DECREE NO. 6,272, OF November 23, 2007.

Disposes on the competencies, composition and functioning of the National Food and Nutritional Safety Council- CONSEA.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives him art. 84, incisments IV and VI, paragraph (a?) of the Constitution, and with a view to the provisions of the Act No 11,346 of September 15, 2006,

DECRETA:

CHAPTER I

OF THE NATURE AND COMPETENCY

Art. 1st The National Food and Nutritional Security Council-CONSEA, the immediate advising body to the President of the Republic, integrates the National System of Food and Nutritional Security-SISAN.

Art. 2nd Compete to the CONSEA:

I-convene the National Food and Nutritional Safety Conference, with periodicity no greater than four years;

II-define the parameters of composition, organization, and operation of the Conference;

III-propose to the Interministerial Chamber of Food Safety and Nutritional, from the deliberations of the National Nutritional Food Safety Conference, the guidelines and priorities of the Policy and National Food and Nutritional Safety Plan, including the budget requirements for its achievement;

IV-articulate, follow up and monitor, in regime of collaboration with the rest members of the SISAN, the implementation and convergence of the actions inherent in the Policy and the National Food and Nutritional Safety Plan;

V-define, in collaboration arrangements with the Interministerial Chamber of Food and Nutritional Security, the criteria and procedures of joining SISAN;

VI-institute permanent mechanisms of articulation with organs and congennery entities of safety food and nutritional in the states, the Federal District and the Municipalities, with the purpose of promoting the dialogue and convergence of the actions that integrate SISAN;

VII-mobilize and support civil society entities in the discussion and implementation of the National Food and Nutritional Security Policy;

VIII-stimulate the magnification and enhancement of mechanisms of participation and social control in the actions members of the Policy and the National Food and Nutritional Safety Plan;

IX- to ensure the realization of the human right to adequate food and its effectivity;

X- maintain permanent articulation with other national councils concerning the actions associated with the Policy and the National Food and Nutritional Safety Plan;

XI-maintain articulation with similar foreign institutions and international bodies; and

XII-elaborated and approve your internal regiment.

§ 1st The CONSEA will stimulate the creation of state and municipal councils of food and nutritional safety.

§ 2nd assignment provided for in the inciso VI will be performed by committee, composed of the presidents of the state boards of food and nutritional security, to be instituted within the framework of the CONSEA.

§ 3rd The CONSEA will maintain permanent dialogue with the Interministerial Chamber of Food and Nutritional Security, for proposition of the Policy and Plan Guidelines and priorities National Food and Nutritional Security, inclusive as to the budget requirements for their achievement.

CHAPTER II

DA COMPOSITION

Art. 3rd The CONSEA will be composed by fifty-seven members, holders and alternates, of which two-thirds of civil society representatives and one-third of government representatives, as disposed of in art. 11 of the Law no 11,346, of September 15, 2006.

§ 1st Government representation in the CONSEA will be exercised by the following members holders:

I-the Ministers of State:

a) of the Civil House of the Presidency of the Republic;

b) of Social Development and Combat to Hunger;

c) of Agriculture, Livestock, and Supply;

d) of the Cities;

e) of the Agrarian Development;

f) of Education;

g) of the Farm;

h) of the Environment;

i) of Planning, Budget, and Management;

j) of Health;

l) of the Work and Employment;

m) of National Integration;

n) of Science and Technology;

the) of Foreign Relations; and

p) of the General Secretariat of the Presidency of the Republic;

II-the Special Secretaries:

a) of the Special Office of Acquiculture and Fisheries of the Presidency of the Republic;

b) of the Special Policies Office for the Women of the Presidency of the Republic;

c) of the Special Secretary for Human Rights of the Presidency of the Republic; and

d) from the Special Secretariat of Racial Equality Promotion Policies of the Presidency of the Republic.

§ 2nd civil society representatives will be chosen as criteria for referral established by the National Food and Nutritional Security Conference.

§ 3rd Powerful compose the CONSEA, in the quality of observers, representatives of federal related boards, of international bodies and of the Public Prosecutor's Office, indicated by the holders of the respective institutions, upon invitation formulated by the President of the CONSEA.

Art. 4th The representatives of civil society, holders and alternates, as well as the alternates of the governmental representation, shall be designated by the President of the Republic.

Para. single. Representatives of civil society will be given two-year term, allowed for redriving.

Art. 5th The CONSEA, in advance of the termination of the mandate of the advisors representatives of civil society, will constitute commission, made up of nine members, of which six will be representatives of civil society, included the President of the Council, and three will be representatives of the Government, included the Secretary-General, for the purposes set out in § 1st.

§ First it's up to the committee to draw up list with proposal for representation of civil society that will behave the CONSEA, to be submitted to the President of the Republic, observed the criteria for representation deliberated by the National Food and Nutritional Safety Conference.

§ 2nd The commission will be due forty-five days, after the achievement of the National Food and Nutritional Safety Conference or the termination of the tenure of the advisers, to present proposal for representation of civil society in the CONSEA to the President of the Republic;

Art. 6th The CONSEA has the following organization:

I-Plenary;

II- Secretariat-Geral;

III-Secretariat-Executive;

IV-Tematic Commissions.

Section I

Da Presidency and the General Secretariat

Art. 7th The CONSEA will be chaired by a representative of civil society, indicated by the Council, among its members, and designated by the President of the Republic.

Paragraph single. Within thirty days, after the designation of the advisors, the Secretary-General shall convene meeting, during which the new President of the CONSEA shall be appointed.

Art. 8th To the President incumbent:

I-ensure the fulfillment of the deliberations of the CONSEA;

II-externally represent the CONSEA;

III-convene, preside, and coordinate the meetings of the CONSEA;

IV-maintain permanent interlocution with the Interministerial Chamber of Food and Nutritional Safety;

V-convening extraordinary meetings, together with the Secretary-General; and

VI-propose and install thematic commissions and working groups, designating the coordinator and the remaining members, well as setting deadline for presentation of results, as deliberated by the CONSEA.

Art. 9th Compete to the General Secretariat advising the CONSEA.

Paragraph single. The Minister of State for Social Development and Combating Hunger will be the Secretary General of the CONSEA.

Art. 10. The Secretary General is incumbent on:

I-submit to the analysis of the Interministerial Chamber of Food and Nutritional Safety the proposals of the CONSEA of guidelines and priorities of the National Food and Nutritional Security and Nutritional Plan, including-if the budget requirements for their achievement;

II-keep the CONSEA informed about the appreciation, by the Interministerial chamber of Food and Nutritional Security, of the proposals forwarded by that Council;

III-follow up with the analysis and the forwarding of the proposals and recommendations approved by the CONSEA in the responsible instances, presenting report to the Council;

IV-promoting integration between the Politics and the National Food and Nutritional Security Plan and the remaining social policies of the Federal Government;

V-instituting interministerial working groups to study and propose related integrated government actions to the Policy and the National Food and Nutritional Safety Plan;

VI-replace the President in his impediments;

VII-presiding of the Interministerial Chamber of Security Food and Nutritional.

Section II

From the Executive Secretariat

Art. 11. For the fulfillment of its functions, the CONSEA will count, in its organizational structure, with a Secretariat-Executive, which will give technical and administrative support to its functioning.

Paragraph single. The budget and financial resources necessary for the structuring and operation of the Executive Secretariat will be directly consigned to the budget of the Presidency of the Republic.

Art. 12. It is incumbent on the Executive Secretariat:

I-assist the President and the Secretary-General of the CONSEA, within the framework of their assignments;

II-establish permanent communication with the boards state and municipal food and nutritional safety, while keeping them informed and oriented about the activities and proposals of the CONSEA;

III-advise and assist the President of the CONSEA in their relationship with the Interministerial Chamber of Food and Nutritional Security, bodies of the public administration, civil society organizations and international bodies; and

IV-subsidize the committees themed, working groups and advisors with information and studies, aiming to aid the formulation and analysis of the proposals appreciated by the CONSEA.

Art. 13. It is incumbent upon the Executive Secretary of the CONSEA to direct, coordinate and guide the planning, execution and evaluation of the activities of the Executive Secretariat, without prejudice to other assignments entrusted to them by the President and the Secretary-General of the Council.

Art. 14. For the performance of its assignments, the Executive Secretariat will contest with specific structure, pursuant to the terms set out in decree, which will have on the quantitative of positions in committee and trust functions for that purpose.

CHAPTER III

OF THE HEALTH

Art. 15. They will be able to attend the meetings of the CONSEA, the chairman of the committee of which he treats the § 2nd of the art. 2nd, and, at the invitation of its President, representatives of other public, national and international bodies or entities, as well as persons representing civil society, whose participation, in accordance with the agenda of the meeting, is justifiable.

Art. 16. The CONSEA will contest with thematic commissions of permanent character, which will prepare the proposals to be by him appreciated, and working groups, of temporary character, to study and propose specific measures in their scope of acting.

Art. 17. The personnel requisitions to have exercise in the Executive Secretariat of the CONSEA will be made through the Civil House of the Presidency of the Republic.

Art. 18. The role performance in the Executive Secretariat of the CONSEA constitutes, for the military, activity of a military nature and relevant service and, for civilian personnel, relevant service and merity-level title, for all the effects of functional life.

Art. 19. They shall be repealed the Decrees in the 5,079, of May 12, 2004, 5,303, of December 10, 2004, and 6,245, of October 22, 2007.

Art. 20. This Decree comes into effect on the date of its publication.
