DECREE OF June 5, 2008.

Creates the Xingu River Extractivist Reserve, in the Municipality of Altamira, State of Pará, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives him the art. 84, inciso IV, of the Constitution, with a view to the provisions of the art. 18 of the Law no 9,985, of July 18, 2000, and in the Decree no 4,340 of August 22, 2002, and what appears in the Process at 02001.006394 /2004-67,

DECRETA:

Art. It's created the Extractivist reserve Rio Xingu, in the Municipality of Altamira, State of the Pará, with an approximate area of three hundred and three thousand, eight hundred and forty-one hectares and four airs of terrestrial areas, having based the Sheets MI-723, MI-792, MI-793, MI-862, MI-865, MI-866, MI-942 and MI-943, of scale 1:100.000, edited by the Brazilian Institute of Geography and Statistics-IBGE, with the following descriptive memorial: departing from Point 1, of approximate geographical coordinates 04º22 '05 " S and 52º44' 00" Wgr.; of this, follows upstream by the left margin of the Igarapé Baliza to the confluence with an igarapé without denomination, by approximate distance of 12,823.97 metres, up to Point 2, of approximate geographical coordinates 04 ° 24 '54 " S and 52 ° 49' 50" Wgr.; of this, follows by a straight line of azimut 193 ° 58 '09 "and distance from 17,800.44 meters to Point 3, of approximate geographical coordinates 04 ° 34' 16" S and 52 ° 52 '11" Wgr., situated in the Igarapé Floresta; of this, follows by a straight line of azimut 203 ° 58' 26 " and distance from 10,640.99 metres up to Point 4, of approximate geographical coordinates 04 ° 39 '32 "S and 52 ° 54' 32" Wgr., situated in the Igarapé do Estragado; of this, follows in a straight line of azimut 204 ° 38 ' 06 " and distance from 12,278.56 meters to Point 5, of approximate geographical coordinates 04 ° 45 '35 "S and 52 ° 57' 19" Wgr., situated in an affluent without denomination of the left margin of the Igarapé Piracuí; of this, follows in a straight line of azimut 197 ° 39 ' 56" and distance from 7,789.31 meters to Point 6, from approximate geographical coordinates 04 ° 49 '35 "S and 52 ° 58' 36" Wgr., situated in an igarapé without denomination, affluent of the right margin of the Igarapé Piracuí; of this, follows in a straight line of azimut 214 ° 25 ' 28 " and distance from 15,555.12 meters to Point 7, of approximate geographical coordinates 04 ° 56 '33 "S and 53 ° 03' 23" Wgr., situated in an igarapé without denomination; of this, follows in a straight line of azimut 190 ° 42 '22" and distance from 10,452.95 meters up to Point 8, of approximate geographical coordinates 05 ° 02' 07 " S and 53 ° 04 '27" Wgr., situated in the Igarapé Fort Venice; of this, follows in a straight line of azimut 171 ° 48' 15 "and distance of 20,352.88 metres up to Point 9, of approximate geographical coordinates 05 ° 13 '03" S and 53 ° 02' 55" Wgr., situated in the Igarapé Humaitá; of this, follows in a straight line of azimut 176 ° 14 '05 "and distance of 14,250.76 metres up to Point 10, of approximate geographical coordinates 05 ° 20' 46" S and 53 ° 02 ' 26" Wgr., situated at the confluence of an igarapé without denomination with the Igarapé of the Cipo; of this, follows in straight line of azimute 158 ° 47 '45 "and distance from 15,899.43 meters to Point 11, of approximate geographical coordinates 05 ° 28' 49" S and 52 ° 59 '21" Wgr., situated on the left bank of the Pardo River; of this, follows in a straight line of azimut 132 ° 37' 30 " and distance of 3,486.42 metres up to Point 12, of approximate geographical coordinates 05 ° 30 '06 "S and 52 ° 57' 58" Wgr., situated in an igarapé without denomination, affluent of the right bank of the Pardo River; of this, follows in a straight line of azimut 118 ° 38 ' 42" and distance from 10,181.88 meters to Point 13, of approximate geographical coordinates 05 ° 32 '46 "S and 52 ° 53' 08" Wgr., situated at the bedside of an igarapé without denomination; of this, follows in a straight line of azimut 143 ° 50 ' 30" and distance of 6,451.65 meters to the Point 14, of approximate geographical coordinates 05 ° 35 '36 "S and 52 ° 51'05" Wgr., situated in the Igarapé Caxinduba; of this, follows in a straight line of azimuth 165 ° 34' 34" and distance of 9,558.28 meters up to Point 15, of approximate geographical coordinates 05 ° 40 '37 "S and 52 ° 49' 49" Wgr., situated in the Igarapé do Coqueiro; of this, follows downstream by the said igarapé by a distance of 15,785.32 meters to its mouth in the Xingu River at Point 16, of approximate geographical coordinates 05o36 '54" S and 52o42' 32 " Wgr.; of this follows in straight line of azimut 62 ° 46 '16 "and distance of 2,583.34 meters situated on the right bank of the Xingu River, at Point 17, of approximate geographical coordinates 05o36' 16" S and 52o41'18" Wgr.; of this follows by the right bank of the Xingu River by a distance of 183,539.14 meters up to Point 18, of approximate geographical coordinates 04o20 '46 "S and 52o41'27" Wgr; of this follows in a straight line of azimut 242 ° 45' 10" and distance of 5,320.77 meters to the Point 1, start of this descriptive memorial, totaling an approximate perimeter of three hundred and seventy four thousand, seven hundred and fifty and one meters and twenty-two centimeters.

Art. 2nd The Xingu River Extractive Reserve aims to protect the means of life and culture of the extractivist population residing in the area of its comprehensiveness and ensure the sustainable use of the natural resources of the unit.

Art. 3rd Caberá to the Institute Chico Mendes of Conservation of Biodiversity-Chico Mendes Institute to administer the Xingu River Extractivist Reserve, adopting the necessary measures for its deployment and control, in the terms of the art. 18 of the Law no 9,985 of July 18, 2000, providing, in the case of Union lands, the contract for granting real-resolvable property right with the traditional extractivist population, for the purpose of its celebration by the Registry of the Heritage Site of the Union of the Ministry of Planning, Budget and Management, and follow up on compliance with the conditions stipulated therein, in the form of the law.

Art. 4th Ficam declared of social interest, for the purposes of misappropriation, in the form of the Law no 4,132, of September 10, 1962, the rural real estate of legitimate domain private and their benefits that come to be identified in the Xingu River Extrativist Reserve.

§ 1st The Chico Mendes Institute becomes authorized to promote and execute the dispropriations of which it treats this article, and may, for the purpose of immission of possession, claim the urgency to which refers to art. 15 of the Decree-Law no 3,365, of June 21, 1941.

§ 2nd The areas that come to be identified as domain of the State of Pará will only be able to be misappropriated after due legislative authorization.

§ 3rd The Federal Attorney General, the organ of the Advocate-General of the Union, through its legal unit of execution together with the Chico Mendes Institute, is authorized to promote the relevant administrative and judicial measures, targeting the declaration of nullity of possible property titles and their respective real estate records considered irregular, incidents in the conservation unit ora created.

Art. 5th This Decree goes into effect on the date of its publication.
