DECREE OF August 11, 2000.

Creates the Marine Extrativist Reserve from the Baia do Iguapé, nos Municipalities of Maragojipe and Cachoeira, State of Bahia, and gives other providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, inciso IV, of the Constitution, and in accordance with the provisions of the art. 9º, inciso VI, of Law No. 6,938 of August 31, 1981, as amended by Law No. 7,804 of July 18, 1989 and in Decree No. 98,897 of January 30, 1990 and taking into view what is stated in the IBAMA Process No. 02006.001279 /97-39,

DECRETA:

Art. 1º It is created the Marine Extrativist Reserve of the Baia do Iguapé, located in the Municipalities of Maragojipe and Cachoeira, State of Bahia, with an approximate area of 8,117 ,53ha (eight thousand, one hundred and seventeen hectares and fifty three centiars), being 2,831 ,24ha (two thousand, eight hundred and thirty-one hectares and twenty-four centiars) on mangrove grounds, and 5,286 ,29ha (five thousand, two hundred and eighty-six hectares and twenty-nine centiars) of Brazilian internal waters, having on the basis of Folha SD-24-X-A-IV, published by the Department of Cartography of the Brazilian Institute of Geography and Statistics, with the following Descriptive Memorial: departing from the Point 1, of approximate geographical coordinates 12º51?40.54? S and 38º51?06.47? Wgr, located on the right bank of the Paraguaçú River, in the vicinity of Vila de Enseada; of this one, follows by a straight of azimut 9º09?39, 76? and a approximate distance of 1,268.17 meters up to Point 2, of approximate geographical coordinates 12º50?59.78? S and 38º50?59.80? Wgr, located on the municipal dividing line between the Municipalities of Maragojipe and Saubara; hence, it follows, by the same municipal dividing line, by an approximate distance of 2,432.07 meters, up to Point 3, of approximate geographical coordinates of 12º50?18.44? S and 38º52?08.61? Wgr, located at the intersection of the municipal dividing lines between the Municipalities of Maragojipe, Saubara and Cachoeira; hence, it follows, by the dividing line, between the Municipalities of Saubara and Cachoeira, by an approximate distance of 2,027.79 meters, up to the Point 4, of approximate geographical coordinates 12º49?20.19? S and 38º51?36.97? Wgr, located on the dividing line between the Municipalities of Saubara and Cachoeira; hence, it follows, accompanying the boundary of the mangrove land zone, by the left bank of the river Paraguaçú, in the upstream sense, by a approximate distance of 1,061.69 metres, passing through the mouth of the river Inhauma, up to the mouth of the Inhanga river; hence, it follows, accompanying the boundary of the land zone of the mangrove, in the sense amount of the river Paraguaçú, by an approximate distance of 6,793.61 meters, up to the mouth of the German River; hence, continues, marching the Baia do Iguape, accompanying the boundary of the mangrove land zone, in the sense amount of the river Paraguaçú, passing through the San Francisco District of Paraguaçú, by an approximate distance of 9,403.14 meters, up to the disembowelment of the River Catú; hence, follows, always accompanying the boundary of the mangrove land zone, marching the Baia of the Igaupe, by an approximate distance of 2,239.96 meters, up to the mouth of the river of the Furado; hence, it follows by the edge of the Baia do Iguape, accompanying the boundary of the land zone of the mangrove, by an approximate distance of 7,800.52 meters, passing through the Santiago de Iguape District, up to the mouth of the river of the Sand; hence, follows by accompanying boundary of the mangrove land zone, by an approximate distance of 6,025.43 metres, up to the mouth of the Dendê river; hence, it follows, marching, the Baia do Iguape, accompanying the boundary of the mangrove land zone, by an approximate distance of 593.97 metres, up to the disembowelment of the river from the Bridge; hence, follows, accompanying the boundary of the zone ground of the mangrove, by an approximate distance of 5,244.81 meters, up to the mouth of the Calemba River; hence, follow, by accompanying the boundary of the mangrove land zone, by an approximate distance of 2.285.39 meters, up to the disembowelment of the river Catolé; hence, follows, accompanying the boundary of the mangrove land zone, by an approximate distance of 25,370.93 meters, up to the mouth of the Pinto river, thus circumvating the bottom of the northern calha of the Baia do Iguape; hence, it follows, marching the Baia do Iguape, accompanying the limit of the land zone of the mangrove, by an approximate distance of 3,834.47 metres, to the Ponta of the Ponta Engineer, penetrating again in the calha of the Paraguaçú River on its left margin; it follows by this left margin, in the sense amount, accompanying the limit of the mangrove land zone, by approximate distance of 5,446.77 meters, up to Point 5, of approximate geographical coordinates 12º41?48.12? S and 38º56?32.15? Wgr., located on the left bank of the Paraguaçú River; of this one, follows by a reta of azimut 245º26?20.69? and a approximate distance of 238.17 meters, crossing the Paraguaçu River, up to Point 6, of approximate geographical coordinates 12º41?51.34? S and 38º56?39.33? Wgr, located on the intersection of the municipal dividing lines between the Municipalities of São Felix, Cachoeira and Maragojipe; hence, it follows, by the right bank of the river Paraguáu, in the downstream sense, by a approximate distance of 5,099.74 meters, bypassing the boundary of the land zone of the existing mangrove in the pathway, passing through the mouth of the river Sinunga, and by the District of Cookers, up to the mouth of the river Nagé; hence it follows, in the downstream sense, still on the right bank of the Paraguaçú River, accompanying the boundary of the mangrove land zone, passing through the Nagé District, by an approximate distance of 4,466.28 meters, up to the mouth of the river of the Caboclas, reaching again the shore of the Baia do Iguape; hence, it follows, penetrating the cala of the Guaí River, by its left margin, in the sense amount, by an approximate distance of 11,612.06 meters, accompanying boundary of the land zone of the existing mangrove in the pathway, passing through the seat of the Municipality of Maragojipe, up to the mouth of the Ribeira river; hence, follows, by the the left bank of the river Guaí, in the sense amount, accompanying the boundary of the mangrove land zone, by an approximate distance of 5,712.11 metres, up to the mouth of the river Cachoeirinha; hence, it follows, accompanied by the boundary of the mangrove land zone, in the sense amount of the river Guaí, by a distance of 16,219.21 meters, up to the mouth of the river Taquandiba, thus bypassing all the existing mangroves on the Gauí river's soak; hence, it follows, by the right bank of the river Guaí, in the downstream sense, circumvented always the boundary of the land zone of the existing mangrove in the pathway, by an approximate distance of 5,356.90 metres, up to the mouth of the Tororó river; hence it follows, in the downstream sense, returning again to the river Paraguaçú, on its right margin, by following the boundary of the land zone of the mangrove, by an approximate distance of 4,166.39 meters, up to the mouth of the river of the Ship; hence, it continues, following by the right bank of the river Paraguaçú, in the downstream sense, accompanying the boundary of the mangrove land zone, by a distance approximate 8,545.65 metres, up to the mouth of the Cerqueira river; hence, it follows, by the right bank of the river Paraguaçú, in the sense amount, accompanying the boundary of the mangrove land zone, passing through the District of São Roque of Paraguaçu, by a distance approximate 5,309.68 meters, up to the Ponta of the Owl; hence, it follows, penetrating through the calha of the Batatan River in its left margin, in the upstream sense, accompanying the boundary of the mangrove land zone, by an approximate distance of 12,353.71 meters, up to the mouth of the river of the Paus; hence, it follows, by the left bank of the Batatã river, in the upstream sense, always accompanying the boundary of the land zone of the existing mangrove in the pathway, thus circumvating all existing mangroves in the Batatã river's gutter, and by following by its right margin, in the downstream sense, finding again the right bank of the Paraguaçú river; follows, by this margin, in the downstream sense, accompanying the boundary of the mangrove land zone, passing through the Enseada District, percurring a approximate distance of 17,355.42 meters, until you find the Point 1, initial of this descriptive.

Art. 2º The Marine Extrativist Reserve of the Baia do Iguape is aimed at ensuring self-sustaining exploitation and conservation of renewable natural resources traditionally used by the extractivist population of the area.

Art. 3º The area of Extrativist reserve, ora created, becomes declared of ecological and social interest, as it advocates for art. 2º of Decree No. 98,897, of January 30, 1990.

Art. 4º Caberá to the Institute Brazilian Environment and Renewable Natural Resources-IBAMA overseeing the area of which it treats this Decree, promote the necessary measures to formalize the actual concession contract of free use with the traditional population extrativist, for the purpose of its celebration by the Ministry of Planning, Budget and Management, pursuant to Decree No. 3,125 of July 29, 1999, and monitors compliance with the conditions therein.

Art. 5º This Decree goes into effect on the date of its publication.
