Declarations of public utility, for the purposes of dispropriation, in favor of the Autopista Coastal Sul S.A., the estate that mentions, located in the Municipality of Itajaí, State of Santa Catarina.

THE CHAIRWOMAN OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 3º, art. 5º, caput, points "h" and "i", and 6º of the Decree-Law No. 3,365, of June 21, 1941, in art. 29, caput, inciso VIII, and art. 31, caput, inciso VI, of Law No. 8,987, of February 13, 1995, and in accordance with what appears in the ANTT Process No. 50500.032097 /2012-07,

D E C R E T A:

Art. 1º It shall be declared of public utility, for the purposes of dispropriation, in whole or in part, in favour of the Autopista Coastal Sul S.A., the immovable bounded by the topographical coordinates described below, excluded the public domain goods, adjacent to the Highway Governor Mário Covas, 101/SC, in the Municipality of Itajaí, State of Santa Catarina, necessary for the execution of the side street implantation works on the stretch between km 123 + 580m and km 125 + 608m, at the South Pista.

Single paragraph. The description initiates if in the milestone named 'point 1', georreferenced in the Brazilian Geodetic System, DATUM-SIRGAS 2000, MC-51 °W, coordinated Retangular Plan Relatives, UTM System: E= 730,313 ,927m and N= 7,016,714 ,104m dividing it with property 01; of this, follows, confronting with ownership of Sanwer Participações Ltda. with the azimuth of 268 ° 58 '48 " and the distance from 16 ,91m to the milestone' point 2 ' (E=730.297 ,023m and N=7.016.713, 803m); of this, follows, confronting with Sanwer Participants Ltda. with the azimuth of 352 ° 04 '16 "and the distance from 45 ,70m to the milestone' point 3 '(E=730.290, 719m and N=7.016.759 ,066m); of this, follows, confronting with Sanwer Participações Ltda. with the azimuth of 36 ° 43' 48" and the distance from 26 ,31m to the milestone 'point 4' (E=730.306, 451m and N=7.016.780, 149m); of this, it follows, confronting with the 101/SC with the azimuth of 167 ° 30 '04 " and the distance from 21 ,33m to the milestone' point 5 ' (E=730.311 ,067m and N=7.016.759, 324m); of this, it follows, confronting with the 101/SC with the azimut of 169 ° 51'07 "and the distance from 19 ,48m to the milestone 'point 6' (E=730.314, 499m and N=7.016.740, 152m); of this, follows, confronting with the 101/SC with the azimuth of 181 ° 15 '29" and the distance from 26 ,05m to the milestone' point 1 ' (E=730.313, 927m and N=7.016.714, 104m), with the perimeter of the polygon described with surface area of a thousand, one hundred and six square meters and sixty-one square centimeters.

Art. 2º It is the concessionaire Coastal Sul S.A. authorised to promote, with own resources, the disappropriation of the area of land and benfeits of which it treats art. 1º.

Single paragraph. The expropriating shall be allowed to invoke the character of urgency in the process of dispropriation, for purposes of impropriation in the possession, pursuant to art. 15 of the Decree-Law No. 3,365 of June 21, 1941.

Art. 3º The declaration of public utility does not exonerate the dealership of the prior obtaining of the licensing and the fulfilment of the obligations attached to the environmental entities and too many organs of the public administration.

Art. 4º This Decree takes effect on the date of its publication.
