DECREE NO. 4,343, OF August 26, 2002

Disposes on the execution of the Sixth Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and of the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community), 28 from June 2002.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that gives it the art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), firmed by Brazil on August 12, 1980 and approved by the National Congress, through the Legislative Decree No. 66 of November 16, 1981, provides for the modality of Complementation Agreement Economic;

Whereas, on the basis of the Treaty of Montevideo of 1980, the Agreement of Economic Complementation No. 39 was firmed by the Plenipotentiaries of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Community Andina), in Montevideo, on August 11, 1999, and incorporated into the Brazilian legal planning by means of Decree No. 3,138, of August 16, 1999;

Whereas the Plenipotentiaries of the Federative Republic of Brazil and of the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of the Venezuela, on the basis of the Treaty of Montevideo of 1980, signed in Montevideo, respectively on August 8, 2001 and December 28, 2001, the Third Additional Protocol (Decree No. 4,015 of November 13, 2001) and the Fifth Additional Protocol (Decree No. 4,164, of March 12, 2002), which extended the term of the Economic Supplementation Agreement No. 39, respectively until December 31, 2001 and until June 30, 2002, pursuant to Article 22 of the Original Protocol of the Agreement of Economic Complementation No. 39;

Whereas the Plenipotentiaries of the Republic Federative of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela, in reaffiring the will of the signatory countries to continue the negotiations of an economic complementation agreement between the member countries of MERCOSUR and the Andean Community to create a free trade zone, they signed on the basis of the 1980 Treaty of Montevideo on June 28, 2002 in Montevideo, the Sixth Additional Protocol, which is aimed at extending the term of the Economic Supplementation Agreement No. 39, from 1º July 2002 a to September 30, 2002;

D E C R E T A:

Art. 1º The Sixth Additional Protocol to the Economic Supplementation Agreement No. 39, between the Governments of the Federative Republic of Brazil and the Republic of Colombia, the Republic of Ecuador, the Republic of Peru and the Bolivarian Republic of Venezuela (member states of the Andean Community) of June 28, 2002, apensed by copy to the present Decree, will performed and fulfilled as entirely as it contains.

Art. 2º This Decree comes into effect on the date of its publication.
