DECREE OF November 16, 2000.

Creates the Marine Extractive Reserve of the Delta of the Parnaíba, in the Municipality of Grande de Santa Isabel, State of the Piauí, and in the Municipalities of Araióses and Water Sweet, State of the Maranhão, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, incisus IV, of the Constitution, and with a view to the provisions of Law No. 9,985 of July 18, 2000 and in Decree No. 98,897 of January 30, 1990,

Decrees:

Art. 1º It becomes created the Reserve Navy extractives of the Parnaíba delta, and in the Municipalities of Island Grande and Santa Isabel, State of the Piauí, Araióses and Water Doce, State of the Maranhão, with an approximate area of twenty-seven thousand, twenty-one hectares and sixty-nine centiars, with perimeter approx one hundred and four kilometers, nine hundred and thirty-one meters, having on the basis of the sheets MI 553 and MI 554, on the scale of 1:100.000, published by the Directorate of the Geographic Service, Ministry of Army, 2ª edition, 1978, with the next Descriptive Memorial: departing from point 1, of approximate geographical coordinates 02º43 ', 14.15??S and 42º01'10.33 " Wgr., located on the Island of the Canaries, on the right bank of the Rio Santa Rosa, when this landfall in the Atlantic Ocean, on the so-called Cajú Bay; of this one, follows by following the line of the average shoreline of the Canary Island shoreline, by a approximate distance of 10,312.03 meters, up to point 2, of approximate geographical coordinates 02º43??04.30??S and 41º56??08.01??Wgr., located on the left bank of the Igarapé of the Poldros, when this disembokes in the Atlantic Ocean; hence, it follows by a reta of azimuth of 89º11'10.76 " and a approximate distance of 638.0251m crossing the Igarapé of the Poldros to the point 3, of approximate geographical coordinates 02º43 ' 04.00 "S and 41º51'47.36" Wgr; located on the right bank of the igarapé of the Poldros, hence, it follows by the right margin of the cited Igarapé, in the sense amount, by a approximate distance of 4,508.42 meters, up to the point 4, of approximate coordinates 02º43 '28.83 " S and 41º53' 39.04" Wgr; located on the right bank of the Igarapé of the Poldros; hence, follows by a reta of azimut 151º11'35.36?? Art. 2º The Extractive Reserve Marine of the Parnaíba Delta has the object to ensure the self-sustaining exploitation and conservation of the renewable natural resources traditionally used by the area's extractivist population.

Art. 3º The area of the Reserve Extractivist, ora created, becomes declared of ecological and social interest, as advocated by art 2º of Decree No. 98,897, of January 30, 1990.

Art. 4º Caberá to the Brazilian Institute of the Environment and Resources Natural Renewables-IBAMA overseeing the area that treats this Decree, promote the necessary measures to formalize the actual concession contact of free use with the traditional Extrativist population, for effect of its celebration by the Ministry of Planning, Budget and Management, pursuant to Decree No. 3,125, July 29, 1999, and follow up with compliance with the conditions stipulated therein.

Art. 5º This Decree comes into effect on the date of its publication.
