DECREE NO. 5,292 OF 1º OF DECEMBER 2004

Disposes on the execution of the Thirteenth-Ninth Rectification Act to the Complementation Agreement Economic No. 35, between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile, of August 23, 2004.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution, and

Whereas the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed up by Brazil on August 12, 1980, and approved by the National Congress, by means of the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Economic Supplementation Agreement;

Whereas, on June 25, 1996, the Governments of the Republic Federative of Brazil, the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile signed the Economic Supplementation Agreement No. 35, incorporated into the Brazilian legal planning by the Decree No. 2,075, of November 19, 1996;

Considering that the ALADI General Secretariat washed on August 23, 2004, in Montevideo, the Rectification Act of the Thirtieth Ninth Protocol to the Economic Supplementation Agreement in the 35;

DECRETA:

Art. 1º The Rectification Act of the Thirtieth Ninth Protocol to the Economic Supplementation Agreement No. 35, among the Governments of the Federative Republic of Brazil, of the Argentine Republic, the Republic of Paraguay, the Eastern Republic of Uruguay and the Republic of Chile, append by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree comes into effect on the date of its publication.

ATA REACTION OF THE THIRTIETH NINTH PROTOCOL
ADDITIONAL TO THE
ECONOMIC N ° 35 SUPPLEMENTATION AGREEMENT

In the city of Montevideo, at the 23 days of the month of August of the thousand and four, the General Secretariat of the Latin American Integration Association (ALADI), in use of the colleges that gives it to Resolution 30 of the Committee of Representatives, as a depositary of the Agreements and Protocols signed by the Governments of the ALADI member countries, and in accordance with the one established in its Article Third, makes the record:

First.-That the Permanent Representation of the Chile to the ALADI, upon Notes No 33/04, of April 29, 2004, and No 63/04, of August 5, 2004, communicated to the General Secretariat formal observations in the Spanish language version of the Thirteenth Additional Protocol to the Complementation Agreement Economic No 35, signed on March 8, 2004 by the Argentine Republic, by the Federative Republic of Brazil, by the Republic of Paraguay, by the Eastern Republic of Uruguay, States Parties to MERCOSUR, and by the Republic of Chile.

Second.-That the observations made by the Permanent Representation of Chile to the ALADI in the Spanish language version of the Thirtieth Ninth Protocol Additional to the Economic Supplementation Agreement No 35 were as follows:

a) In the title, where one reads "carreteras", it should read "carretera".

b) In the Article 2nd lack a final point in the first inciso. That is, after the text "Eastern Republic del Uruguay".

c) No Article 3rd, letter c), where one reads "Findencia", should read "Findencias".

d) In the inciso third of Article 7th, it would be convenient where one reads "Asociación" read "ALADI".

Third.-That the General Secretariat has found the errors noted in the letters a), (b), (c) and (d), in the Spanish version and letters b), c) and d), in the Portuguese version, being the error indicated in the letter a) only attributable to the Spanish language version, as the Portuguese language version correctly records the observation carried out at that point.

Room.-That the errors were communicated to the Argentine Representation to the MERCOSUR and to the ALADI, to the Permanent Delegation of Brazil to the ALADI and to MERCOSUR, to the Permanent Representation of Paraguay to the ALADI and to the MERCOSUR, to the Permanent Representation of Uruguay to the ALADI and to the MERCOSUR and to the Permanent Representation of Chile to the ALADI, by Note ALADI/SGA-COM 196/04, dated August 10, 2004, being heard a time limit of ten calendar days, numbered from its notification to make observations, won which this General Secretariat would wash the Rectification Act, as long as there are no objections.

Quinto.-Which transcend the deadline heard and no objections by part of the signatory countries of the Economic Supplementation Agreement No 35, this General Secretariat carries out the following amendments to the Thirtieth Ninth Additional Protocol to the Economic Supplementation Agreement No. 35, signed on March 8, 2004:

-in the title, where one reads "carreteras", read "carretera", in the Spanish language version;

-in Article 2º, after the text "Eastern Republic del Uruguay" must include a final point in the first inciso, in the versions in the Portuguese and Spanish languages;

-in Article 3º, letter c), where one reads "Findencia", read "Findencias", in the versions in the Portuguese and Spanish languages; and

- in Article 7º, inciso 3rd, where you read "Asociación", read "ALADI", in the versions in the Portuguese and Spanish languages.

And, for the record, this General Secretariat lavishments the present Rectification Act in place and date indicated, in an original in the Portuguese and Spanish languages, being both texts being equally valid.
