DECREE OF September 5, 2002

Declara of social interest, for purposes of agrarian reform, the rural real estate it mentions, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon you the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplementary Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of Law No. 4,504, of November 30, 1964, and 2º of Law No. 8,629, of February 25, 1993, the following rural real estate:

I-"Fazenda Encanto II", with area of a thousand and five hundred and twenty-three hectares, situated in the Municipality of Solonópole, object of the Register # R-2-1.018, fls. 204, Book 2-D, of the Carthorium of the 2º Estate Registration Office of the Comarch of Solonópole, State of Ceará (Process INCRA/SR-02/nº 54130.001155 /2001-04);

II-"Site Umari", with area of a thousand, one hundred and eighteen hectares and sixty ares, situated in the Municipalities of Cascavel and Beberibe, object of Record No R-11-1.320 (remnant), fls. 01, Book 2, of the Carthorium of the 2º Offer of the Comarch of Cascavel, State of Ceará (Process INCRA/SR-02/nº 54130.000873 /2001-55);

III-"Fazenda Katira and Novo Carimbó", with area of a thousand, eight hundred and eighty six hectares, thirty-six airs and eighty-four centiars, situated in the Municipality of Cáceres, object of the Matricles n 13,332, Book 2-K-1, and 14,373, Book 2-J-2, of the Estate Registry Office of the Comarch of Cáceres, State of Mato Grosso (Case INCRA/SR-13/nº 54242.000396 /00-17);

IV-"Engineer Root from Within", with area of five hundred and eighteenth hectares, thirty-two airs and a centiare, situated in the Municipality of Amaraji, object of the Registry # R-1-192, fls. 55, Book 2-BO, from the Estate Registration Office of the Comarch of Amaraji, State of Pernambuco (Process INCRA/SR-03/nº 54140.000615 /2001-50);

V-"Rancho Baraldi", with area of three hundred and thirty hectares, eighty and one airs and forty centiars, situated in the Municipality of Xambrê, object of the Registers n R-3-5.264, fls. 1v, Book 2; R-3-5.265, fls. 1v, Book 2 and R-1-5.957, fls. 1, Book 2, of the Estate Registration Office of the Comarch of Xambrê, State of Paraná (Process INCRA/SR-09/nº 54200.001431 /2001-55);

VI-"Fazenda Almada and Marui", with area of two hundred and eleven hectares, thirty-five airs and sixty-five centiars, situated in the Municipality of Fields of the Goytacazes, object of the Records n R-1-649, fls. 68, Book 2-B and R-1-650, fls. 69, Book 2-B, of the Carthorium of the 3º Oftice of the Comarch of Fields of the Goytacazes, State of Rio de Janeiro (Case INCRA/SR-07/nº 54180.000305 /2002-40);

VII-Fazenda Santo Amaro and Company ", with area of five hundred and eighty-eight hectares and ninety six airs, situated in the Municipality of Fields of the Goytacazes, object of the Enrolment n 395, fls. 140, Book 2-A; 721, fls. 167, Book 2-B; 2,242, fls. 229, Book 2-G and 2,243, fls. 230, Book 2-G, of the Carthorium of the 9º Oftice of the Comarch of Fields of the Goytacazes, State of Rio de Janeiro (Case INCRA/SR-07/nº 54180.001937 /2001-40);

VIII-"Farm Three Bars", with area of two thousand, six hundred and ninety and nine hectares and twenty-three airs, situated in the Municipality of Castilho, object of Matriculation No. 18,641, fls. 01/02, Book 2, from the Estate Registration Office of the Comarch of Andradina, State of São Paulo (Process INCRA/SR-08/nº 54190.001013 /2001-24); and

IX-"Farm Mosque", with area of five hundred and one hectares, ninety and six airs and twelve centiars, situated in the Municipality of Pereira Barreto, object of the Registrations n R-3-8.301, Fiche 01v, Book 2, of the Estate Registration Office of the Comarch of Mirandópolis and R-3-18.339, Ficha 01v, Book 2, of the Estate Registration Office of the Comarch of Pereira Barreto, State of São Paulo (Case INCRA/SR-08/nº 54190.001007 /2001-77).

Art. 2º Excludes from the effects of this Decree the semovents, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the rural real estate dispropriations of which it treats this Decree, in the form provided for in the Act Supplementary No 76 of July 6, 1993 and to maintain the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771 of September 15, 1965 preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree comes into effect on the date of its publication.
