Declara of public usefulness, for purposes of misappropriation, total or partial, or de pass-through administrative servitude institution, in favor of Brazilian Petroleum S.A. -PETROBRÁS, the real estate it mentions, situated in the State of Rio de Janeiro, necessary for the construction of Oleodus from the January-Comperj River Petrochemical Complex, and gives other providences.

THE CHAIRPERSON OF THE REPUBLIC, in the use of the attribution that confers it on art. 84, caput, inciso IV, of the Constitution, with a view to the provisions of the art. 5º of the Decree-Law No. 3,365 of June 21, 1941, in Decree-Law No. 1,075 of January 22, 1970, and what is stated in Processes ANP No 48610.003453 /2010-16 and MME No 48000.001661 /2012-21,

D E C R E T A:

Art. 1º Become declared of public utility, for purposes of disappropriation, total or partial, or of institution of administrative servitude of passage, in favor of Brazilian Petroleum S.A. -PETROBRÁS, or of society by this controlled, directly or indirectly, which comes to be in charge of the construction, installation and operation of the pipelines and the transportation of oil and its derivatives, and the one that comes to be in charge of maintenance, repair and surveillance of ducts, communication cables and other necessary for the proper operation of the moving and transport facilities of oil and its derivatives, the real estate constituted of land and benfews, of private property, excluded the public domain goods, understood in the areas and lanes of land with approximately two million, nine hundred and fifty-three thousand, seven hundred and twenty-one square metres, situated in the Municipalities of Guapimirim, Magé and Duke of Caxias, State of Rio de Janeiro, whose administrative constraints are indispensable to the construction of the Olepipelines of the January-Comperj Petrochemical Complex, including its optical communication and data transmission cables, networks of networks of electric power buried or aerial, cathodic protection system, too much works and respective complementary facilities.

Art. 2º Brazilian Oil S.A. -PETROBRÁS, or company by it controlled, directly or indirectly, is authorized to promote, with own resources, amicably or judicially, the disappropriation, in whole or in part, or the institution of administrative servitude of passage, in case in that will be compensated, when cableable, the values already indensed in the perpetual servitude of passage instituted in favor of PETROBRÁS on the land area of which it treats this Decree, and may, including, invoke the urgency character for the purposes of provisional immission in the possession of the goods, in the terms of the art. 15 of the Decree-Law No. 3,365 of June 21, 1941 and of the Decree-Law No. 1,075 of January 22, 1970.

Art. 3º The public utility statement of which it treats this Decree does not exonerate PETROBRÁS from the prior obtaining of the licensing and fulfilment of the obligations attached to environmental entities and other public administration bodies, necessary to effectuate the of the works and activities referred to in art. 1º.

Art. 4º This Decree comes into effect on the date of its publication.
