DECREE OF December 23, 2011

Declara of social interest, for purposes of agrarian reform, the rural real estate named "Guiomar Farm", situated in the Municipality of Iati, State of Pernambuco, and gives other arrangements.

THE PRESIDING OF THE REPUBLIC, in the use of the assignments that confer upon you the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplementary Act No. 76, of July 6, 1993, 18 and 20 of Law No. 4,504 of November 30, 1964, and 2º of Law No. 8,629 of February 25, 1993,

D E C R E T A:

Art. 1º It is declared of social interest, for purposes of agrarian reform, the rural real estate named "Guiomar Farm", with registered area of three hundred and two hectares and fifty ares, and measured area of five hundred and fifty-eight hectares, twenty-one ares and seventy two centiars, situated in the Municipality of Iati, object of the Registry # R-1-3.668, fls. 11, Book 2-AD, of the Carthorium of the Single Offer of the Comarch of Fine Water, State of Pernambuco (Process INCRA/SR-03/nº 54140.002948 /2009-71).

Art. 2º This Decree, regardless of discrimination or fundraising, does not hear any particular compensation effects, in respect of areas of public domain consisting of law or registration and the private domain areas harvested by nullity, prescription, comb or ineffectiveness operated solely for the benefit of any legal person of public law, excepted good-faith benefactions existing in them previously to the science of the beginning of the administrative procedure, excluding still from its effects the soothing, the machinery and the agricultural implements and any benfeitory introduced by anyone who comes to benefit from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA, attested to the private dominial legitimacy of the mentioned planimetry area, is allowed to promote the disappropriation of the rural real estate from which it treats this Decree, in the manner provided for in the Act Supplementary No 76, of July 6, 1993, and to maintain the areas of Legal Reserve and permanent preservation provided for in Law No. 4,771, de15 September 1965, preferably in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree comes into effect on the date of its publication.
