DECREE OF September 19, 2002

Creates the Cazumbá-Iracema Extrativist Reserve, in the Municipalities of Sena Madureira and Manoel Urbano, in the State of the Acre, and gives other arrangements.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers it on art. 84, inciso IV, of the Constitution, and with a view to art. 18 of Law No. 9,985 of July 18, 2000 and in Decree No. 98,897 of January 30, 1990,

D E C R E T A:

Art. 1º It is created the Cazumbá-Iracema Extrativist Reserve, in the Municipalities of Sena Madureira and Manoel Urbano, in the State of the Acre, with the objectives of ensuring the sustainable use and conservation of renewable natural resources, protecting the means of living and the culture of the local extractivist population.

Art. 2º The Cazumbá-Iracema's Extractivist Reserve covers an area of approximately 750,794.70 ha (setecentos and fifty thousand, seven hundred and ninety and four hectares and seventy centiars), with the following descriptive memorial: departing from Point 01, of approximate geographical coordinates 68 ° 50 ` 37.55?WGr and 9 ° 05 ` 46, 81?S, situated on the left bank of the Caeté River, follow by this margin, in the sense amount, by a approximate distance of 14,961.79 meters, up to Point 02, of approximate geographical coordinates 68 ° 53 ` 55.07?WGr and 9 ° 07 ` 53.58?S, located at the mouth of the Igarapé Mimitem with the Caeté River; of this one, it follows by the left bank of the Igarapé Mimitem, in the sense amount, by a approximate distance of 17,339.62 meters, up to Point 03, of approximate geographical coordinates 68 ° 53 ` 07, 32?WGr and 9 ° 16 ` 08, 44?S, located on the left bank of the Igarapé Mimitem; of this one, follows by a straight of azimut 108 ° 18 ` 10 " and approximate distance of 1,327.86 meters, up to Point 04, of approximate geographical coordinates 68 ° 52 ` 25, 99?WGr and 9 ° 16 ` 22.00?S, located on the Road of the Cachoeira; of this one, follows by the said road, in the southwest sense, confronting with the Colonization Project Good Hope, by an approximate distance of 47,028.22 meters, up to Point 05, of geographical coordinates approximate 69 ° 04 ` 01, 12?WGr and 9 ° 33 ` 53.56?S, located on the Road of the Cachoeira; of this, follows, confronting with the Seringal Santa Luzia, by a straight of azimut 177 ° 06 ` 16 " and approximate distance of 12,479.93 meters, up to Point 06, of approximate geographical coordinates 69 ° 03 ` 40.52?WGr and 9 ° 40 ` 39, 41?S, located on the left bank of the Macauan River; of this one, it follows by the left bank of the Macauan River, in the sense amount, by an approximate distance of 31,807.64 meters, up to Point 07, of approximate geographical coordinates 69 ° 12 ` 12.02?WGr and 9 ° 48 ` 03, 80?S, located on the left bank of the Macauan River with the Point P-14 of the National Forest of the Macauan; It is excluded from the polygon described in the caput of this article an area of approximately 9,878.48 ha (nine thousand, eight hundred and seventy and eight hectares and forty-eight centiars), with the following descriptive memorial: departing from Point A1, of coordinates approximate geographical 69 ° 09 ` 39, 12?WGr and 9 ° 10 ` 49, 63?S, situated at the confluence of the Caeté River with the Canamari River; follows by the right bank Rio Caeté, in the sense amount, by an approximate distance of 30,297.43 meters, up to the Point A2, of approximate geographical coordinates 69 ° 18 ` 11, 27?WGr and 9 ° 15 ` 37, 83?S, located at the confluence of the Caeté River with the Igarapé São Paulo; hence, it follows by the right bank of the Igarapé São Paulo, in the sense amount, by a approximate distance of 4,465.60 meters, up to the Point A3, of approximate geographical coordinates 69 ° 17 ` 23.04?WGr and 9 ° 17 ` 39, 15?S, located in the nascent of this igarapé; hence, follows by a straight azimut 172 ° 46 ` 22? and approximate distance of 2,795.21 meters, up to Point A4, of approximate geographical coordinates 69 ° 17 ` 11.59?WGr and 9 ° 19 ` 09, 46?S, located in the nascent of an igarapé without denomination; of this one, follows by a straight azimut 46 ° 40 ` 35? and approximate distance of 2,483.54 meters, up to Point A5, of approximate geographical coordinates 69 ° 16 ` 12, 32?WGr and 9 ° 18 ` 14.02?S, located in the spring of another Igarapé without denomination; hence, it follows by the left margin of this igarapé, in the downstream sense, by an approximate distance of 6,139.45 meters, up to the Point A6, of approximate geographical coordinates 69 ° 13 ` 19, 37?WGr and 9 ° 17 ` 09, 80?S, at the confluence of this Igarapé with the Canamari River; hence, it follows by the left bank of the Canamari River, by a approximate distance of 18,016.65 meters, up to the Point A1, start of this descriptive, perimeter a perimeter of approximately 64,197.89 meters (sixty-four thousand, one hundred and ninety-seven meters and eighty-nine centimeters).

Art. 3º The lands contained in the boundaries described in art. 2º of this Decree, belonging to the National Institute of Colonization and Agrarian Reform-INCRA, will be transferred to the Brazilian Institute of the Environment and Renewable Natural Resources-IBAMA, in the form of the law.

§ 1º The lands referred to in the caput will be the subject of Legal Reserve area compensation of the projects agro-extractivists, of settlement and colonization, created by the INCRA, pursuant to Law No. 4,771, of September 15, 1965.

§ 2º The IBAMA and the INCRA, together, will lower the standards for the effective implementation of this article.

Art. 4º Ficam declared of public utility, for purposes of misappropriation by IBAMA, private real estate constituted of existing land and benfeits in the limits described in the art. 2º of this Decree, in the terms of the arts. 5, point (? l?, and 6, of the Decree-Law n3.365 of June 21, 1941.

Art. 5º Caberá ao IBAMA to administer the Cazumbá-Iracema Extrativist Reserve by adopting the necessary measures to its effective deployment, formalizing the contract of actual free use concession with the traditional extractivist population, and tracking compliance with the conditions in it stipulated, in the terms of the arts. 3a to 5º of Decree No. 98,897, of June 30, 1990.

Art. 6º This Decree enters into vigour on the date of its publication.
