DECREE OF December 2, 2013

Declarations of public utility, for the purposes of dispropriation, in favor of the concessionary Autopista Sul S.A., the estate it mentions, located in the Municipality of São José, State of Santa Catarina.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points ("h" and "i", and art. 6º of the Decree-Law No. 3,365 of June 21, 1941 in the art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and what appear in the ANTT Process No. 50500.116606 / 2012-45,

D E C R E T A:

Art. 1º It shall be declared of public utility, for the purposes of dispropriation, in whole or in part, in favour of the Autopista Coastal Sul S.A., the immovable bounded by the topographical coordinates described below, excluded the public domain goods, situated on the banks of the Governor-Governor Mário Covas, BR-101/SC, located in the Municipality of São José, State of Santa Catarina, necessary to the complementation of the execution of the pedestrian walkway implantation works at km 205 + 100m:

I-area 1-starts the perimeter at the P7 point of Plants Plants in the U.T.M. System. -SIRGAS 2000 E: 735,427 ,59m and N: 6,946,664 ,20m; of this, follows with AZPlano= 343 ° 10 '32 "and distance of 33.44 meters, arrives at point P8, E: 735,437 ,25m and N: 6,946,696 ,22m; of this, follows with AZPlano= 142 ° 39' 58" and distance of 3.28 meters, arrives at the point P9, E: 735,439 ,22m and N: 6,946,693 ,64m; of this, follows with AZPlano= 227 ° 46 ' 53 "and distance of 1.69 meters, reaches point P10, E: 735,437 ,96m and N: 6,946,692 ,50m; of this, follows with AZPlano= 209 ° 31'57" and distance of 1.69 metres, reaches the point P11, E: 735,437 ,13m and N: 6,946,691 ,03m; of this, follows with AZPlano= 200 ° 24 '28 "and distance of 12.65 meters, arrives at point P12, E: 735,432 ,71m and N: 6,946,679 ,17m; of this, follows with AZPlano= 197 ° 06' 29" and distance of 14.64 meters, reaches the point P13, E: 735,428 ,41m and N: 6,946,665 ,17m; of this, follows with AZPlano= 220 ° 01'35 " and distance of 1.27 meters, arrives at point P7, E: 735,427 ,59m and N: 6,946,664 ,20m; closing, thus the perimeter with 68 ,62m and the area with 28 ,56m².

Art. 2º It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the area of land and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and fulfilment of the obligations attached to the environmental and other public administration bodies, necessary to the effectivation of the works and activities referred to in art. 1º.

Art. 4º This Decree takes effect on the date of its publication.
