DECREE OF December 26, 2011

Outorga to the West Coast Transmitter Power S.A. concession for exploration of the public service of electric power transmission, relative to the Transmission Line Cascavel West-Umuarama, Circuit Simple, at 230 kV, and to Substation Umuarama, 230/138 kV, both located in the State of Paraná.

THE CHAIRPERSON OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, incisus IV, of the Constitution, with a view to the provisions of the Laws No. 8,987 of February 13, 1995, paragraph 9,074, of July 7, 1995, and No. 9,648 of May 27, 1998 and what is stated in Processes No. 48500.000981 /2011-41 and n ° 48500.005996 / 2011- 04,

D E C R E T A:

Art. 1 ° Stay bestoed to the West Coast Energy Transmitter S.A. concession for operation of the public service of electric power transmission, upon construction, operation, maintenance and other associated facilities required for the measurement functions, supervision, protection, command, control, telecommunication, administration and support of the undertakings Line of Transmission Cascavel West-Umuarama, Simple Circuit, in 230 kV, and Umuarama Substation, 230/138 kV, both located in the State of the Paraná.

Art. 2 ° The concession that it treats this Decree shall apply for the period of thirty years, counted from the date of signature of the respective public service concession contract of electrical power transmission.

§ 1 ° The contract is to be signed within thirty days, counted from the convocation made by the National Electrical Energy Agency-ANEEL, under penalty of ineffectiveness of the outorgada concession.

§ 2 ° Mediant application of the West Coast Transmitter of Energy S.A. to ANEEL, submitted until thirty-six months prior to the expiry of the caputconstant deadline, the granting of which it treats this Decree may be extended under the conditions laid down.

Art. 3 ° The existing goods and facilities depending on the electrical power transmission service are linked to the public services granted, vetting the disposal, assignment, transfer or dation in warranty, without prior and express authorization from ANEEL.

Single paragraph. Fining the term of the concession, the goods and facilities linked to the provision of the public power transmission service granted will revert to the Union, in the form provided for in law and in the concession contract.

Art. 4 ° This Decree comes into effect on the date of its publication.
