DECREE NO. 3,807, OF April 26, 2001

Regulaments to Law No. 10,197 of February 14, 2001, which adds devices to Decree-Law No. 719 of July 31, 1969 to dispose of on funding for projects for deployment and recovery of research infrastructure at public institutions of higher education and research, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confers you the art. 84, inciso IV and VI, of the Constitution, and with a view to the provisions of Law No. 10,197, of February 14, 2001,

D E C R E T A:

Art. 1º The resources for the financing of projects of deployment and recovery of research infrastructure at the public higher education and research institutions, members of the National Scientific and Technological Development Fund-FNDCT, as provided for in the arts. 3º-e 3º -B of Decree-Law No. 719 of July 31, 1969, go on to be managed under the denomination of Infrastructure Fund-CT-INFRA.

Art. 2º THE CT-INFRA will support projects and actions that target deployment and recovery of research infrastructure in the public institutions of higher education and research.

Art. 3º The Ministry of Science and Technology, by means of porterie, will establish and maintain up-to-date glossary by setting the terms technicians and operational relating to this Decree.

Art. 4º Will be applied at the public higher education and research institutions based in the North, Northeast and Midwest regions, at the earliest thirty percent of the features intended for the CT-INFRA, as disposed of in the single paragraph of the art. 3º -B, of the Decree-Law No. 719, of 1969.

Art. 5º The Gestor Committee has the following composition:

I-a representative of the Ministry of Science and Technology, who will chair it;

II-two representatives of the Ministry of the Education;

III-a representative of the National Council for Scientific and Technological Development-CNPq;

IV-a representative of the Financier of Studies and Projects-FINEP;

V-one Representative of the Higher Level Personnel Improvement Coordination-CAPES;

VI-two representatives of the scientific community.

§ 1º The mandate of the members referred to the inciso VI will be of Two years, allowed a redrive.

§ 2º It is up to the Minister of State for Science and Technology to designate the members of the Gestor Committee.

Art. 6º The Gestor Committee will have the following assignments:

I-draw up and approve your internal regiment, in line with the general guidelines of the Ministry of Science and Technology and the Ministry of Education;

II-identify and select, taking into account the government policies in Science and Technology, the priority actions for the application of resources, as well as to draw up the Multiannual Investment Plan of the CT-INFRA;

III-elaboration of the Basic Document that will guide the CT-INFRA investments, describing the financing actions to projects for deployment and recovery of research infrastructure to be supported, specifying their strategies, targets, criteria, mechanisms, procedures, indicators, budgets and resources;

IV-establish, in line with the general guidelines of the Ministry of Science and Technology and the Ministry of Education, the criteria for the submission of project proposals, the parameters of judgment and the value limits of the financial support applicable to each case, and deliberating on the allocation of resources;

V-elaboration of the Operative Manual, containing the operational and administrative regulations and procedures necessary for the implementation of the CT-INFRA;

VI-follow up the development of the actions supported by the CT-INFRA, periodically evaluating their results;

VII-recommend the hiring of studies and the setting up of technical groups and advising committees for specific actions of interest of the CT-INFRA;

VIII-deliberation on the recommendations of the advisory committees;

IX-establish control criteria so that the operational expenditure incidents on the FNDCT for the implementation of the CT-INFRA activities do not exceed the amount corresponding to five percent of the resources raised annually;

X-judging, in last instance, the administrative resources of authorship of project proponents and beneficiaries of funding contesting acts and decisions regarding the administration of the resources of the CT-INFRA;

XI-deliberation on the cases missing, relative to the reference documents set out in the incisos I, II, III and V.

Art. 7º For the performance of its assignments, the Gestor Committee:

I-submit to the approval of the Minister of State of Science and Technology the instruments provided for in the incisos II, III and V of the preceding article, as well as their changes;

II-shall convene in an ordinary manner, by obeying the annual calendar previously approved by the Colegiate, and, extraordinarily, when convened by its President or by the majority of its members;

III-shall submit to the Minister of State for Science and Technology solicitation for the immediate replacement of the member who cede to attend unjustifiably, for three consecutive times, to meetings of the Council.

§ 1º The Chair of the proceedings, in the case of absence of the representative of the Ministry of Science and Technology, shall be delegated, by his or her choice, to any one of the members of the Committee.

§ 2º The Gestor Committee's deliberations will be taken by a majority of votes from those present, by the President the common and de-tie votes.

§ 3º The representatives of government institutions may be replaced in accordance with the criteria and interest of the Public Administration.

§ 4º At the discretion of the Gestor Committee, they will be able to be convened to attend their expert meetings and representatives of other Ministries, with no voting rights.

§ 5º The Gestor Committee will be able to use technical grants presented by advisory groups, experts from the productive sector, members of the academic community and of technical areas linked directly or indirectly to the activities of scientific research and technological development.

§ 6º The Gestor Committee deliberations will be recorded in synthetic-form-washed acts, which will be distributed to its members and archived in the Ministry of Science and Technology.

§ 7º The Gestor Committee will promote broad dissemination of its acts and the evaluation of results of the activities financed with resources of the CT-INFRA.

Art. 8º The Ministry of Science and Technology will provide the Gestor Committee with the technical, administrative and financial support for its functioning.

§ 1º The Gestor Committee will be able to request the collaboration of public fosters agencies, legal persons of public and private non-profit law and physical persons who develop or support, in a systematic way, scientific research and technological development activities, to implementation of their decisions.

§ 2º The actions to be carried out by the institutions mentioned in the preceding paragraph shall develop through institutional and inter-institutional arrangements, contracts, financing direct or any other instruments provided for in the legislation.

Art. 9º The Ministry of Science and Technology will coordinate the process of raising the financial resources earmarked for the CT-INFRA and will maintain system of control and specific accounting, regularly reporting to the Gestor Committee its financial and budgetary position.

Single paragraph. Fund administrators constituted or who come to be constituted with views to financially support the scientific and technological development of specific economic sectors, as provided for in the inciso II of the art. 3º-A of the Decree-Law No. 719, of 1969, shall inform the Ministry of Science and Technology, quarterly, the amount raised and carry out the respective deposit in the FNDCT of the parcel due to the CT-INFRA within up to twenty days.

Art. 10. Will be published in the Official Journal of the Union the acts of approval of the internal regiment, of the basic document, of the operative manual, of the Multiannual Plan of Investments and the excerpts of convents of the contracted projects, as well as others who require this requirement.

Single paragraph. The remaining actions regarding the implementation of the activities of the CT-INFRA will be widely disseminated by the Ministry of Science and Technology by the available means and, including, by the electronic rapid processing and dissemination systems of the information.

Art. 11. Minister of State for Science and Technology will be able to download instructions necessary for the fulfillment of the provisions of this Decree.

Art. 12. This Decree comes into force on the date of its publication.
