DECREE NO. 7,023, OF December 7, 2009.

Promulga the Fourteenth Additional Protocol to the Economic Supplementation Agreement No. 35.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, inciso IV, of the Constitution, and

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980 and promulgated by Decree No. 87,054 of March 23, 1982, provides for the modality of Economic Supplementation Agreement;

Considering that the Plenipotentiaries of the Argentine Republic, of the Federative Republic of Brazil, of the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to MERCOSUR, and the Republic of Chile, based on the Treaty of Montevideo of 1980, signed on June 25, 1996 in San Luis, Argentina, the Economic Supplementation Agreement No. 35, promulgated by Decree No. 2,075, of November 19, 1996; and

Whereas the Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to MERCOSUR, and the Republic of Chile, on the basis of the 1980 Treaty of Montevideo, signed, in 7 of October 2009, in Montevideo, the Fourteenth Fifth Protocol to the Economic Supplementation Agreement No. 35, between the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of the Uruguay, States Parties to MERCOSUR, and the Government of the Republic of Chile;

DECRETA:

Art. 1º The Fifteenth Additional Protocol to the Economic Supplementation Agreement No. 35, among the Governments of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to MERCOSUR, and the Government of the Republic of Chile, of October 7, 2009, apensed by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2nd This Decree comes into effect on the date of its publication.

ECONOMIC COMPLEMENTATION AGREEMENT N ° 35

CELEBRATED AMONG THE GOVERNMENTS OF STATES PARTIES

DO MERCOSUR AND THE GOVERNMENT OF THE REPUBLIC OF CHILE

Qüinqutwenty-Fifth Additional Protocol

The Plenipotentiaries of the Argentine Republic, of the Republic Federative of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of States Parties of the Common Market of the South (MERCOSUR), by one party, and of the Republic of Chile, by another, accredited by their respective Governments second powers that were bestowed in good and due form, deposited opportunely in the General Secretariat of the Latin American Integration Association (ALADI).

HAVING IN VISTA the Resolution MCS-CH N ° 2/2009, emanating from the Extraordinary Meeting of the ACE Administrator Commission No. 35,

DECK IN:

Article 1º.-The Eastern Republic of Uruguay will apply the scheme of preferences set out in the Economic Supplementation Agreement No. 35 a all goods drawn up or coming from Zones Francas of any nature, located in the territory of the Republic of Chile.

Article 2º.-The Republic of Chile will apply the scheme of preferences set out in the Economic Supplementation Agreement No. 35 a all goods drawn up or coming from Zones Francas of any nature, located in the territory of the Eastern Republic of Uruguay.

Article 3º.-To enjoy the benefit provided for in Articles 1º and 2º, the goods are to comply with the Origin Regime set out in Annex 13 to the Agreement. In the respective certificate of origin is to appear, in Table 14 "Observations", the phrase: elaborate merchandise or coming from free zone.

Article 4.-The Parties shall review, annually, the trade flows to the amparo of the present standard, in the framework of the Chile-Uruguay Commercial Monitoring Commission, in order to assess its impact on bilateral trade.

Article 5º.-The present Protocol will enter into force 30 days after the date on which the Republic of Chile and the Eastern Republic of the Uruguay have communicated to the General Secretariat of the ALADI that it has been incorporated into its domestic law, pursuant to their respective legislations. The General Secretariat of the ALADI will inform the respective Signatary Parties the date of their entry into force.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send duly authenticated copies to the Signatary Parties.

IN FÉ FROM WHAT, THE RESPECTIVE Plenipotentiaries sign the present Protocol in the city of Montevideo, at the seven days of the month of October of the thousand and nine, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
