DECREE OF February 25, 2003.

Declares of social interest, for purposes of agrarian reform, the rural real estate it mentions, and gives others providences.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignments that confer upon him the arts. 84, inciso IV, and 184 of the Constitution, and in the terms of the arts. 2º of the Supplemental Act No. 76, of July 6, 1993, 18 and 20 of the Act No. 4,504, of November 30, 1964, and 2º of the Act No. 8,629, of February 25, 1993,

DECRETA:

Art. 1º Ficam declared of social interest, for purposes of agrarian reform, in the terms of the arts. 18, letters "a", "b", "c" and "d", and 20, inciso VI, of the Law no 4,504, of November 30, 1964, and 2º of the Law no 8,629, of February 25, 1993, the following rural real estate:

I-"Tingui", with area of four hundred and Forty-four hectares and fifty two airs, situated in the Municipality of Girau do Ponciano, object of the Registry in the R-1-3.001, Ficha 01, Book 2, of the Estate Registration of Estate of the Comarch of Girau of the Ponciano, State of Alagoas (Process INCRA/SR-22/nº 54360.000143 /2002-21);

II-"Fazenda Our Lady Aparecida", with area of a thousand, thirteen hectares, twenty-nine airs and seventy five centiars, situated in the Municipality of Formoso, object of the Matriculation in the 266, fls. 166, Book 2-B, of the Estate Registration Office of the Comarch of Formoso, State of Goiás (Case INCRA/SR-04/nº 54150.000201 /00-41);

III-"Fazenda Santana", with area of four thousand, five hundred and fifty hectares, situated in the Municipality of Rosario, object of the Matriculation on the 1,518, fls. 41, Book 2-I, of the Carthorium of the 1º Oftice of the Comarch of Rosary, State of the Maranhão (Process INCRA/SR-12/nº 54230.000651 /98-01);

IV-known as "Blood", with area of two thousand, two hundred and twelve hectares, eighty and five ares and eighty centiars, situated in the Municipality of Chapadinha, object of the Registry in the R-10-49, fls. 63, Book 2-A, of the Carthorium of the 1º Oftice of the Comarch of Chapadinha, State of the Maranhão (Process INCRA/SR-12/nº 21530.000771/96);

V-"Beautiful River Farm", with area of two thousand, five hundred and eighty six hectares, seventy five ares and seventy nine centiars, situated in the Municipality of Good Jesus of the Selves, object of the Registry in the R-2-2.027, fls. 149, Book 2-G, of the Carthorium of the 1º Oftice of the Comarch of Santa Luzia, State of the Maranhão (Process INCRA/SR-12/nº 54234.000442 /2001-21);

VI-"Fazenda Porto Novo", with area of seven thousand, seven hundred and forty five hectares, eighty and one ares and ninety centiars, situated in the Municipality of Jequitinhonha, object of the Registry in the AV-1-6.367, Ficha 4,253, Book 2-RG, of the Estate Registration of Estate of the Comarch of Jequitinhonha, State of Minas Gerais (Process INCRA/SR-06/nº 54170.006539 /2002-10);

VII-"Farmhouse Santa Célia", with area of nine thousand, nine hundred and ninety and one hectares, situated in the Municipality of Nova Xavantina, object of the Registry in the R-1-2.014, Book 2, of the Carthorium Real estate Record of the Bar Comarch of the Garces, State of Mato Grosso (Case INCRA/SR-13/nº 54241.000130 /97-26);

VIII-"Fazenda Santa Maria and Cateandeua", with area of novecents and twenty-one hectares, twenty and Seven ares and ninety-nine centiars, situated in the Municipality of Concordia of the Pará, object of the Registry in the R-8-3.122, Book 2-J, of the 1º Offer of the Comarch of Bethlehem, State of the Pará (INCRA/BR/no 54000.000823 /99-50);

IX-"Engenho Bom Jesus and Others", with area of two hundred and forty-five hectares and fifty seven airs, situated in the Municipality of Amaraji, object of the Records in the R-1-77, fls. 40, Book 2-A; R-1-75, fls. 38, Book 2-A; R-1-78, fls. 41, Book 2-A; R-1-76, fls. 39, Book 2-A and Matriculation at 289, fls. 66, Book 2-C, of the Estate Registration Office of the Comarch of Amaraji, State of Pernambuco (Process INCRA/SR-03/nº 54140.001549 /2001-35);

X-"Fazenda Serrote Redondo", with area of three hundred and sixty-four hectares, situated in the Municipality of Arcoverde, object of the Matriculation on the 1,856, fls. 33, Book 2-J, of the Estate Registration Office of the Comarch of Arcoverde, State of Pernambuco (Process INCRA/SR-03/nº 54140.000057 /2001-22); and

XI-"Fazenda Pitombeira and Others", with area of five hundred and thirty-one hectares and ten ares, situated in the Municipalities of Angelim, Calwear and Canhotinho, object of the Records in the R-2-424, fls. 344, Book 2-A; R-1-331, fls. 251, Book 2-A; R-1-1.058, fls. 58, Book 2-C; Matriculation at 10,080, fls. 92v, Book 3-AB, from the Estate Registration Office of the Canhotinho Comarch, and Registration at R-2-898, fls. 159, Book 2-E, of the Real-estate Registration Office of the Comarch of Angelim, State of Pernambuco (Case INCRA/SR-03/nº 54140.001417 /2001-11).

Art. 2º Excludes from the effects of this Decree the Semoters, the machines and agricultural implements, as well as the existing benfeons in the real estate referred to in art. 1º and belonging to those who will be benefited from their targeting.

Art. 3º The National Institute of Colonization and Agrarian Reform-INCRA is allowed to promote the dispropriations of rural real estate from which treats this Decree, in the form provided for in the Supplementary Act no 76, of July 6, 1993, and to keep the areas of Legal Reserve and permanent preservation provided for in the Act no 4,771, of September 15, 1965, preferentially in single gleba, so as to reconciling the settlement with the preservation of the environment.

Art. 4º This Decree comes into force on the date of its publication.
