DECREE NO. 8,619, OF December 29, 2015

Dislays on supplemental financial support for maintenance and to the development of child education for the care in children's crèches of zero to forty-eight months enrolled in the Basic Education School Census whose families are beneficiaries of the Bolsa Familia Program.

The CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, and with a view to the provisions of the art. 4º, caput and § 3º, of Law No. 12,722, of October 3, 2012,

DECRETA:

Art. 1º Fwill jus to the supplementary financial support of which it treats art. 4º of Law No. 12,722 of October 3, 2012, the Federal District and the Municipalities that:

I- have expanded the number of enrolment in children's crèches from zero to forty-eight months enrolled in the Basic Education School Census whose families are beneficiaries of the Bolsa Familia Program; or

II-have broadened the coverage of children from the Bolsa Família Program in crèches, calculated as the total of children's enrollment from zero to forty-eight months whose families are beneficiaries of the Bolsa Familia Program on the number of children from zero to forty-eight months whose families are beneficiaries of the Bolsa Família Program.

Paragraph single. The broadening of the number of enrolment or the coverage to which they refer to the incisions I and II of the caput will be awound from the comparison of the number of enrolment and the coverage of the editions of the Basic Education School Census of the two years prior to the of the exercise in which you will give the transfer of the supplementary financial support of which it treats the caput.

Art. 2º The supplementary financial support of which it treats art. 1º shall be based on the minimum annual value per pupil defined nationally for child education under the terms of Law No. 11,494 of June 20, 2007 and shall correspond to:

I-up to twenty five percent of this value by child matriculation whose family is a beneficiary of the Exchange Program Family, should the Federal District or the Municipality have failed to meet the annual target set in the form of the art. 3º; and

II-up to fifty per cent of this value per child's tuition whose family is beneficiary of the Bolsa Familia Program, should the Federal District or the Municipality have met the annual target set in the form of the art. 3º.

Single paragraph. In the hypothesis of the Federal District or the Municipality having balance in account of the previous financial year's resources for the supplementary financial support of which it treats art. 4º of Law No. 12,722, of 2012, that amount, to be verified after the course of one year of the last repass, will be subtracted from the value of the supplementary financial support to be transferred to the new financial year.

Art. 3º The meta to which refer to the incisos I and II of the art's caput . 2º will be expressed by the number of children from zero to forty-eight months, whose families are beneficiaries of the Bolsa Familia Program, that the Federal District or the Municipality must enrol each year in child education, in nurseries, so as to reach, by the year 2024, at least fifty per cent of care in nurseries to children whose families are beneficiaries of the Bolsa Familia Program, as set out in a joint act of the State Ministers of Social Development and Combat to Famine and Education.

Art. 4º Exceptionally, in 2015 and 2016, will jus ao supplementary financial support of up to fifty per cent of the minimum annual value per pupil defined nationally for child education, pursuant to Law No. 11,494, 2007, by matriculation, the Federal District and the Municipalities that:

I-have widened the number of enrolment in children's crèches from zero to forty-eight months enrolled in the School Census of Basic Education whose families are beneficiaries of the Bolsa Familia Program; or

II-have coverage of children from the Bolsa Família Program in crèches equal to or greater than thirty-five per cent to data from the edition of the School of Basic Education Census of the Year previous to the exercise in which the transfer of supplementary financial support will be given.

§ 1º A extension of the number of enrolment to which the inciso I of the caput is concerned will be affixed to the terms of the single paragraph of the art. 1º.

§ 2º The coverage to which refers to the inciso II of the caput will be calculated from the total child enrolment from zero to forty-eight months whose families are beneficiaries of the Bolsa Familia Program in relation to the number of children from zero to forty-eight months whose families are beneficiaries of the Exchange Program Family.

Art. 5º Applies the willing in the single paragraph of the art. 2º to the repasses that it treats art. 4º.

Art. 6º The supplementary financial support will meet the child education offered in district and municipal public educational establishments or in community, confessional, or philanthropic not-for-profit institutions conveniently located with district or municipal public power, in part time or integral, as per data of the Basic Education Census for Basic Education.

Art. 7º The resources transferred pursuant to this Decree may be applied in the expenses for maintenance and development of child education, under art. 70 of Law No. 9,394 of December 20, 1996, excepted those listed in the incisos IV, VI and VII of its caput, and in the actions to ensure full care and food and nutritional security, necessary for access and permanence of the child in child education, in the form defined in the joint act of the State Ministers of Social Development and Combat to Hunger and Education.

Art. 8º Joint of the State Ministers of Social Development and Combating Hunger and Education will have on the monitoring of the implementation of financial support supplementary that it treats this Decree.

Art. 9º The financial resources corresponding to the financial support of which it treats this Decree will run to the allocation account achieved in the budgets of the National Education Development Fund-FNDE and the Ministry of Social Development and Combat to the Hunger, observed the limits of movement, commitment and payment of annual budget and financial programming.

Art. 10. This Decree takes effect on the date of its publication.
