DECREE OF November 24, 2005.

Declara of social interest, for purposes of agrarian reform, the rural real estate named "Fazenda Serra Alegre", situated in the Municipality of Bodoquena, State of Mato Grosso do Sul, and gives other providencies.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confers the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2nd of the Supplemental Act no 76, of July 6, 1993, 18 and 20 of the Law no 4,504, of November 30, 1964, and 2nd of Law no 8,629, of February 25, 1993,

DECRETA:

Art. 1º Stay declared of social interest, for the purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law no 4,504, of November 30, 1964, and 2nd of the Law no 8,629, of February 25, 1993, the rural real estate named "Fazenda Serra Alegre", with area of a thousand, seven hundred and fifty and one hectares, twenty-five airs and seventy five centiars, situated in the Municipality of Bodoquena, object of the Registry in the R-2-5.625, fls. 01, Book 2-AJ, of the Estate Registration Office of the Comarch of Miranda, State of Mato Grosso do Sul (PROC/INCRA/SR-16 / No 54290.000393 /2004-02).

Art. 2º Excludes from the effects of this Decree the soothing, the machines and the agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1st and belonging to those who will be benefited from their intended purpose.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the rural impropriation of the rural real estate from which it treats this Decree, in the form provided for in the Supplementary Act no 76, of July 6, 1993, and to keep the areas of Reserva Legal and permanent preservation, provided for in the Law no 4,771, of September 15, 1965, preferentially in single gleba, so as to reconcile the settlement with the preservation of the environment.

Art. 4º This Decree goes into effect on the date of its publication.
