DECREE NO. 4,159, OF March 12, 2002

Disposes on the execution of the 10th Additional Protocol to the Economic Supplementation Agreement No. 36, between the Governments of the Federative Republic of the Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to Mercosur, and the Government of the Republic of Bolivia of June 19, 2001.

THE PRESIDENT OF THE REPUBLIC, in the use of the assignment that confers you the art. 84, inciso IV, of the Constitution,

Considering that the Treaty of Montevideo of 1980, which created the Latin American Integration Association (ALADI), signed by Brazil on August 12, 1980 and approved by the National Congress, by the Legislative Decree No. 66, of November 16, 1981, provides for the modality of Partial Reach Agreement of Economic Supplementation;

Whereas the Plenipotentiaries of the Federative Republic of Brazil, of the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, States Parties to the Common Market of the South (Mercosur), and of the Republic of Bolivia, based on the Treaty of Montevideo of 1980, signed on June 19, 2001 in Montevideo, the Tenth Additional Protocol to the Economic Supplementation Agreement No. 36 (Resolution No. 02/00 of the Administrative Commission of the ACE-36-Transient Regime of Origin), between the Governments of the Federative Republic of Brazil, of the Argentine Republic, of the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to Mercosur, and the Government of the Republic of Bolivia;

D E C R E T A:

Art. 1º The Tenth Protocol Additional to the Complementation Agreement Economic No. 36 (Resolution No. 02/00 of the Administrative Commission of the ACE-36-Transitional Regime of Origin), between the Governments of the Federative Republic of Brazil, the Argentine Republic, the Republic of Paraguay and the Eastern Republic of Uruguay, as States Parties to the Common Market of the South (Mercosur), and the Government of the Republic of Bolivia, aped by copy to the present Decree, will be executed and fulfilled as entirely as it contains.

Art. 2º This Decree enters into vigour on the date of its publication.

CONCLUDED BETWEEN THE GOVERNMENTS OF THE STATES PARTIES OF MERCOSUR AND THE GOVERNMENT OF THE REPUBLIC OF BOLIVIA

Tenth Additional Protocol

The Plenipotentiaries of the Argentine Republic, the Federative Republic of Brazil, the Republic of Paraguay and the Eastern Republic of Uruguay, in their condition of States Parties of the Common South Market (MERCOSUR), on the one hand, and of the Republic of Bolivia, by another, accredited by their respective Governments second powers that were bestowed in good and due form, deposited timely in the General Secretariat of the Latin American Integration Association (ALADI),

HAVING IN A VIEW TO Resolution MCS-BO N ° 02/00 of the Administrative Commission of ACE 36,

DECK IN:

Article 1º-Apply, from December 15, 2000 to June 30, 2001, the special treatment, provided for in Appendix 2, letter b), of the Annex No. 9, of the Origin Regime for the products included in the aforementioned Appendix.

Article 2º-Exceed from the provisions of Article 1º items 6205.20.00 and 6205.30.00. For these items, the transitional arrangement of origin will be in place for the certifications that are issued until December 31, 2001.

The General Secretariat of ALADI will be depositary of this Protocol, of which it will send copies duly authenticated to the signatory Governments.

IN FÉ OF WHAT, THE RESPECTIVE PLENIPOTENTIARIES SIGN the present Protocol in the city of Montevideo, to the nineteen days of the month of June two thousand and one, in an original in the idioms Portuguese and Spanish, being both texts being equally valid.
