DECREE NO. 4,582, OF January 30, 2003.

Regulaments the functioning of the National Food and Nutritional Safety Council-CONSEA, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that gives him art. 84, incisos IV and VI, paragraph "a" of the Constitution, and with a view to the provisions of the inciso III of the § 1st Art. 1st and in art. 9th, both of the Provisional Measure no 103, of ,

DECRETA:

Art. 1st The National Food and Nutritional Safety Council-CONSEA, the immediate advising body to the President of the Republic, aims to propose the general guidelines of the National Food and Nutritional Security Policy of the Executive Power.

Art. 2nd Compete to the CONSEA propose and pronounce on:

I-the guidelines of the National Food and Nutritional Security Policy, to be implemented by the Cabinet of the Minister of State Extraordinary of Food Safety and Combat to the Famine and by the remaining organs and executor entities of that Policy;

II-the priority projects and actions of the National Food and Nutritional Security Policy, to be included in the Multiannual Government Plan;

III-the ways to articulate and mobilize organized civil society, within the framework of the National Food and Nutritional Security Policy, establishing priority indications; and

IV-the realization of studies that substantiate the proposals linked to food and nutritional security.

Single paragraph. The CONSEA will stimulate the creation of state and municipal food and nutritional safety boards with which it will maintain close cooperative relations, especially in relation to actions defined as priority under the Policy National Food and Nutritional Safety.

Art. 3rd The CONSEA will consist of thirty-eight advisors, designated by the President of the Republic, who will represent the civil society, and by the following authorities:

I-Minister of State Extraordinary of Food Security and Combat to the Famine;

II-Minister of State for Agriculture, Livestock and Supply;

III-Minister of State for Agrarian Development;

IV-Minister of State for Education;

V-Minister of State for Finance;

VI-Minister of State for the Environment;

VII-Minister of State for Planning, Budget and Management;

VIII-Minister of State for Health;

IX- Minister of State for Assistance and Social Promotion;

X-Minister of State for Labour and Employment;

XI-Minister of State for National Integration;

XII-Minister of State Head of the Secretariat General of the Presidency of the Republic; and

XIII-Special Secretary for Policies for Women, of the Presidency of the Republic.

§ 1st The CONSEA will be chaired by one of the members representatives of civil society, designated by the President of the Republic, and secretariat by the Minister of State Extraordinary of Food Safety and Combat to the Famine.

§ 2nd Na first composition of the CONSEA, the mandate of the members representatives of civil society will be closed on March 30, 2004 or at the official opening date of the II National Food and Nutritional Security Conference, if this is earlier to that.

§ 3rd Powers to be invited to attend the meetings of the CONSEA, without the right to vote, holders of other public bodies or entities, as well as persons representing civil society, where of the Tariff in the subject matter of its acting area, or the judgment of its President.

§ 4th The CONSEA will have as permanent guests, in the condition of observers, representatives of the following bodies and entities:

I-Council for Economic and Social Development;

II-National Council for Sustainable Rural Development;

III-Special Advising of the President of the Republic;

IV-Intersetorial Commission of Food and Nutrition;

V-United Nations Children's Fund for Children-UNICEF;

VI-United Nations Organization for Agriculture and Food-FAO;

VII-United Nations Organization for Education, Science and Culture-UNESCO;

VIII-International Labor Organization-ILO

IX-World Bank; and

X-Inter-American Development Bank.

§ 5th The participation in the CONSEA is considered to be unpaid relevant public service.

Art. 4th O CONSEA will count on up to three permanent thematic chambers, which will prepare the proposals to be by him appreciated.

§ 1st thematic chambers will be comprised of advisors appointed by the President of the CONSEA, observed the conditions set out in the internal regiment.

§ 2nd In the drafting phase of the proposals to be submitted to the plenary of the CONSEA, the thematic chambers will be able to invite representatives of civil society entities, of organs and public and technical entities amade to the themes in them under study.

Art. 5th The CONSEA may institute groups of work, of temporary character, to study and propose specific measures.

Art. 6th The President of the CONSEA, the thematic chambers and working groups will count on the administrative and technical support of the Office of the Minister of State Extraordinary of Food Security and Combat to the Famine, and with resources secured by the Civil House of the Presidency of the Republic.

Art. 7th The CONSEA shall draw up its internal regiment by up to sixty days, from the date of your facility, and will be approved by the Minister of State Head of the Civil House of the Presidency of the Republic.

Art. 8th This Decree comes into effect on the date of its publication.
