General Secretariat of the Association shall be a depositary of this Protocol, of which it will send copies duly authenticated to the signatory Governments.

IN FÉ DO WHAT, THE RESPECTIVE Plenipotentiaries sign the present Protocol in the city of Montevideo, at the 9 days of the month of September two thousand and two, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
