CONSTITUTIONAL AMENDMENT NO. 51, OF February 14, 2006
Adds the § § 4º, 5º and 6º to the art. 198 of the Federal Constitution.
The Mesas of the House of Representatives and the Senate Federal, in the terms of art. 60 of the Federal Constitution, promulgate the following Amendment to the constitutional text:
Art. 1º The art. 198 of the Federal Constitution passes the increased vigour of the following § § 4º, 5º and 6º:
" Art. 198. ........................................................

§ 4º Local managers of the single health system will be able to admit community health agents and combat agents to the endemias through selective public process, according to the nature and complexity of their attributions and specific requirements for their acting.
§ 5º Federal law will have on the legal regime and regulation of the activities of community health agent and agent of combat endemies.
§ 6º In addition to the hypotheses provided for in § 1º of the art. 41 and in § 4º of the art. 169 of the Federal Constitution, the server exercising duties equivalent to those of community health agent or endemic combat agent may lose the office in the event of a failure to comply with the specific requirements, fixed in law, for their exercise. Art 2º Following the promulgation of the present Constitutional Amendment, community health officers and endemic combat agents will only be able to be hired directly by the states, the Federal District or the Municipalities in the form of the § 4º of the art. 198 of the Federal Constitution, observed the limit of spending set out in the Supplementary Act that it treats art. 169 of the Federal Constitution.
Single paragraph. The professionals who, on the date of promulgation of this Amendment and to any title, perform the activities of community health agent or combat agent endemias, in the form of the law, are exempted from submitting to the selective process public as referred to in § 4º of the art. 198 of the Federal Constitution, provided that they have been hired from the previous Public Selection process carried out by organs or the heads of the direct or indirect administration of State, Federal District or Municipality or by other institutions with the effective supervision and authorization of the direct administration of the federation's ents.
Art. 3º This Constitutional Amendment goes into effect on the date of its publication.
